CTOW/Renewal/SAS/2019/10142012 dated 19/07/2019 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2019/10142247 dated 19/07/2019, both of which were valid upto 17/11/2022, for manufacturing of Lead product (ingots) from old dry batteries @ 8.3 MTD as raw material.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Thereafter, the industry had applied for obtaining renewal of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. However, the said application were refused by the Board vide no. CTOW/Renewal/SAS/2022/20324390 dated 22/12/2022 and Air (Prevention & Control of Pollution) Act, 1981, vide no. CTOA/Renewal/SAS/2022/20324124 dated 22/12/2022, due to following observations:</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">‘<em>As per CPCB’s SOP for lead acid battery recycling units, the industry is required to install ETP in its premises. However, the industry not yet installed effluent treatment plant in its premises, as such, the industry is not complying with the SOPs now laid down by CPCB</em>.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Now, the industry has again applied obtaining renewal ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Lead product (ingots) from old dry batteries @ 8.3 MTD as raw material.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">It is worth to mention here that, along with the online application, the industry has now submitted a copy of dimensional drawing and completion certificate of newly installed ETP of capacity 1M3/day in its premises.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">As per record file, the previous fee already deposited by the industry is adequate upto 31.03.2025. The industry had deposited Rs. 18665/- UTR R. no. SBIN422301941008 dated 28.10.2022 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 19165/- vide R. no. SBIN422301941161 dated 28.10.2022 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 31.03.2027 for both the Acts against the fixed assets of Rs. 51.30 lakh on 06.10.2022.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';"> </span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Now, the industry has deposited Rs. 1350/- vide R. no. 901083353 dated 03.03.2023 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 1350/- vide R. no. 62827823 dated 03.03.2023 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 31.03.2027.</span></p>
<p class="MsoBodyText" style="margin: 0in -3.5pt 6pt 0in; text-align: justify;"><strong><u><span lang="EN-IN">Status of Passbook under Rule, 09 of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016</span></u></strong><span lang="EN-IN">:</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">The industry has been issued actual user certificate cum passbook by the Board vide letter no. 46445 dated 18.12.2017 and the passbook is valid upto 17.12.2022. Further, the online application of the industry for obtaining renewal of the said passbook was process (application no. 20545305) and the same is pending at ZO Level.</span></p>

During visit, as the unit was not in operation thus, the APCD was also not in operation. </span><span style="line-height: 24px;">The industry has submitted analysis report of the air emission sample from private laboratory i.e. M/s Eco Laboratories and Consultants Pvt. <p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px;"><span style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry shall not procure any raw material, without having valid Passbook under Rule, 09 of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin: 0in -9pt 0.0001pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px; background: white;"><span style="font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall maintain the record of receiving of used battery from the different states and quantity of product (i.e. lead recovery) and submit the same in the Regional office on monthly basis.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in -9pt 0.0001pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px; background: white;"><span style="font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall comply with the standard operating procedure (SOP) framed by the CPCB for battery recycling units, at all times.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in -9pt 0.0001pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px; background: white;"><span style="font-family: 'Bookman Old Style', 'serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall break/ dismantle used batteries in scientific ways.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin: 0in -9pt 0.0001pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px; background: white;"><span style="font-family: 'Bookman Old Style', 'serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall submit the ambient air quality report as well as stack emission report from the Board’s lab / Board’s approved lab once in a year.</span></p>
<p class="MsoBodyText" style="margin: 0in 5.85pt 0.0001pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px;"><span style="line-height: 24px;">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="line-height: 24px;">The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.</span></p>
<p class="MsoBodyText" style="margin: 0in 5.85pt 0.0001pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px;"><span style="line-height: 24px;">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="line-height: 24px;">The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received</span></p>
<p class="MsoBodyText" style="margin: 0in 5.85pt 0.0001pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px;"><span style="line-height: 24px;">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="line-height: 24px;">The Consent is being issued to the industry based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.</span></p>
<p class="MsoBodyText" style="margin: 0in 0.2pt 0.0001pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px;"><span style="line-height: 24px;">9.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="line-height: 24px;">In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.</span></p>
