<p style="text-align: justify;">The agenda note and report / recommendations of AEE/EE, RO, may kindly be perused.</p>
<p style="text-align: justify;">It is submitted that the industry is a small scale red category dyeing unit and was granted consent to operate under the Water Act, 1974 and Air Act, 1981, both valid upto 05/12/2022 for production of Dyeing of Polyester/PC Fabrics @ 6650 Kg/day and for discharge of trade effluent @ 995 KLD and domestic effluent @ 05 KLD into CETP 40 MLD (Focal Point Module) and for using rice husk as fuel in its one FBC boiler of capacity 03 TPH with cyclone separator as APCD.</p>
<p style="text-align: justify;">Earlier, the industry was visited by a surprise team on 20.09.2020. The team reported that during the visit, manholes near the dyeing cluster of Phase-VIII, Focal Point, Ludhiana and the industries located at the upstream of the manhole, wherein coloured effluent was observed were also inspected. The team further reported that while carrying out the above exercise, dark violet coloured waste water was observed flowing in the sewer manhole located in front of the industry. Accordingly, the industry was visited by the team. During the visit the team collected effluent samples from the outlet of the ETP installed by the industry. As per analysis report received from the lab, parameters (TSS 1156 mg/l), (TDS 5379 mg/l), (COD 520 mg/l) and (BOD 190 mg/l) were beyond the prescribed limits of the Board.</p>
<p style="text-align: justify;">Accordingly, the consent to operate granted to the industry under the Water Act, 1974 was revoked and directions u/s 33-A of the Water Act, 1974 were issued for closure of the industry as well as disconnection of electric supply.</p>
<p style="text-align: justify;">In compliance, the electric supply available to the industry has been disconnected by PSPCL authorities vide TDCO no. 129/56 dated 12.10.2020.</p>
<p style="text-align: justify;">Thereafter, the electricity supply to the industry was restored temporarily upto 31.03.2021. The restoration was further extended upto 30.06.2021. Further, the restoration was extended upto 31.12.2021. Lastly, the restoration letter was issued vide order no. 301-04 dated 06.01.2022 which was upto 30.06.2022.</p>
<p style="text-align: justify;">Apparently, during the issuance of last consent to operate issued dated 06/06/2022, upto 05/12/2022 under both the Acts the restoration of electric connection was approved by the competent authority on 29.05.2022 in application no. 18685270, however, the letter was issued as per record file. </p>
<p style="text-align: justify;">Now, the industry has applied for renewal of consent to operate under the Water Act, 1974 and under the Air Act, 1981. The industry has already deposited consent fee, which is adequate upto 31.03.2026 under both Acts.</p>
<p style="text-align: justify;">Accordingly, the industry was visited by AEE of RO on 24.02.2023 and it was observed as under:-</p>
<p style="text-align: justify;">1. The industry was in operation and is engaged in dyeing of fabrics.</p>
<p style="text-align: justify;">2. The industry has installed 17 soft flow machines of capacities (02x650 Kg, 03x400 Kg, 06x300 Kg, 05x 200 Kg & 01x50 Kg) for dyeing purposes. Earlier, the dyeing capacity of the industry was 4900 kg/day and now it has capacity of 5300 kg/day.</p>
<p style="text-align: justify;">3. The industry has obtained shares of 1000 KLD and has installed flow meter/SCADA system for leading the effluent to CETP.</p>
<p style="text-align: justify;">4. The industry is discharging its trade & domestic effluent into CETP 40 MLD. The M.C. sewer in proximity of industry was verified during visit and no connection was observed during the visit. Further, the untreated waste water was being discharged through the dedicated sewer line provided by the PDA.</p>
<p style="text-align: justify;">5. The perusal of the monthly report generated from the SCADA enabled system the average discharge of the industry viz a viz its shareholding is 82.75% in December, 2022, is 89.76% in January, 2023 and is 86.08% in February, 2023.</p>
<p style="text-align: justify;">6. The industry has installed one boiler of capacity 04 TPH attached with separate cyclone as APCD alongwith adequate stack height and rice husk is being used as fuel in its boiler. Stack emission sample was collected on 15.11.2022 and as per analysis results SPM was found to be 232 mg/Nm3 against the permissible limits 500 mg/Nm3.</p>
<p style="text-align: justify;">7. The industry has installed one DG set of capacity 362 KVA equipped with canopy along with adequate stack height.</p>
<p style="text-align: justify;">From above, it evident that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and no action is pending against the industry. The site of the industry falls in approved focal point.</p>
<p style="text-align: justify;">In view of above, it is recommended that:-</p>
<p style="text-align: justify;">A. Directions u/s 33-A of the Water Act 1974 may be issued to the PSPCL Authorities to restore the electric connection of the industry permanently.</p>
<p style="text-align: justify;">B. The Consent to operate under Water Act, 1974 and Air Act, 1981 may be granted upto 30.06.2025 with suitable conditions and additional conditions as under:-</p>
<p style="text-align: justify;">1. Shares of CETP are yet to be "Demat" through Registrar of Companies (ROC). As such, legal sanctity of these shares allocated by the Punjab Dyers Association (PDA) to the industry is yet to establish as per the guidelines issued by Securities and Exchange Board of India under the Company Laws. The industry will get its Demat from ROC, within 2 months, positively.</p>
<p style="text-align: justify;">2. As such, the production/ effluent discharge in this consent is subject to the final allotment as described at "1" above. Therefore, in case of variation of shares at the final settlement by the PDA / approval by PPCB /Demat by ROC, the industry is bound to follow the production/ effluent discharge from their unit accordingly and shall obtain revised consents with modified figures of production and effluent discharge as per the final share allotment.</p>
<p style="text-align: justify;">3. The industry shall discharge the whole consented effluent into dedicate sewer line leading to CETP for final treatment in accordance to the shares allotted to the unit. </p>
<p style="text-align: justify;">4. The industry will also dismantle any other connection available for discharge of effluent either into public sewer or PDA conveyer system.</p>
<p style="text-align: justify;">5. The industry should either take measures to control its inlet parameters by good practices and selection of good chemicals for processing or shall operate and maintain its existing effluent treatment plant (ETP), regularly and efficiently, so as to achieve the inlet effluent standards of CETP as per DPR. </p>
<p style="text-align: justify;">6. The industry shall make the necessary arrangements to achieve the effluent standards as per the inlet designed parameters of the CETP.</p>
<p style="text-align: justify;">7. There shall be no physical expansion of the unit either with the installation of new machinery or with the permission for enhanced electricity load, after the varied consents are granted for increased discharge of effluent.</p>
<p style="text-align: justify;">8. The industry shall stop discharging its effluent in case due to any reason the CETP is not operational or dedicated conveyance system is overflowing.</p>
<p style="text-align: justify;">9. The industry shall maintain the record of flow meter installed at source and at the outlet leading to CETP.</p>
<p style="text-align: justify;">C. As the industry has increased its dyeing capacity from 4900 kg/day to 5300 kg/day, however, the effluent discharge is within the consented/ shares discharge, the policy decision regarding sealing of dyeing capacity @ 400 kg/day be taken.</p>
<p style="text-align: justify;">D. Further, policy decision be taken for third party audit (GNE audit) of the dyeing units of CETP w.r.t. discharge and installed machinery to be done collectively of all the member industries at SPV level.</p>
