CTOW/Fresh/SGR/2022/19615796 dated 17/08/2022 and under the Air Act, 1981 vide no. CTOA/Fresh/SGR/2022/19607766 dated 17/08/2022, both are valid upto 31/03/2023, for manufacturing of Raw rice (Without sortex machinery and without dryer) @ 6.0 T/Hour, by using paddy @ 9.0 T/Hour as raw material, under orange category.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 63.8pt; line-height: 14.35pt; background: white;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; background: white;"><span style="mso-tab-count: 1;"> </span></span><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; background: white; mso-fareast-language: EN-IN; mso-bidi-language: PA;">Now, the industry has applied for renewal of consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air Act, 1981, for production of </span><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; background: white;">Raw rice (Without sortex machinery and without dryer) @ 6.0 T/Hour, by using paddy @ 9.0 T/Hour as raw material, under orange category</span><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; background: white; mso-fareast-language: EN-IN; mso-bidi-language: PA;">.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; color: black; background: white; mso-fareast-language: EN-IN; mso-bidi-language: PA;"><span style="mso-tab-count: 2;"> </span></span><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; background: white;">The consent fee already deposited in previous granted applications is adequate upto 31.03.2024, under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; background: white;"><span style="mso-tab-count: 2;"> </span>Now, the industry has deposited consent fee of Rs. 16,000/- through online vide R No. 150713635 dated 15/03/2023 on account of Water Act, 1974 and 16,000/- through online vide R No. <br />962752024 dated 15/03/2023 on account of Air Act, 1981, against the fixed assets of value i.e. Rs. 47.29 Lacs as on 29.05.2022 as per CA certificate date 30.05.2022. The aggregate fee is <strong>adequate upto 30.09.2029, </strong>under the both the Acts. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; background: white;"><span style="mso-tab-count: 2;"> </span>The industry had already deposited Rs. 7,198/- vide no. 26/5492 dated 12.08.2022, as air sample testing fee in advance. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; background: white;"><span style="mso-tab-count: 2;"> </span></span><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The industry has also submitted compliance report of consent conditions earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The industry has further submitted an undertaking that the consent to operate to my rice sheller unit be granted based on the undertaking submitted by me, therefore, in case during the visit to the industry in future, the entire contents of the undertaking or any part of this undertaking is found false, the Board shall be free to take action against the unit under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 63.8pt; line-height: normal;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The industry has also submitted undertaking regarding updation of APCD from time to time, in future when and required by PPCB or Punjab Govt. As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for five years, ten years & 15 years respectively. The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 63.8pt; line-height: normal;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. Further, it is intimated that there is no change in the underappreciated value of the fixed assets. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 63.8pt; line-height: normal;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;"><span style="mso-spacerun: yes;"> </span>No complaint is pending against the industry. The industry was found complying with consent conditions during last visit and consents were granted thereafter.</span></p>
<p class="MsoNormal"><span lang="EN-US" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 1;"> </span><span style="mso-spacerun: yes;"> </span>Keeping above in view, it is recommended that consent to operate granted under the Water Act, 1974 & under the Air Act, 1981 may both be renewed up to <strong style="mso-bidi-font-weight: normal;">30/09/2029</strong> for manufacturing of <span style="background: white;">Raw rice (Without sortex machinery and without dryer) @ 6.0 T/Hour, by using paddy @ 9.0 T/Hour as raw material, under orange category, </span>subject to certain conditions to be mentioned therein.</span></p> |
