File Note: <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;It is submitted that the industry is a lead smelting unit which was granted consents to operate under the Water Act, 1974 and Air Act, 1981 vide nos.&nbsp;&nbsp; CTOW/Fresh/FZL/2022/19333980 and CTOA/Fresh/FZL/2022/19237974 dated 17/08/2022, expired on 16/02/2023, respectively, for operation of lead smelting unit to manufacture Lead Ingots@ 5 TPD (1250 TPA)&nbsp; and Battery Plates @ 1000 nos./day by using Used/ Waste Lead Acid Battery 1875 TPA, subject to the conditions mentioned therein alongwith the special condition that the consents to operate is granted to the industry only for the purpose of obtaining registration-cum-passbook under the HOWM Rules, 2016 and the industry shall not procure any raw material/ hazardous waste for re-cycling in this period and shall not operate without obtaining registration-cum-passbook under the said Rules.</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has been granted authorization under the HOWM Rules, 2016 in the name &amp; style of M/s G-2 Industries on 22.07.2020 (valid upto 30.06.2022) for generation, collection, storage &amp; disposal of hazardous waste of category 9.1 (Lead bearing residues) @1 TPA, cat. 9.2 (Lead ash or particulate from flue gas) @ 0.1 TPA &amp; 9.3 (Acid from used batteries) @ 0.1 KLA.</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry has obtained registration/passbook in the name &amp; style of M/s G-2 Industries under HOWM Rules, 2016 for utilization of lead acid batteries/ lead scrap on 15.09.2017 (valid upto 14.09.2022).</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry was visited by AEE of this office on 08.12.2022 and it was observed that:</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry was not in operation, during visit. However, there is huge storage of battery cages at in the unit, showing that unit has been operated. Also, lead ingot was found at the site. The industry has failed to product record of raw material being procured. </span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has stored category 9.1 in open space also. The category 9.2 was stored near the APCD. The hazardous waste room seems small for storage of such waste. The representative of the industry informed that category 9.1 &amp; 9.2 can still be reprocessed. </span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has stored 30 kg of category 9.1 &amp; nil storage of category 9.2 &amp; 9.3. No record has been produced. </span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has installed one smelting furnace, in which wood/charcoal is used as fuel. Gravity Settling Chamber, Twin Cyclone, bag filter and scrubber have been installed as APCD with this furnace. </span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry is discharging its domestic effluent onto land for plantation after passing through septic tank. </span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">6.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has provided suction hood over breaking section and same has been connected with APCD system. </span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">7.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has provided lime treatment system followed by neutralization pits, for further discharge to plants at main gate of the industry. There is nil storage in neutralization pits after lime treatment system. No storage of lime was found. The representative informed that they are processing dry batteries. </span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In the meantime, the industry has applied for obtaining authorization &amp; for obtaining passbook-cum-registration under HOWM Rules, 2016 in the name &amp; style of M/s Shri Balaji Industries, which is in process.</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Accordingly, the industry was afforded an opportunity of personal hearing u/s 31-A of Air Act, 1981 alongwith revocation of consents to operate under Water Act, 1974 &amp; Air Act, 1981 as well as violation of provisions of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 on 09.02.2023.</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;During hearing, the representative of the industry informed that they have purchased the unit and are yet to obtain varied consents/ authorization and pass book. </span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; It was observed that the industry under the new name M/s Balaji Industries has failed to obtain prior permissions for operating this type of unit. As per the physical condition reported by the visiting officer, huge quantity of raw material was found procured and was lying in the premises. As such, it is a fit case to confirm directions for closure of the unit.</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; After hearing the representative of the industry and officer of the Board, the Chief Environmental Engineer (B) decided that:-</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">(i)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Directions u/s 31-A of the Air Act, 1981 be issued for closure of the industry and simultaneously, PSPCL authorities be asked to disconnect the electric connection of the industry with immediate effect.</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">(ii)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The authorization-cum-passbook applied by the industry under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 be processed on merits.</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">(iii)&nbsp;&nbsp;&nbsp;&nbsp; The industry shall not operate/ procure raw material without obtaining varied consents to operate under Water Act, 1974 &amp; Air Act, 1981, authorization and passbook as actual user certificate as required under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The proceedings of the personal hearing were conveyed to the industry vide Zonal Office letter no. 857 dated 07.03.2023. </span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In compliance to decision no. (i), directions u/s 31-A of the Air Act, 1981 were issued for closure of the industry and simultaneously, PSPCL authorities be asked to disconnect the electric connection of the industry with immediate effect vide Board&rsquo;s letter no. 918-19 dated 13.03.2023. Also, vide this office letter no. 1254-55 dated 17.03.2023, PSPCL authorities were requested to disconnect the electric connection of the industry immediately and submit compliance to this office. </span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Now, the industry has submitted applications for obtaining renewal consent to operate under the Water Act, 1974 and the Air Act, 1981 for operation of lead smelting unit to manufacture Lead Ingots @ 1250 TPA and Battery Plates @ 1000 nos./day by using Used / Waste Lead Acid Battery @ 1875 TPA, with requisite documents and adequate consent fees. The detail of the case is as under:-</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has submitted an affidavit dated 14/02/2023 bearing certificate no. IN-PB71022191872128V stating that Sh. Pawan Kumar S/o Sh. Rang Lal S/o Sh. Niyamat Rai, R/o Radha Swami Colony, Fazilka has sold the unit to M/s Shri Balaji Industries through Sub Registrar, Jalalabad, vide Vasika No. 2111 dated 26/10/2021, the land measuring 2 kanal area including existing plant &amp; machinery of the industry and raw material situated at Village Dhab Khushal, Jalalabad, Distt.Fazilka .</span></p> <p class="MsoListParagraphCxSpFirst" style="margin-left: 0in; text-indent: 0in; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: Wingdings; mso-fareast-font-family: Wingdings; mso-bidi-font-family: Wingdings;">&Oslash;<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry has submitted certificate of C.A showing value of gross fixed assets of the industry as Rs. 16.50 lacs as on 31.12.2022.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-left: 0in; text-indent: 0in; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: Wingdings; mso-fareast-font-family: Wingdings; mso-bidi-font-family: Wingdings;">&Oslash;<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry has deposited Rs. 11000/- vide UTR/ Ref. No.&nbsp; N055221846154664 dated 24.02.2022 as consent to operate fee under the Water Act, 1974 and Rs. 220/- vide UTR/ Ref. No. N055221846175782 dated 24.02.2022 deposited as water penalty fee, which is adequate for a period upto 30.06.2027 under orange category.</span></p> <p class="MsoListParagraphCxSpLast" style="margin-left: 0in; text-indent: 0in; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: Wingdings; mso-fareast-font-family: Wingdings; mso-bidi-font-family: Wingdings;">&Oslash;<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry has deposited Rs. 11000/- vide UTR/ Ref. No.&nbsp; N055221846152337 dated 24.02.2022 deposited as consent to operate fee under the Air Act, 1981 and Rs. 220/- vide UTR/ Ref. No.&nbsp;&nbsp; N055221846175782 dated 24.02.2022 deposited as air penalty fee, which is adequate for a period up to 30.06.2027 under orange category.</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; To process the application of the industry, the industry was visited by undersigned (AEE) on 22.03.2023 and it was observed as under:&ndash;</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry was not in operation during visit. No battery was lying at site. Electric connection of the industry was found disconnected.</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has stored category 9.1 &amp; 9.2 in hazardous waste room. No open storage of hazardous waste was found. The representative of the industry informed that they will produce only dry battery, so that there will be nil generation of category 9.3. The industry has stored hazardous waste in storage room and maintained the record in register for hazardous waste.</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has installed one smelting furnace, in which wood/charcoal is used as fuel. However the representative of the industry informed that they will procure dry batteries only.</span></p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; From above, it is clear that the industry is complying with the conditions of consents granted to it under the Water Act, 1974 &amp; the Air Act, 1981, Hazardous &amp; Other Wastes Rules, 2016 and with the SOP framed by CPCB for lead scrap/used lead acid battery recycling units.</span></p> <p style="text-align: justify;">&nbsp;</p> <p class="MsoNormal" style="margin-left: 0in; text-align: justify;"><span style="font-family: 'Tahoma','sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Keeping in view of above, it is recommended that consents to operate under the Water Act, 1974 &amp; Air Act, 1981 may be granted for a period of six months and directions may be passed to the PSPCL authorities for temporary restoration of electric connection, please.</span></p>
