<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;"> It is submitted that the industry is a lead smelting unit and was granted consents to operate under the Water Act, 1974 & Air Act, 1981 on 08.07.2019 with validity upto 30.06.2024 for production of battery plates @ 1000 no. / day and lead ingots @ 500 TPA by using lead acid battery plates / scrap @ 750 TPA by operating 2 no. smelting furnaces.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;"> The industry was granted authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 on 11.01.2022 (valid upto 10.01.2027) for generation, collection, storage & disposal of hazardous waste of category 9.1 (Lead bearing residues) @ 0.3 T/annum & category 9.2 (Lead ash or particulate from flue gas) @ 0.2 T/annum.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;"> The industry obtained registration/passbook under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 for utilization of lead acid batteries / scrap on 11.01.2022 (valid upto 10.01.2027).</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;"> During environment surveillance campaign, the industry was visited by officers of the Board on 29.11.2022 and it was observed that:-</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">1. The industry was in operation.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">2. The industry has undergone expansion by addition of one smelting furnace and one no. rotary furnace in addition to the existing 2 no. smelting furnaces.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">3. During visit, one no. rotary furnace and the newly installed smelting furnace were in operation. In the area where rotary furnace was installed, lot of emissions were observed, which were being generated from the operation of rotary furnace and the same were not arrested in the APCD installed.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">4. Two no. existing smelting furnaces and rotary furnace are provided with a common APCD and separate APCD provided with the newly installed smelting furnace. The wet scrubber of both the APCDs were not in line during the visit.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">5. The industry has not provided any specific area for breaking of the scrap batteries, which were lying all over the floor area resulting in poor housekeeping.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">6. No record was produced by the industry regarding lifting of commonly recyclable hazardous wastes mentioned at sr. no. 17 i.e. used Lead acid battery scrap of schedule- IV of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">7. The industry has maintained no record regarding the hazardous waste generated / stored by it of category 9.1 & 9.2 of schedule-I of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;"> Accordingly, Notice u/s 33-A of the Water Act, 1974 & u/s 31-A of Air Act, 1981 with revocation of consents to operate under Water Act, 1974 & Air Act, 1981 and show cause notice before revocation of authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 issued to the industry alongwith an opportunity of personal hearing on 26.12.2022, which was postponed due to administrative reasons and again hearing held on 02.02.2023.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;"> During hearing, the Prop. of the industry submitted reply of notices issued and the same has been taken on record. He further stated that:-</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">1. The application has been applied for obtaining consents to operate for the newly installed smelting furnace & rotary furnace.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">2. The emissions being generated from the rotary furnace were due to replacement of glands and testing of the same, however the same has been got repaired.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">3. The wet scrubbers installed with the APCDs have been made operational.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">4. The industry has provided a separate area for breaking of the batteries, however due to construction activity the same was covered with the scrap.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">5. The record is being maintained in the red book and during visit the same was sent alongwith the vehicle for lifting the battery scrap.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">6. The industry is maintaining the record of hazardous waste generated in its premises.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;"> After hearing the Prop. of the industry and officer of the Board, the Chief Environmental Engineer (B) decided that:-</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">a) The industry shall not operate its rotary furnace & newly installed smelting furnace without obtaining consent to operate of the Board under the Water Act, 1974 & Air Act, 1981.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">b) The Regional Office, Bathinda shall immediately seal the rotary furnace and newly installed smelting furnace, which have been installed/commissioned without obtaining 'consent to operate of the Board.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">c) The industry shall ensure the compliance of the guidelines/ Standard Operating Procedure prescribed for environmentally sound recycling of lead bearing Hazardous Waste alongwith compliance of conditions of consents granted under the Water Act, 1974 & Air Act, 1981 & authorization under HOWM Rules, 2016 at all times.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">d) Environmental Engineer, Regional Office, Bathinda shall visit the industry immediately within 15 days to verify the compliance (s) / submissions made by the industry at site and thereafter submit report / recommendations in the matter.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;">e) During hearing, it has been made clear to the proprietor of the industry that in case of any violation(s) in future, further action as deemed fit shall be initiated under the provisions of the Water Act, 1974; the Air Act, 1981 and HOWM Rules, 2016.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="color: red; background: white;"> </span></p>

<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;"> Thereafter, the industry has applied for obtaining varied consent to operate under Water Act, 1974 & Air Act, 1981 for the production of battery plates @ 2000 no. / day and lead ingots @ 1350 TPA by using lead acid battery plates / scrap @ 2000 TPA. The industry has submitted request letter which is attached below.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="color: red; background: white;"> </span><span style="background: white;">The industry has deposited Rs. 17200/- vide UTR no. N359221011252176 dt. 25.12.2022 under Air Act, 1981 and Rs. 17200/- vide UTR no. N359221011248230 dt. 17.02.2022. Further, the industry has deposited Rs. 2200/- vide UTR no. N359221011251849 dt. 25.12.2022 as NOC regularization fee. The fee deposited by the industry is adequate upto 30.06.2028 under both acts.</span></p>
<p class="MsoListParagraph" style="text-indent: 0in;"><span style="background: white;"> Accordingly, the site of the industry was visited by undersigned on 17.03.2023 and it was observed as under: </span></p>

DG sets 62.5 KVA with canopy however the same were found disconnected from the main line.</span></p>
