The project proponent was granted Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2018/7279304 dated 06.04.2018, valid till 30.09.2022 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2018/7279403 dated 06.04.2018, valid till 30.09.2022 for manufacturing of Wire @ 4 000 Meter/day & Cable @ 5,000 Meter/day with special conditions as under: 1.       The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments. 2.       The industry will stick to the production capacity mentioned in this consent and will not increase the same without the prior written permission of the Board. 3.       The industry shall not consume any fuel except HSD in DG sets of capacity 125 KVA & 285 KVA for burning purposes without the prior written permission of the Board. 4.       The industry shall comply with the instructions issued by the Board vide office order no. Admn./SA2/F.No.783/ 2010/448 dated 8/6/2010 regarding DG sets. 5.       The industry shall make necessary arrangements for the monitoring of stack emissions / ambient air & shall monitor its emissions twice in a year and shall submit analysis results to the Board. 6.       The industry shall obtain authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 7.       The industry shall ensure that no air pollution problem / public nuisance / odour problem is created in the area due to discharge of emissions from its industrial premises. 8.       The hazardous wastes generated from various processes / activities of the industry shall be handled, managed, treated and / or disposed off as per provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 9.       The industry shall bound to comply with the bye laws of Master Plan of the area notified / to be notified by the Government. 10.   The industry shall submit within 3 months a certificate from the Deptt. of Town & Country Planning / GMADA / Local Authority to the effect that how much time the industry can continue its operations at the present location in light of provisions of section 79 of the Punjab Regional & Town Planning and Development Act, 1995, if the same are applicable to the industry. 11.   The industry shall ensure the compliance of decisions taken during hearing on 13/2/2018. 12.   The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the industry and Rules, Circulars & Directions issued by the Board from time to time. Thereafter, the site of the unit was surprisingly visited by the officer of the Board on 30.10.2020. During visit, it was observed as under: 1.       The industry is engaged in the process of manufacturing of electric wires and cables. 2.       The industry has not provided Environmental Data Board at the entrance. 3.       The industry has not obtained authorization under HWM Rules, 2016. 4.       The industry has not installed water meter at the source of fresh water. 5.       The industry has not made any arrangements for the proper utilization of domestic effluent. 6.       The industry has not obtained permission from the Central Ground Water Authority for the abstraction of fresh water. Thereafter, the show cause notice for revocation of Consent to Operate granted under Water (Prevention & Control of Pollution) Act, 1974 , the Air (Prevention & Control of Pollution) Act, 1981 & Hazardous & Other Wastes (Management & Trans boundary Movement) Rules, 2016 issued to the project proponent to submit reply within 15 in writing. No reply received from the industry. Thereafter, the industry again visited by the officer of the Board on 11.01.2022 and it was observed that the industry has removed the various violation observed during the earlier visit and report was sent through enoting no. 15812102 Now, the project proponent has applied for renewal of Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Wire @ 4000 Meter/day & Cable @ 5,000 Meter/day using Copper @ 100 Kgs/day, Aluminium @ 1000 kgs/day, PVC @ 600 kgs/day, Steel Strip @ 500 kgs/day & XLPE  @ 200 kgs/day as raw material. The project proponent has submitted CA Certificate with value of fixed assets of Rs. 3.24 crore on 31.03.2022. The project proponent has deposited Rs. 45,000/- vide R no. 346709059 dated 10.01.2023 under Water Act, 1974 and Rs. 45,000/- vide R no. 200291143 dated 10.01.2023 under Air Act, 1981. After deduction of NOC regularization fees, late fees, the consent fees adequate till 31.01.2026 under Water Act, 1974 & adequate till 31.05.2026 under Air Act, 1981. On scrutinizing the application of  the project proponent following observation were observed on 17.03.2023 with request to submit reply within 2 days. 1)      The value of fixed assets have increased by 36 lacs as compared to fixed assets at the time of obtaining previous CTO. It is requested to submit details of expansion along with bills and give undertaking that with the increase in assets whether there has been increase in production or Pollution load. 2)      The industry has only mentioned one dg set in the application form however in the previous cto there were 2 dg set. 3)      The industry has not submitted certificate from DTP in compliance of special condition no. 10 that how much time the industry can operate at the location. No reply received from the industry till date. The project proponent has submitted compliance report of the previous Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 granted to it. The site was visited by the undersigned on 21.03.2023 and contacted Sh. D.K. Khurana, President (9023289922). During visit it was observed as under: 1.       The industry was in operation and was engaged in the production of wires & cables. 2.       The Raw Materials involved are Aluminium, PVC, XCP Granules, steel wire. 3.       The Manufacturing Process of the industry is given as under: Wire Drawing (only for aluminum wire) -- Stranding (Single wire out of individual wire) -- Insulation --  Lagging up (Twisting) -- Armouning (Steel Sheathing) -- Final (Sheathing) 4.       The industry has installed 1 no. grinder, 1 no. RBD machines, 3 no. fine drawing machines,  2 no. annealing machines, 5 no. PVC extruder, armouring machine and 3 no. Pot annealing machines. 5.       The industry has also installed one PVC granule unit in which the Raw Material i.e., the PVC Powder CaCl3, CPW, DOP and epoxy are mixed and fed to the extruder to produce PVC granules which is further used as a raw material by the industry for manufacturing electric wires & cables. 6.       No trade effluent is generated from the process. The water used in the process is in RBD machines for shining along with soap which is again recycled back. The water is also used in the process in fine drawing machines for as coolant, in PVC extruder machine as Coolant and in annealing  machine for cooling purpose which is again recycled back. 7.       The industry is already having septic tank and has not make arrangements for discharge of domestic effluent from over flow of the septic tank and same is cleared through tankers. 8.       One submersible pump has been provided and now water meter has been provided on the same and reading was 6266.0 KL. 9.       The industry has provided environmental data board outside the premises. 10.   2 no. DG sets of capacity 125 KVA, 125 KVA have been installed by the industry, which are equipped with canopies and inadequate stacks height. 11.   Overall housekeeping was poor. The project proponent has not extended the bank guarantee amounting to Rs. 1 lakh. The representative was advised and he informed that the same will be submitted in 3-4 days. In view of above, it is recommended that show cause notice for refusal of Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of 7 days to submit reply within writing. *Competency – Senior Environmental Engineer
