<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/FGS/2021/17489464 dated 22/12/2021 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/FGS/2021/17471040 dated 22/12/2021, both valid upto 30/06/2022 for the manufacturing of M.S Bar/Round @ 15.0 MTD with certain conditions mentioned therein and specific condition that the industry shall shift from pulverized coal to PNG by 31/12/2021.</span></p>
<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">Further, the industry has applied for obtaining renewal of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981. The industry was visited by the officer of the Board <strong>on 01/07/2022</strong> and observed as under:</span></p>

Ltd for shifting its fuel to PNG. As informed by the representative of the industry it has not purchased burners. Further, fabrication work regarding changing of coal based furnace to PNG is pending and same will take 3-4 months. Therefore, the industry has failed to comply with the timeline of 30/06/2022 for shifting its fuel to PNG.</span></p>
<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">Accordingly, the industry was served with show cause notice for refusal of renewal of CTOs under Water Act, 1974 and Air Act, 1981 vide no. 2127 dated 28/07/2022 to file written reply before the Senior Environmental Engineer of the Board within 15 days from the date of issuance of this notice.</span></p>
<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">The industry vide its letter dated 12/08/2022 has submitted reply to the said show cause notice, which is reproduced as under;</span></p>

<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">Accordingly, the reply submitted by the industry was considered and found unsatisfactory. Thus, the industry has failed to comply with the condition of consent to operate granted to it under the Air (Prevention & Control of Pollution) Act, 1981 and violating the provisions of the said Act. The matter was considered by the Competent Authority and it was decided to refuse the consent to operate applied by the industry under the Air (Prevention & Control of Pollution) Act, 1981</span></p>
<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">Thereafter, the industry was refused 'consent to operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/FGS/2022/19167022 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/FGS/2022/19091766 dated 09/08/2022.</span></p>
<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">Now, the subject cited industry has applied for obtaining fresh consent to operate under the Water Act, 1974 and Air Act, 1981 with requisite documents. </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; letter-spacing: .05pt; mso-bidi-font-weight: bold;">The industry has earlier deposited </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Rs. 12600/- vide e-R no. 345602771 dated 22/02/2023 as water consent fee and Rs. 12600/- vide e-R no. 430673056 dated 22/02/2023 & Rs. 7200/- vide e-R no. 224642920 dated 17/03/2023 as Air consent fee <span style="background: white;">against the un-depreciated fixed assets of Rs. 261.78 Lacs as on 22/12/2022 as per CA certificate dated 22/12/2022, which is adequate upto <strong>31/12/2022</strong> as per Board's Office Order dated 29/10/2018 after deducting penalty charges and NOC regularization fee. There is no increase in production capacity as well as pollution load. </span></span></p>
<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 71.95pt; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">The industry was visited by the AEE of this office <strong>on 21.03.2023</strong> and during visit, it was observed as under:</span></p>

<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 71.95pt; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">Moreover, no complaint has been received/pending in this office. The industry has not submitted stack emission sampling was carried out by NABL approved lab on <strong>31/01/2023</strong>. As per the analysis results, the concentration of SPM is found to be <strong>84 mg/Nm3</strong>, which is within the permissible limits of 150 mg/Nm3 as laid down by the Board.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: EN-IN;">In the meeting held under the Chairmanship of Shri Vijay Kumar Janju, Chief Secretary, Punjab with the representatives of rolling mills operating in Mandi Gobindgarh Area on 30/12/2022 at 12:00 noon regarding their conversion of fuel from Coal/Furnace Oil to PNG, it was unanimously decided that the rolling mills operating in Mandi Gobindgarh area may be granted relaxation for some time for converting from their conventional fuels to cleaner fuels and the Competent Authority of the Board may consider/ decide regarding extending the validity of the Consents to Operate till finalization of State Fuel Policy or 31/12/2023, whichever is earlier subject to suitable conditions.</span></p>

However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."</span></strong></p>

CEE(HQ)/F.No.957/2016/59 dated 02/02/2016 has decided that the Board shall grant renewal of NOC / Consent to operate within 7 days to all types of industries falling under Orange and Green category, without visiting the industry on the basis of submission of documents self attested by the Owner / Director /Managing partner of industry and deposition of fee prescribed by the Board for such type of industries. The data, processes and pollution control measures installed by the industry shall be verified at a later date by visiting the site as per inspection guidelines. Further, as per PPCB office order no. 443 dated 09.08.2021</span><span lang="EN-US">, </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Tahoma; mso-bidi-language: PA; mso-bidi-font-weight: bold;">the Board in its 185th meeting held on 07.01.2021 has decided to extend the facility for auto generated renewal to all categories of small scale industries / projects, without inspection / physical verification of the environmental parameters at the time of application(s).</span></p>

S.O. 3250(E) dated 20.07.2022 of MoEF&CC and obtain Environmental Clearance, failing which this 'consent to operate' shall stand revoked/cancelled automatically.</span></p>
