<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif;">It is submitted that the industry is a large <span style="mso-spacerun: yes;"> </span>scale red category industry and has been granted Consent to Operate <a name="_Hlk130216870"></a>under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH4/2022/17954286 dated 25.05.2022 valid upto 31.03.2023 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH4/2022/17954331 dated 25.05.2022 valid upto 31.03.2023.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif;">Now, the industry has applied for Renewal of Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 through OCMMS. The industry has deposit Rs. 2,40,100/- vide R. No. 543204497 dated 09.03.2023, under the Water Act, 1974 and Rs. 21,600/- including NOC regularization fees, and Rs, 2,18,000/- vide R. No. 258409699 dated 09/03/2023 under the Act, 1981 which is adequate upto <span style="color: black; mso-themecolor: text1;">31.03.24 </span>against gross value of fixed assets Rs. 150,95,19,000/- Cr. and plant & machinery Rs. 296,55,00,000/- as per C.A Certificate on 31.12.2022.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif;">To verify the facts, the industry was visited by the undersigned on <span style="color: black; mso-themecolor: text1;">15.03.2023 </span>and it was observed as under:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif;">The project proponent has developed a logistic park for receiving various kinds of goods from international as well as domestic markets.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif;">The Project proponent has provided STP @10 KLD for treatment and disposal of effluent from office and admin section. During visit the STP was not in operation and untreated effluent was lying collected in the collection tank. The physical condition of the STP reveals that it is not being operated regularly.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif;">The project proponent failed to show the <span style="mso-spacerun: yes;"> </span>record of STP operation and energy meter readings.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif;">The project proponent has provided 4 no. DG sets with canopy and adequate stack heights.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif;">It is further informed that industry has earlier submitted C.A certificate dated 02.02.2022 in earlier application mentioning the value of plant & machinery as Rs. 6025.75 lacs and now the industry has submitted value of plant & machinery in C.A certificate dated 27.01.2023 as Rs. 296.55 lacs. From the above, it is doubtful that industry has submitted revised certificate in order to comes under small scale category. (both C.A certificate attached).</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif;">The industry failed to show any agreement for disposal of Municipal Solid Waste. <span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0in; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style',serif;">In view of above, it is recommended that the Show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 may be issued to the project proponent with opportunity of the personal Hearing before the Competent Authority of the Board.</span></p>
