It is submitted that the industry is a rice sheller unit, which falls under small scale orange category and has been established after obtaining consent to establish (NOC) vide no. CTE/Fresh/FZR/2022/19062324 dated 05.07.2022, valid upto 30.06.2023 for manufacturing of Raw Rice With Dryer @ 5 TPH and Sorted Rice @ 5 TPH, under Orange category, with certain conditions mentioned therein.                        Now, the industry has applied for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981 for the manufacturing of Raw Rice With Dryer @ 5 TPH and Sorted Rice @ 5 TPH, under Orange category. The detail of case is as under:-                        The industry has submitted electricity bill as a proof of date of commissioning of its unit, which shows that electric connection has been issued to M/s A.K. Overseas, VPO Ratoul, Tehsil Zira Distt. Ferozepur on dated 13.09.2022.                        The industry has submitted proposed building plan under section-6 of the Factories Act, 1948 and Punjab Factories Rules 1952 from the Director of Factories, Punjab Department of Labour, SAS Nagar, which is duly signed by Er. Hanish Gupta, Competent Person, Approved under Factories Act, 1948.                        The industry has deposited Rs. 56,700/- vide UTR/Ref. No.  N052232339907365 dated 21.02.2023 as water consent fee under the Water Act, 1974 and Rs. 56,700/- vide UTR/Ref. No.   N052232339903801 dated 21.02.2023 as air consent fee under the Air Act, 1981, against the fixed assets of Rs. 250.82 Lakhs as on 31.01.2023 as per CA certificate submitted by it. Thus, the consent fee is adequate upto 30.09.2027 under each Acts..                        The industry was visited by AEE of this office on 02.03.2023 and it was observed as under:- 1.            The industry was not in operation during visit. The industry has installed machinery for the production of sorted raw rice with dryer. 2.            The industry has covered all the processing sheds. 3.            The industry has provided brick paved road from main gate of the industry to the rice room/husk area for the movements of vehicles. 4.            The industry has provided separate Cyclone Separator as APCD along with stack of adequate height to control the process emission from shelling section as well as paddy cleaner of  dryer. 5.            The industry has provided stack of adequate height with the APCD and provisions to facilitate emission sampling. 6.            The rice husk discharge area of M/s A K Overseas and M/s A K Agro Tech are towards the wall of their processing sheds. The length of the said wall is more than 70 feet and height is more than 15 feet. 7.            The industry has provided septic tank for treatment of domestic effluent with provision to discharge onto land for irrigation along the boundary. 8.            The industry has planted trees along its boundary wall.                        The industry is complying with the code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no 10/48/2004-STE-(4) / 932 dated. 15/10/2013. The competency for grant of consents to the rice shellers with dryer lies with the Environmental Engineer of the Regional Office.                             Keeping in view of above mentioned facts, it is, therefore, recommended that consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may be granted to the industry for a period upto 30/09/2027 for operation of rice sheller unit to manufacture Raw Rice With Dryer @ 5 TPH and Sorted Rice @ 5 TPH, under Orange category, subject to the suitable conditions.
