The project proponent has submitted reply to the show cause notice issued. Built up area as on today is less than 20,000 sqm and we were not aware that due to same look it can be considered as group housing and high rise project. The construction is being done by the purchasers of plots. Affidavits regarding the same have already been submitted with the Regional Office of the board along with copies of registries as proof of sale of plot to individual plot owner.</span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><strong><span style="font-family: 'Tahoma','sans-serif';">Comments: Opinion of Senior Law Officer of the Board may be taken as to whether it is to be considered a group housing project or not. Or the project proponent may be asked to submit clarification from State Level Environment Impact Assessment Authority, Punjab whether this project to be considered a group housing project or not.</span></strong></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><strong><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp; </span></span></span></strong><!--[endif]--><strong><span style="font-family: 'Tahoma','sans-serif';">Reply: </span></strong><span style="font-family: 'Tahoma','sans-serif';">Category 8 (a) of the schedule appended to EIA notification dated 14.09.2006 is associated with building and construction projects. Thus M/s CRD Infra being an Area development project does not fall under this category. If in future the built area by M/s CRD Infra increases above 20,000 sqm we will get our EIA clearance as applicable.</span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><strong><span style="font-family: 'Tahoma','sans-serif';">Comments: The EIA notification dated 14.09.2006 requires prior Environmental Clearance if the built up area is more than 20,000 sqm. Therefore, the plea of the project proponent that if in the future the built up area increase above 20,000 sqm they will obtain EIA clearance, cannot be considered.</span></strong></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><strong><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp; </span></span></span></strong><!--[endif]--><strong><span style="font-family: 'Tahoma','sans-serif';">Reply: </span></strong><span style="font-family: 'Tahoma','sans-serif';">As per our application and feasibility report our waste water generation is 95.9 KLD for which a 100 KLD of STP is already being commissioned. If board requires us to increase the capacity of sewage treatment plant we will do so.</span></p> <p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><strong><span style="font-family: 'Tahoma','sans-serif';">Comments: There are 4 flats being built per plot and total 280 flats will be built. Also there are 16 commercial showrooms, therefore, total fresh water consumption will be about 197 KLD and accordingly wastewater generation (80 % of fresh water consumed) will be 158 KLD. Therefore, the STP installed by the project proponent is inadequate and is required to upgrade the STP capacity to atleast 175 KLD.</span></strong></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Further, the point wise reply to the decisions of personal hearing dated 20.09.2022 is given as under:</span></p> <p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The STP of capacity 100 KLD installed by the project proponent is inadequate and was not in operation during the visit on 14.02.2023.</span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent has not provided adequate arrangement for disposal of treated wastewater onto land for plantation as per Karnal Technology.</span></p> <p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent has not reserved any area for plantation as per Karnal Technology inside the project premises instead has taken land on lease from adjoining agricultural land for disposal of excess treated wastewater onto land for irrigation in area of 22 bighe and 11 biswe. The said land has been taken on lease by the project proponent from neighboring farmer by executing an agreement dated 30.11.2022 and the Khasra numbers of the land are 750 (0-13), 750/1 (3-6), 751 (4-0), 752 (4-0), 753 (5-16), 754 (4-10), 837 (0-2), 1326/766 (0-2), 1328/767 (0-2) which is located in Hadbast No. 289, Village Dayalpura, Zirakpur, SAS Nagar.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Submitted for further action please.</span></p>
