It is submitted that the industry is a rice sheller unit, which falls under small scale orange category and has been established after obtaining consent to establish (NOC) vide no.  CTE/Fresh/FZR/2022/19229320 dated 18.07.2022, valid upto 30.06.2023 for manufacturing of Raw Rice With Dryer @ 5 TPH and Sorted Rice @ 5 TPH, under Orange category, with certain conditions mentioned therein.                       A complaint dated 01.08.2022 made the residents of village Sudan to the Deputy Commissioner, Ferozepur was received on 17.08.2022, in which complaint has mentioned that there are 11-12 residential houses and Gurudwara Sahib near to M/s Garg Agro Industries, Village Sudan, Distt. Ferozepur.                        It is submitted that M/s Garg Agrotech and M/s Garg Agro Industries are sister concerned units. In the year 2022, M/s Garg Agrotech has applied for consent to establish ‘CTE’ of the Board. The industry has given certificate from Naib Tehsildar, Makhu that there is no approved residential colony within 500 meter from the site of the industry. Also the religious place does not have historical importance. Accordingly CTE was granted on 18.07.2022.                        Thereafter, M/s Garg Agro Industry applied for CTE of the Board and granted CTE on 02.08.2022.                        Now, the industry has applied for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981 for the manufacturing of Raw Rice With Dryer @ 5 TPH and Sorted Rice @ 5 TPH, under Orange category. The detail of case is as under:-                        The industry has submitted electricity bill as a proof of date of commissioning of its unit, which shows that electric connection has been issued to M/s Garg Agrotech, Aminwala Road, VPO Sudan, Makhu, Tehsil Zira Distt. Ferozepur on dated 13.09.2022.                        The industry has submitted proposed building plan under section-6 of the Factories Act, 1948 and Punjab Factories Rules 1952 from the Director of Factories, Punjab Department of Labour, SAS Nagar, which is duly signed by Er. Hanish Gupta, Competent Person, Approved under Factories Act, 1948.                        The industry has deposited Rs. 56,700/- vide UTR/Ref. No. N048232336181702 dated 17.02.2023 as water consent fee under the Water Act, 1974 and Rs. 56,700/- vide UTR/Ref. No.  N`048232336174147 dated 17.02.2023 as air consent fee under the Air Act, 1981, against the fixed assets of Rs. 314.94 Lakhs as on 14.02.2023 as per CA certificate submitted by it. Thus, the consent fee is adequate upto 30.09.2027 under each Acts.                        The industry was visited by AEE of this office on 02.03.2023 and it was observed as under:- 1.       The industry was not in operation during visit. The industry has installed machinery for the production of sorted raw rice with dryer. Sister concerned unit M/s Garg Agro Industries, has not set up rice mill at site. 2.       The industry has covered all the processing sheds. 3.       The industry has provided brick paved road from main gate of the industry to the rice room/husk area for the movements of vehicles. 4.       The industry has provided separate Cyclone Separator as APCD along with stack of adequate height to control the process emission from shelling section as well as paddy cleaner of  dryer. 5.       The industry has provided stack of adequate height with the APCD and provisions to facilitate emission sampling. 6.       The industry has provided brick wall of adequate length & height around husk discharge / storage area and further mesh wire of 5' height has been provided above the said wall in compliance to code of practice prescribed by the Govt. vide order dt. 15.10.2013. 7.       The industry has provided septic tank for treatment of domestic effluent with provision to discharge onto land for irrigation along the boundary. 8.       The industry has planted trees along its boundary wall.                        The industry is complying with the code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no 10/48/2004-STE-(4) / 932 dated. 15/10/2013. The competency for grant of consents to the rice shellers with dryer lies with the Environmental Engineer of the Regional Office.                           Keeping in view of above mentioned facts, it is, therefore, recommended that consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may be granted to the industry for a period upto 30/09/2027 for operation of rice sheller unit to manufacture Raw Rice With Dryer @ 5 TPH and Sorted Rice @ 5 TPH, under Orange category, subject to the suitable conditions.
