SAS Nagar w.r.t show cause notice for refusal of consent to operate under the Water Act, 1974 and the Air Act, 1981</strong></p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;">The following were present:</p> <h3 style="text-align: justify;"><span lang="EN-US">From the Board:</span></h3> <p style="text-align: justify;">1)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Sh. Kuldeep Singh, Environmental Engineer (ZP-I)</p> <p style="text-align: justify;">From the industry:</p> <p style="text-align: justify;">Sh. Amit Kumar, General Manager</p> <p style="text-align: justify;">The officers of the Board brought that the project proponent was granted consent to establish (NOC) under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2022/17988855 dated 20/4/2022, valid upto 25/3/2023 for establishment of Commercial project consisting of Offices @ 108 and Showroom @ 80 and for generation of domestic effluent @27.2 KLD - Sewage Treatment Plant (STP) of capacity 30 KLD, treated wastewater @ 14 KLD is to be reused for flushing purpose (dual plumbing system) within the premises. Remaining treated wastewater @ 13 KLD is to be used for plantation purpose within the premises and onto land for plantation as per Karnal Technology in an area of 0.75 acres taken on lease&nbsp;with certain special conditions mentioned therein. The project&nbsp;proponent has now applied consent to operate as required under the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 for operation of Commercial project consisting of Offices @ 108 and Showroom @ 80 along with requisite documents. While scrutinizing the application of the project proponent on 15.02.2023, the observations was raised by the Scrutiny Officer with the request to submit the reply within 5-day and&nbsp;also found during visit of the project on 14/2/2023. But no reply was received from the project proponent:</p> <p style="text-align: justify;">1)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;In the layout plan approved by the authority, the location of the STP has not been marked. Further, in the layout plan submitted with the application, no detail regarding no. of SCOs, offices &amp; halls to be constructed has been mentioned..</p> <p style="text-align: justify;">2)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The dimensional drawing of STP submitted is not proper as it not clearly depicts all the components of the STP.</p> <p style="text-align: justify;">3)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent has not obtained permission from PWRDA for ground water abstraction till date.</p> <p style="text-align: justify;">The project proponent has submitted water detail of the project, as per which total water requirement of the project is 34 KLD out of which 34 KLD will be met through groundwater. The total wastewater generation from the project will be 34 KLD which will be treated in a STP of capacity 30 KLD to be installed within the project premises. The total treated wastewater generation from STP will be 27.20 KLD, out of which 14 KLD will be used for flushing purpose, 13.20 KLD will be used for irrigation of green area. The project site was visited by officer of the Board on 14/2/2023 and it was observed as under:</p> <p style="text-align: justify;">1)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project is a commercial project developed in the name of Maxxon Celebration by M/s Maxxon Space Builders.</p> <p style="text-align: justify;">2)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent has completed the construction and finishing work of the project. No occupancy is there in the project.</p> <p style="text-align: justify;">3)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent has installed 2 borewells at the site but no water meter has been provided.</p> <p style="text-align: justify;">4)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The DG set for which the consent to operate has been applied was not installed at the site. The project proponent has installed two temporary DG set of capacity 62.5 KVA with canopy and adequate stack and 45 KVA without canopy and inadequate stack height.</p> <p style="text-align: justify;">5)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent has not developed the plantation area on its land as well as area taken on lease for development as per karnal technology at backside of the project (@ 0.75 acres) where it is proposing to use the treated waste-water @ 13 KLD.</p> <p style="text-align: justify;">6)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent has not carried out color coding of the pipeline laid for fresh water, dual plumbing etc.</p> <p style="text-align: justify;">7)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent has not installed color coded bins at the site for promoting segregation of solid waste in compliance of NOC conditions.</p> <p style="text-align: justify;">8)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent has not installed mechanical composter at the site for in-situ management of wet solid waste.</p> <p style="text-align: justify;">9)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent is yet to make connection of the treated water line from STP to plantation and dual plumbing.</p> <p style="text-align: justify;">10)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;No sewer has been laid down by MC in the area.</p> <p style="text-align: justify;">The project proponent has not deposited adequate NOC regularization fee for increasing its fixed assets and has not made scientific adequate mode of disposal. The project proponent is not complying with the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 as well as conditions mentioned in the consent to establish (NOC) earlier granted to it, willfully causing water and air pollution in the vicinity, thus, violating the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 intentionally and deliberately. It was proposed to refuse consent to operate applied by the project proponent under the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 after affording an opportunity of show cause/ personal hearing. Therefore, the industry was issued show cause notice for refusal of consent to operate under the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981&nbsp;vide Board's letter no. 1539-40 dated 3/3/2023&nbsp;alongwith an opportunity of the personal hearing&nbsp;before the Chief Environmental Engineer (P) of the Board on 13/3/2023.</p> <p style="text-align: justify;">The representative of the project proponent attended the hearing and submitted its reply in which it has been mentioned that STP has been installed and same was verified by visiting officer. The same will be projected in completion drawing of the project details regarding showrooms/ offices on each floor are being submitted. DG sets of small capacities are temporarily installed to run the make shift office of the builder within the project and to carry the finishing jobs of the project. Work orders for final DG sets have been placed. Plantation as per Karnal Technology has been done in the land adjoining the project. Initially due to very less occupancy and for site yet to be operational, bins has been placed and once substantial occupancy is there. Mechanical composter already released. They have also requested to give two days time to submit another reply.</p> <p style="text-align: justify;">The Authority has given a permission to submit reply within 2-days. Accordingly, the project proponent has submitted its reply (received in this office on 15/3/2023) that as there is no MC sewer in our area for dispose of treated water. They have acquired some land on lease basis adjoining to our project. There also assured that they will keep the land with for disposal of treated water until MC will not lay the sewer in our area.&nbsp;</p> <p style="text-align: justify;">But the project proponent has not submitted registered lease deed.</p> <p style="text-align: justify;">After hearing the officers of the Board and the representatives of the industry, the Chief Environmental Engineer (P) of the Board decided as under:</p> <p style="text-align: justify;">A)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Consent to operate applied under the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 be refused.</p> <p style="text-align: justify;">B)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Directions u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 be issued to the project proponent with the following directions:</p> <p style="text-align: justify;">1)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;That the project proponent shall take all necessary steps to stop its construction at site and stop forthwith discharging any effluents/wastewater into sewer/ into storm water drain/ inland surface water/ onto land for stagnation/ irrigation or through any mode.</p> <p style="text-align: justify;">2)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;That the project proponent shall not allow any new occupancy and shall not allow any new possession in the premises of the project, with immediate effect.</p> <p style="text-align: justify;">3)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;That the project proponent will immediately stop its activities and will not restart the same unless all necessary water and air pollution control measures are taken and it obtains valid 'consents to operate' of the Board under the provisions of the Water (Prevention &amp; Control of Pollution) Act 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981.</p> <p style="text-align: justify;">C)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent shall submit the registered lease deed used/ to be used for onto land plantation as per Karnal Technology alongwith revenue record alongwith the Khasra nos. on Aksh Sajra Plan so that same be freezed in the record of Revenue Department, so that area not be used for expansion in future.</p> <p style="text-align: justify;">D)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent shall provide mechanical composter for conversion of solid waste into compost.</p> <p style="text-align: justify;">&nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;If approved, proceedings of the personal hearing as above may be conveyed to the and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.</p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;"><strong>(Note-It is requeted to press the refused button, please)</strong></p>
