<p>It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/BAR/2022/19688225 dated 24/08/2022 and the Air Act, 1981 vide no. CTOA/Renewal/BAR/2022/19687327 dated 24/08/2022, both valid upto 30/09/2023, for manufacturing of Sorted Raw Rice (without Dryer) @ 1.0 TPH by processing of Paddy @ 1.5 TPH, as raw material under orange category.</p>
<p>Now, the industry has applied for renewal of consents to operate under the Water Act, 1974 & the Air Act, 1981, for production of Sorted Raw Rice (without Dryer) @ 1.0 TPH by processing of Paddy @ 1.5 TPH, as raw material under orange category.</p>
<p>The industry has deposited Rs. 9000/- through online vide UTR No. N052232339813308 dated 21/02/2023 under the Water Act, 1974 & Rs. 9000/- through online vide UTR No. N052232339812989 dated 21/02/2023 under the Air Act, 1981. The fee deposited is adequate up to 30/09/2028 against the value of fixed assets of Rs. 24.99 lacs as per CA certificate dated 16/02/2023.</p>
<p>The industry has also submitted compliance report of consent conditions earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The industry has further submitted an undertaking that the consent to operate to my rice sheller unit be granted based on the undertaking submitted by me, therefore, in case during the visit to the industry in future, the entire contents of the undertaking or any part of this undertaking is found false, the Board shall be free to take action against the unit under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</p>
<p>The industry has also submitted undertaking regarding updation of APCD from time to time, in future when and required by PPCB or Punjab Govt. As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for five years, ten years & 15 years respectively. The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.</p>
<p>It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. Further, it is intimated that there is no change in the underappreciated value of the fixed assets.</p>
<p>No complaint is pending against the industry. The industry was found complying with consent conditions during last visit and consents were granted thereafter.</p>
<p> Keeping above in view, it is recommended that consent to operate granted under the Water Act, 1974 & under the Air Act, 1981 may be renewed up to 30/09/2028 for manufacturing of Sorted Raw Rice (without dryer) @ 1.0 TPH by processing of Paddy @ 1.5 TPH under orange category, subject to certain conditions to be mentioned therein.</p>
