<p class="MsoNormal" style="text-align: justify;">It is submitted that earlier the industry was granted NOC for establishment of the industry in the khasra nos 148//7/1, 148//7/5, 148//7/4, 148//7/3, 148//7/2, 148//14/1, 148//14/2, 148//14/3, 148//14/4, 148//14/5, 148//6 as per aks chajra having total land area 1100 sq yds.</p>
<p class="MsoNormal" style="text-align: justify;">Now the industry has applied for varied CTO for operation of unit in khasra nos. 148//14/1 (0-12), 14/3(1-17) and 13(8-0) total land area 12 k 15 marlas. However, the industry has submitted aks chajra plan bearing khasra nos. 148//4, 5, 7/1, 7/5, 14/1 & 13,3. The industry has submitted registered land deed of khasra nos. 148// 7/5(2-6) & 14/1(0-12) and lease deed of the same khasra nos by Kiran goyal to the industry. The industry has also submitted a lease deed of 4 kanals by Shikha goyal to the industry however not mentioning any khasra nos.in the lease deed.</p>
<p class="MsoNormal" style="text-align: justify;">Further, the industry has submitted DTP certificate to M/s Goyal Industries, kotkapura mentioning that the khasra nos. 148// 7/5(2-6), 14/1(0-12), 14/3(1-17), 13(8-0) fall under general industrial zone as per notified master plan kotkapura.</p>
<p class="MsoNormal" style="text-align: justify;">As per the clarification submitted by the industry dated 27.02.2023 the land area 453.75 sq yds are owned by the rep and 2420 sq yds have been taken on lease from Shikha Goyal and 260 sq yds from Kiren goyal. So the total land area is 3133.75 sq yds however as per site plan the land area with the industry is around 7500 sqyds. The industry has also submitted that the industry is operated in khasra nos. 148//13(4-0), 14/1(0-12), 14/3(0-12) and M/s Goyal Industries in khasra nos. 248//3(0-15).</p>
<p class="MsoNormal" style="text-align: justify;">As per the above documents submitted by the applicant</p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]-->DTP certificate vide no. 140 dated 17.03.2022 addressed to M/s Goyal Industries, kotkapura and it has been mentioned that the site of the said industry i.e. khasra nos. 148// 7/5(2-6), 14/1(0-12), 14/3(1-17), 13(8-0) fall within municipal limits and fall under general industrial zone as per notified master plan kotkapura. The same khasra nos. have been mentioned in the site of the industry M/s KRISHANA PLASTIC INDUSTRY, kotkapura, District Faridkot. It is not clear whether the revenue site is of M/s KRISHANA PLASTIC INDUSTRY, kotkapura or of M/s Goyal Industries, kotkapura</p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]-->The PP has applied for change of the land of the industry from khasra nos 148//7/1, 148//7/5, 148//7/4, 148//7/3, 148//7/2, 148//14/1, 148//14/2, 148//14/3, 148//14/4, 148//14/5, 148//6 total land area 1100 sq yds to khasra nos. 148//14/1 (0-12), 14/3(1-17) and 13(8-0).</p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify;">Further, the industry has submitted site plan bearing khasra nos. 148//14/1 (0-12), 14/3(1-17) and 13(4-0) total land area mentioned is 12 k 15 marlas which is not proper as the mentioned khasras does not account for 12 m 15 k land area. Also the industry has submitted aks chajra plan bearing khasra nos. 148//4, 5, 7/1, 7/5, 14/1, 13 & 3.</p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify;">The revenue record i.e. ownership of the land and the lease deeds submitted, site plan submitted, aks chajra submitted and copy of revenue latha submitted with the application are not in consonance with each other.</p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]-->The PP has submitted a lease deed of 4 kanals by Shikha goyal to the industry however no khasra nos. have been mentioned in the lease deed submitted.</p>
<p class="MsoNormal" style="text-align: justify;">In the matter the case was sent to RO regarding observations w.r.t. the application on 9.3.2023 however the reply to the observation by the RO was not satisfactory.</p>
<p class="MsoNormal">If approved, the industry may be issued SCN for violation of the provisions of Water Act ,1974 and Air Act, 1981 with an opportunity of personal hearing due to above said shortcomings in the CTO application.</p>
