CTE/Fresh/FGS/2022/19531493 dated 13/09/2022 valid upto 12/09/2023, for the manufacturing of</span> <span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Angles and Flats @ 4500 MTA with special conditions as under:</span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; mso-list: l0 level1 lfo3; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The unit shall install its project in the Khasra number mentioned in the CLU submitted by it.</span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; mso-list: l0 level1 lfo3; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The unit shall install furnace as per the report submitted by NISST, Mandi Gobindgarh dated 06/09/2022 and ensure that the production capacity of the unit shall not exceed 5000 TPA under any circumstances, failure of which it shall lead to cancellation of NOC granted to it.</span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; mso-list: l0 level1 lfo3; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The unit shall obtain completion certificate from NISST, Mandi Gobindgarh w.r.t. the design parameters of the furnace as per NISST report dated 06/09/2022, for production of re-rolled products before commissioning of the unit.</span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; mso-list: l0 level1 lfo3; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The unit shall comply with MoEF & CC, New Delhi notification dated 20/07/2022, in which steel re-rolling operations falling under the purview of the secondary metallurgical processing are required to obtain prior Environment Clearance as per item 3(a) of the EIA Notification dated 14/09/2006, with capacities greater than 5000 tons/annum (TPA).</span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; mso-list: l0 level1 lfo3; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-language: PA;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The unit shall obtain necessary clearance for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA).</span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; mso-list: l0 level1 lfo3; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-language: PA;"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The unit shall get its building plans approved from Competent Authority before commissioning of the unit.</span></p>
<p class="MsoNormal" style="margin-top: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">In compliance to the special conditions, the subject cited industry has obtained completion certificate from NISST, Mandi Gobindgarh w.r.t. the design parameters of the furnace as per NISST report dated 06/09/2022, for production of re-rolled products, which is reproduced as under:</span></p>
<p class="MsoNormal" style="margin-top: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">"A team of NISST visited the Plant of M/s Rajtech Ventures, Mandi Gobindgarh. It has been found that the unit has completed the construction of Reheating Furnace as per design given by NISST. As already submitted, furnace has been designed on production capacity of 4800 ton per annum for raw material size of 5-15 Kg considering 8 hours working per day and 300 working days in a year."</span></em></p>
<p class="MsoNormal" style="margin-top: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Now, the industry has applied for obtaining fresh 'consent to operate' under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with requisite documents. The industry has earlier deposit consent fee of Rs. 32500/- vide UTR No. SBIN223065487788 dated 06/03/2023 as Water consent fee and Rs. 32500/- vide UTR No. SBIN223065485964 dated 06/03/2023 as Air consent fee against the un-depreciated fixed assets of Rs. 190.57 Lacs as on 25/02/2023 as per CA certificate dated 09/03/2023, which is adequate <strong>upto </strong><strong style="mso-bidi-font-weight: normal;">31/12/2027</strong> under the both Acts as per Board's Office Order dated 29/10/2018.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Accordingly, the site was visited by the undersigned <strong>on 13/03/2023</strong> and following observations were observed:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: normal; mso-list: l1 level1 lfo2; margin: 0in -.9pt .0001pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The industry was not in operation during visit as it has not commissioned its unit. It will be engaged in manufacturing of Angles and Flats @ 4500 MTA by using raw material as Re-Rollable material and Steel Ingots @ 4800 MTA.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; mso-list: l1 level1 lfo2; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The industry will commission its unit in the month of April, 2023. </span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt -.9pt 10.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">From the above, it is clear that the industry falls under industrial zone as per Master Plan of Mandi Gobindgarh.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt -.9pt 10.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">It is intimated that CPCB has already issued modified directions u/s 18(1)b of the Water Act, 1974 & the Air-Act, 1981 regarding Harmonization of Classification of Industrial sectors under Red/Orange/Green/White categories vide its letter no. B 29012/ESS/CPA/2015-16/85-84 dated 7.3.2016 alongwith the "Final document on revised classification of Industrial sectors under Red, Orange, Green & White categories" which also includes the consent period for which the consents are to be granted to Red, Orange and Green category industries for 5 years, 10 years and 15 years respectively. Further, Board vide Head Office letter no. SEE(HQ-2)/2018/ 9982-10003 dated 27/08/2018 has directed to strictly follow the consent validity criteria for Red, Orange and Green category industries as mentioned in the modified directions issued by CPCB u/s 18(1)b of the Water Act, 1974 & the Air Act, 1981 i.e. consent to Red, Orange and Green category industries may be granted for 5 years, 10 years and 15 years respectively. But, in the subject cited case, the industry has deposited consent fee only <strong>upto </strong><strong style="mso-bidi-font-weight: normal;">31/12/2027<span style="mso-bidi-font-weight: bold;">. However, lease deed of the industry is valid upto 18.06.2027.</span></strong></span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt -.9pt 10.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">It is pertinent to mentioned here that a meeting was taken by the Hon'ble Chairman with the officers of the Board on 29/01/2021 at 11:00 AM in the Committee Room, Head Office, Patiala, wherein, it was decided that Consents to operate be issued to the industries for longer duration as per protocol laid down by the Board and more emphasis shall be laid on the monitoring.</span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Raavi;"><span style="mso-tab-count: 1;"> </span></span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt -.9pt 10.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Raavi;">Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoNormal" style="margin-left: 4.5pt; text-align: justify; text-justify: inter-ideograph; text-indent: -4.5pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Raavi;"><span style="mso-tab-count: 3;"> </span><strong>The Board shall continue to grant consent to</strong> <strong>establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries</strong>.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;">In view of above, it is therefore recommended that:</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><strong><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;">1</span></strong><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;">. The industry may be granted fresh </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">consent to operate under the Water Act, 1974 & Air Act, 1981 <strong>upto 31/12/2026</strong><strong style="mso-bidi-font-weight: normal;"> </strong>to the industry with suitable conditions and special conditions that:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 27.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; mso-list: l2 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">a)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Calibri;">The industry shall not carry out any activity which is covered under the ambit of EIA Notification, 2006. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; mso-list: l2 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">b)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Calibri;">The industry shall not enhance its production capacity beyond 5000 MTA.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; mso-list: l2 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">c)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">T</span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Calibri;">he industry is advised to obtain necessary clearance for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA).</span></p>
