It is submitted that the industry is a rice sheller unit, which falls under small scale orange category and has been established after obtaining consent to establish (NOC) vide no. CTE/Fresh/FZR/2022/19325341 dated 02.08.2022, valid upto 01.08.2023 for the manufacturing of Raw rice with dryer @ 5.0 TPH and Sorted rice @ 4.0 TPH, under Orange category, with certain conditions mentioned therein and following additional conditions: •        The industry will install source of pollution in such a way that it is located beyond 500 meters from the National Highway.                        Now, the industry has applied on 11.03.2023 for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981, for the manufacturing of Raw rice with dryer @ 5.0 TPH and Sorted rice @ 4.0 TPH, under Orange category with requisite documents and adequate consent fees. The detail of case is as under:-                        The industry has submitted completion certificate regarding installation of cyclone separators as APCD for the Pre-cleaning section and sheller section as per attached drawings/ specifications.                        The industry has submitted approved building plan from Competent Person under the Deptt. of Factories.                        The industry has deposited Rs. 54,000/- deposited vide UTR/Ref. No.   N037232319077697 dated 06.02.2023 and Rs. 36,000/- deposited vide UTR/Ref. No.  N048232336290918 dated 17.02.2023 as water consent fee under the Water Act, 1974 & Rs. 54,000/- deposited vide UTR/Ref. No. N037232319052724 dated 06.02.2023 and Rs. 36,000/- deposited vide UTR/Ref. No. N048232336369331 dated 17.02.2023 as air consent fee under the Air Act, 1981, against the fixed assets of Rs. 744.30 Lakhs as on 31/01/2023 as per CA certificate dated 15/02/2023 submitted by it. Thus, the consent fee is adequate upto 30/09/2027 under each Acts.                        The industry was visited by AEE of this office on 10.03.2023 and it was observed as under:- 1.       The industry was not in operation during visit. The industry has installed machinery for the production of sorted raw rice with dryer. 2.       The industry has covered all the processing sheds. 3.       The industry has provided brick paved road from main gate of the industry to the rice room/husk area for the movements of vehicles. 4.       The industry has provided separate Cyclone Separator as APCD along with stack of adequate height to control the process emission from shelling section as well as paddy cleaner of  dryer. APCDs  installed by the industry is located at a distance more than 500 meters from the National Highway. 5.       The industry has provided stack of adequate height with the APCD and provisions to facilitate emission sampling. 6.       The industry has provided brick wall of adequate length & further iron sheets has been provided above the said wall having length 70 feet, thus making a height of 15 ft. 7.       The industry has provided septic tank for treatment of domestic effluent with provision to discharge onto land for irrigation along the boundary. 8.       The industry has planted trees along its boundary wall.                         The industry is complying with the code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no 10/48/2004-STE-(4) / 932 dated. 15/10/2013. The competency for grant of consents to the rice shellers with dryer lies with the Environmental Engineer of the Regional Office.                           Keeping in view of above mentioned facts, it is, therefore, recommended that consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may be granted to the industry for a period upto 30/09/2027 for operation of rice sheller unit to manufacture Raw rice with dryer @ 5.0 TPH and Sorted rice @ 4.0 TPH, under Orange category, subject to the suitable condition that  the industry is bound to comply with the zoning regularizations of Master Plan as and when notified and Board will not be liable for any loss incurred in case site falls under non-conforming zone.
