It is submitted that filling station is a small-scale green category unit and the project proponent was granted consent to establish (NOC) vide no. CTE/Fresh/BAR/2021/17590878 dated 07/01/2022, valid upto 06/01/2023 for outlet filling station Petrol & Diesel @ 5000 ltr/day in the new petrol pump under the name & style - M/s Nand Petro, Bathinda-Barnala Road, Handaya, Tehsil & District Barnala along with requisite documents through OCMMS of the Board. Now, the project proponent has applied for extension in validity of consent to establish (NOC) for outlet filling station Petrol & Diesel @ 5000 ltr/day. The project proponent has deposited NOC fee of Rs. 700/- vide UTR no. 154759026 dated 14/03/2023 and Rs. 140/- vide UTR no. 295175764 dated 22.03.2023 as penalty fee against the value of fixed assets of Rs. 20.0 lacs, which is adequate for one year. The project proponent has also submitted the site / location plan approved by the Sh. Vikrant Hate, Tertiary Manager (Retail), Bathinda. It is worth to mention here that Central Pollution Control Board has framed siting guidelines for setting up of new petrol pump/filling station vide memo no. B-13011/1/2019-20/AQM/10822 dated 07/01/2020 and same are as under:- "In case of siting criteria for petrol pumps/ filling station, new Retail Outlets shall not be located within a radial distance of 50 meters (from fill point dispensing units vent pipe whichever is nearest) from schools, hospitals (10 beds and above) and residential areas designated as per local laws. In case of constraints in providing 50 meters distance, the retail outlet shall implement additional safety measures as prescribed by PESO. In no case, the distance between new retail outlet from schools, hospitals (10 beds and above) and residential area designated as per local laws shall be less than 30 meters. No high tension line shall pass over the retail outlet. Now, the Board vide endst no. 15172-78 dated 06.07.2021 has issued the guidelines for retail outlets/dispensing stations being established in the State of Punjab, in which, it has been stated that guidelines prescribed by CPCB for petrol pumps/retail outlets vide memo no. B-13011/1/2019-20/AQM/10822 dated 07/01/2020 shall be followed, till any specific guidelines for retail outlets/dispensing stations are received. These guidelines are supplementary to all existing relevant Rules. Guidelines Order: etc." The project proponent has got certificate issued from the office of SDM, Barnala vide no. 286/vikas dated 03.01.2022 stating that the site falls outside the distance of 100 mtr from school, hospital and residential area. To verify the facts, the proposed site of the filling station was visited by AEE of this office on 25/03/2023 and it was observed as under: - 1. The site falls in revenue estate of Village Handiaya-D, Tehsil and District Barnala. 2. There is no school, hospital, 15 pucca houses within 50-meter radius of the proposed site. 3. There is no high tension line passing over the proposed site of filling station. 4. The project proponent has proposed to install DG of capacity 15 KVA, equipped with canopy and adequate stack height. 5. The project proponent has not generating any trade effluent. Domestic effluent  is being proposed to discharg onto land for plantation after passing through septic tank. From the above, it is clear that the site of the filling station is comply with siting criteria prescribed by the CPCB & suitable for the establishment of filling station at the proposed site. Keeping in view of above, it is recommended that the project proponent may be granted extension in validity of consent to establish (NOC) for further one year for establishment for filling station Petrol & Diesel @ 5000 ltr/day, with suitable conditions as per policy of the Board and following special conditions that:- 1. The filling station shall obtain authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and complying with the said rules. 2. The filling station will submit on site emergency plan to the Board and also prepare of side emergency plan as per the Manufacturing, Storage & Import of Hazardous Chemical Rules, 1989. 3. The filling station will not carry out any process at the site i.e., automobile servicing, repairing and painting etc. which creates water & air pollution without prior written permission of the Board. 4. The filling station will comply with the Punjab Regional Town Planning & Development Act, 1995 and will obtain necessary approval. 5. The filling station will obtain NOC from Petroleum & Explosive Safety Organization, Govt. of India and comply with the certain conditions mentioned therein. 6. The filling station will comply with the guidelines of I.R.C: 12-2009. 7. The filling station shall install DG set equipped with canopy / acoustic chamber so as to comply with noise standards prescribed under the Noise (Pollution & Control) Rules, 2000. For the installation of diesel generated set of capacity more than 15 KVA, filling station shall obtain consent to operate of the Board under the provisions of the Air (Prevention & Control of Pollution) Act, 1981. 8. The outlet will obtain permission from all concerned Departments. A copy of the NOC may be also sent to the District Magistrate, Barnala for information, please.
