CTOW/Fresh/RPN/2022/17955314 dated 27/04/2022 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/RPN/2022/17955301 dated 27/04/2022, both of which were valid upto 31/12/2022 for Scaffolding of different sizes and Accessories @ 20 Metric Tonnes/Day subject to suitable terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-US; mso-fareast-language: EN-US;"><span style="mso-tab-count: 2;"> </span>The Industry </span><span style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; background: white;">was earlier given show cause notice alongwith an opportunity of personal hearing before the Senior Environmental Engineer of the Board on 06.04.2022, wherein, it was decided as under:</span></p>

<p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-US; mso-fareast-language: EN-US;"><span style="mso-tab-count: 2;"> </span>The industry has applied for obtaining renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-US; mso-fareast-language: EN-US;"><span style="mso-tab-count: 2;"> </span>The industry has also submitted a land use classification issued by District Town Planner, Rupnagar, Deptt. of Housing & Urban Development, Punjab vide letter no. 158 DTP(R)/LUC dated 06.02.2023, wherein, it has mentioned that the site falls under industrial zone and as such is suitable for establishment of such units.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-US; mso-fareast-language: EN-US;"><span style="mso-tab-count: 2;"> </span>The industry was visited by the officer of the Board on 24.02.2023 and Sh. Raghuveer Chand Sharma, Manager was contacted. During visit, it was observed as under:</span></p>

The industry has installed power presses and forging presses for the cutting and moulding of channel, sheets and angles.</span></p>

The representative was also advised to maintain the record of the water consumption.</span></p>

Further, the unit has requested that it will apply for varied consent before operating the galvanising process as the consents of existing unit/process is pre-requisite for grant of varied consents.</span></p>
<p class="MsoListParagraph" style="margin-left: .25in; text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l2 level1 lfo3;"><!-- [if !supportLists]--><span style="mso-bidi-font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; background: white;">The industry has provided septic tank for the treatment of domestic effluent and the outlet of the same has been diverted to plantation along the boundary. Further, the industry is also developing a patch of land in the premises for the plantation purpose.</span></p>
<p class="MsoListParagraph" style="margin-left: .25in; text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l2 level1 lfo3;"><!-- [if !supportLists]--><span style="mso-bidi-font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; background: white;">The industry has installed a DG set of capacity 80 KVA with canopy and stack of adequate height.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-US; mso-fareast-language: EN-US;"><span style="mso-tab-count: 2;"> </span>The industry is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as the industry has started expansion of the unit without obtaining consent to establish (NOC) of the Board. Thus, violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 intentionally and deliberately.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-US; mso-fareast-language: EN-US;"><span style="mso-tab-count: 2;"> </span>It was proposed to refuse the consent applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity of show cause.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-US; mso-fareast-language: EN-US;"><span style="mso-tab-count: 2;"> </span>The matter was considered by the Competent Authority and it was decided to take the action against the industry under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity of show cause- due to aforesaid reasons.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-US; mso-fareast-language: EN-US;"><span style="mso-tab-count: 2;"> </span>Therefore, the industry was given an opportunity to show cause in person before the SEE (ZP-I) Patiala on 13.03.2023 vide letter no. 1555-56 dated 06.03.2023.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-US; mso-fareast-language: EN-US;"><span style="mso-tab-count: 2;"> </span>Sh. Raghuveer Chand Sharma, Manager</span><span lang="EN-US" style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;"> </span><span style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif;">of the industry</span><span style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;"> appeared for hearing and submitted in writing that the industry has applied for renewal of consents to operate under the both acts for the existing unit under orange category. Now the industry to expand its unit by adding new processes like Galvanization this will change the category of the industry from orange to Red. The industry further that no work regarding expansion has been done in the unit and the machinery for new process has just been kept within the project premises and assured to start work related to expansion after obtaining consent to establish (NOC) from the Board. The industry also submitted the record of water consumption maintained by it. </span></p>
<p class="MsoNormal" style="line-height: 115%;"><span style="font-size: 11.5pt; line-height: 115%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;"><span style="mso-tab-count: 2;"> </span>He further requested to consider the above said clarification, drop the show cause notice and grant renewal consents applied by the industry. </span></p>
