<p class="MsoNormal" style="margin-top: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">It is submitted that the industry was earlier given a show cause notice for violation under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide by ZO letter no. 5484 dated 09/09/2022 for opportunity of personal hearing before the Senior Environmental Engineer (ZP-1) on 20/09/2022.</span></p>
<p class="MsoNormal" style="margin-top: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the industry was issue notice regarding non-compliance of the decisions of hearing dated 20/09/2022 by Senior Environmental Engineer (ZP-1) of the Board vide letter no. 706 dated 27/01/2023. The industry was given an opportunity to appear before the Senior Environmental Engineer (ZP-1) of the Board on 14/02/2023 to explain the failure to comply with provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="margin-top: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry was issued proceeding of personal hearing given on 14/02/2023 by the Senior Environmental Engineer (ZP-1) of the Board. After hearing the officers of the Board and the representative of the industry, the Senior Environmental Engineer (ZP-1) of the Board decided as under:</span></p>

The industry shall also provide sampling arrangements as per Board’s norms.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 12.0pt 0in 10.0pt 1.25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry shall immediately apply for consent to operate as required under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 12.0pt 0in 10.0pt 1.25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The Environmental Engineer, Regional Office, SAS Nagar shall visit the industry, verify the statements of the industry, process the applications of the industry on merits and send his report/ recommendations.</span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 12.0pt 0in 10.0pt 1.25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">In case any violation is observed, action u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 will be taken against the industry.</span></p>
<p class="MsoNormal" style="margin-top: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Now, industry has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Powder Coating of MS Boxes @ 200 Number/Day by using Powder for Coating @ 5 Kgs/day alongwith requisite documents and fees.</span></p>
<p class="MsoNormal" style="margin-top: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry has submitted its CA certificate mentioning the cost of the fixed assets of Rs. 3.50 lakh as on 30/09/2022. The industry has deposited Rs.</span> <span style="font-family: 'Tahoma','sans-serif';">2100/- vide online R no. 118488467 dated 13/02/2023 and Rs. 3500/- vide online R. no. 693637018 dated 21/03/2023 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 1400/- vide online R no. 196896510 dated 13/02/2023 and Rs. 3500/- vide online R. no. 44395878 dated 18/03/2023 under the Air (Prevention & Control of Pollution) Act, 1981 and Rs. 700/- adjusted as NOC regularization fees. The consent fee deposited by the industry is adequate upto 30/09/</span><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi;">2028</span><span style="font-family: 'Tahoma','sans-serif';">, under both the Acts after adjusting late fees for one year.</span></p>
<p class="MsoNormal" style="margin-top: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry has submitted rent agreement executed on 23/09/2022 between Prithipal Singh S/o Sh. Gurbachan Singh R/o # 1726, Phase 3B2 SAS Nagar as 1<sup>st</sup> party and M/s S.K. Steel Industries Prop. Sudeep Kumar S/o Barinder Singh R/o H.No. 447, Street No. 30, Ward No.3, Ekta Colony Balongi SAS Nagar<span style="color: red;">.</span></span></p>

The industry has install cyclone as APCD alongwith stack of adequate height.</span></p>

<p class="MsoNormal" style="margin-top: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Keeping in view of the above, it is recommended that the consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30/09/2028, for manufacturing of Powder Coating of MS Boxes @ 200 Number/Day by using Powder for Coating @ 5 Kgs/day, subject to suitable conditions.</span></p> |
