Anil Gupta, Director The officers of the Board brought the industry was granted consents to operate under green category under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2018/8060364 dated 22.08.2018 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/ 2018/8060272 dated 22/8/2018, valid upto 31/12/2022 for Energy meter @ 9,00,000 Number/Year by using Poly Carbonate @ 1.0 MTD, Components for Assembling of Energy Meters @ 9,00,000 Number/Year as a raw material, subject to certain conditions as mentioned therein. Thereafter, the industry was granted consent to establish (NOC) for expansion under green category under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Expansion/SAS/2020/12081507 dated 22.01.2020 which was valid upto 22.01.2022 for Energy meter @ 41,00,000 Number/Year by using Poly Carbonate @ 55 MT/Year, Components for Assembling of Energy Meters @ 41,00,000 Number/Year as a raw material, subject to certain conditions as mentioned therein. The industry has applied for varied consents to operate under green category under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for Energy meter @ 50,00,000 Number/Year by using Poly Carbonate @ 67 MT/Year, Components for Assembling of Energy Meters @ 50,00,000 Number/Year as a raw material, through OCMMS. The industry was visited by the officer of Regional Office, SAS Nagar on 18/1/2023 and it was observed as under: 1.                   The industry was in operation and has has installed 12 plastic moulding machine for manufacturing outer casing of energy meter. 2.                   The industry has installed 02 machine for surface mounting chip on Printed circuit Board (PCB). 3.                   The industry has installed one soldering machine using flux. 4.                   The industry has installed 04 line for assembling and 04 no. packing of energy meter. 5.                   The industry has installed 02 energy meter testing panel. 6.                   The industry has installed 03 DG set, all equipped with canopy. 7.                   The industry has not provided Environment Data Board at the entrance. 8.                   The industry is not maintaining any record regarding the consumption of fresh water for domestic purpose as well as in cooling towers and injection moulding machines and generation & disposal of effluent. The industry has not filled the detail in the application. 9.                   The industry has installed 02 grinding machines for the manufacturing of plastic chips, which is further used for the manufacturing of plastic granules, i.e. the industry is engaged in processing of plastic waste, which is covered under orange category. No APCD installed with 1 no. grinding machine and other grinding machine provided with APCD however, the same found disconnected. 10.               The industry was not obtained authorization under Hazardous & Other Waste (Management & Tran boundary Movement) Rules, 2016 and also not provided proper storage & disposal of hazardous waste. The industry was failed to get EPR registration obtained through CPCB EPR portal. As such, tthe industry does not comply with the directions u/s 5 of the Environmental (Protection) Act, 1981 issued by the CPCB vide its letter no. B-11011/UPC-II/Plastic Waste Management Rules, 2016 Direction)/ 2022/4187 dated 8/9/2022. 11.               The industry is not complying with the various terms and conditions of the consents granted by the Board under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The industry has changed the process and now the industry falls in the orange category, the industry has not installed the APCD to capture the process emission generated from the orange category process.  The industry has failed to comply with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and conditions of consents to operate earlier granted to it under the said Acts.  It is evident that the industry is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, wilfully causing pollution in the vicinity, thus violating the provisions of the said Acts, intentionally and deliberately.  It was proposed to refuse the varied consent to operate applied under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity of show cause/personal hearing. Thereafter, the industry was served show cause notice served for refusal of varied consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide Board's letter no. 1116-17 dated 13/2/2023 alongwith an opportunity to submit reply within 7-days.  But the industry was failed to submit any reply w.r.t notice. The matter was considered by the Competent Authority and decided to afford an opportunity of personal hearing before taking further action in the matter. Therefore, the industry was served show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide Board's letter no. 1545-46 dated 3/3/2023 alongwith an opportunity of the personal hearing before the Chief Environmental Engineer (P) of the Board on 13/3/2023. The representatives of the industry submitted during the hearing that they have stopped the process falling under Orange Category and will not carry out the process which will change the category from current to Orange or Red without obtaining prior permission from the Board. They will also remove the machinery related to Orange Category within a week. The Environment Data board has been provided and has started maintaining the record water meters.  <p class="MsoListParagraphCxSpFirst" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;">After hearing the officers of the Board and the representatives of the industry, the Chief Environmental Engineer (P) of the Board decided as under: 1.                   Consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 be refused. 2.                   The industry shall discontinue its processes which are covered under Orange Category as per categorization of the Board. 3.                   The Environmental Engineer, Regional Office, SAS Nagar shall seal the plant and machinery which are covered in the Orange Category. 4.                   The industry shall obtain consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 under Green Category for the processes being carried out in its premises. 5.                   The Environmental Engineer, Regional Office, Mohali shall verify the statement of the industry and process/ decide the consent applications of the industry on merits.                                 If approved, proceedings of the personal hearing as above may be conveyed to the industry and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.
