It is submitted that the industry is a rice sheller unit, which falls under small scale orange category and has been established after obtaining consent to establish (NOC) vide no.  CTE/Fresh/FZR/2022/19119023 dated 01.07.2022, valid upto 30.06.2023 for the manufacturing of Raw rice with dryer @ 8.0 TPH and Sorted rice @ 8.0 TPH, under Orange category, with certain conditions mentioned therein.                        Now, the industry has applied on 21.02.2023 for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981, for the manufacturing of Raw rice with dryer @ 8.0 TPH and Sorted rice @ 8.0 TPH, under Orange category with requisite documents and adequate consent fees. The detail of case is as under:-                        The industry has submitted completion certificate regarding installation of cyclone separators as APCD for the Pre-cleaning section and sheller section as per attached drawings/ specifications.                                 The rice sheller has submitted partnership deed executed on dated 25.03.2022 between 1. Sh. Naveen Aggarwal S/o Sh. Tilak Raj, and 2. Sh. Sudarshan Kumar S/o Sh. Parshotam Dass, both residents of Zira, Distt. Ferozepur and Bathinda, Distt. Bathinda, respectively, in which it is mentioned that both the above partners have decided to enter into partnership do the business of rice sheller and purchase, sale of rice in the firm name & styled as M/s G A Agro Industries have registered office at Shop No. 42, Grain Market, Zira, District Ferozepur w.e.f. 25.03.2022.                        The industry has submitted certificate of registration of 8 ton capacity sheller from DFSC vide memo no 1653 dated 16.09.2022                        The industry has deposited Rs. 54,000/- vide UTR/Ref. No. SBIN523048723605 dated 17.02.2023 as water consent fee under the Water Act, 1974 and Rs. 54,000/- vide UTR/Ref. No. SBIN523048746513 dated 17.02.2023 as air consent fee under the Air Act, 1981, against the fixed assets of Rs. 227.19 Lakhs as on 31/12/2022 as per CA certificate dated 14/02/2023 submitted by it. Thus, the consent fee is adequate upto 30/09/2027 under each Acts.                        The industry was visited by AEE of this office on 09.03.2023 and it was observed as under:- 1.       The industry was not in operation during visit. The industry has installed machinery for the production of sorted raw rice with one dryer. The industry has provided single shelling line. 2.       The industry has covered all the processing sheds. 3.       The industry has provided brick paved road from main gate of the industry to the rice room/husk area for the movements of vehicles. 4.       The industry has provided separate Cyclone Separator as APCD along with stack of adequate height to control the process emission from shelling section as well as paddy cleaner of  dryer. 5.       The industry has provided stack of adequate height with the APCD and provisions to facilitate emission sampling. 6.       At the point of rice husk discharge pipe, wall on that direction is more than 300 feet away from the discharge pipe, as such there are no chances of reaching rice husk to that point, as such brick wall with mesh wire having total height 15' is not required to be provided. 7.       The industry has provided septic tank for treatment of domestic effluent with provision to discharge onto land for irrigation along the boundary. 8.       The industry has planted trees along its boundary wall.                         The industry is complying with the code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no 10/48/2004-STE-(4) / 932 dated. 15/10/2013. The competency for grant of consents to the rice shellers with dryer lies with the Environmental Engineer of the Regional Office.                           Keeping in view of above mentioned facts, it is, therefore, recommended that consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may be granted to the industry for a period upto 30/09/2027 for operation of rice sheller unit to manufacture Raw rice @ 8.0 TPH and Sorted rice @ 8.0 TPH with one dryer, under Orange category, subject to the suitable conditions alongwith specific condition that the industry will ensure that no nuisance be caused due to nearby vicinity from rice husk all the times.
