CTOA/Renewal/RPN/2020/13681986 dated 28/09/2020, both were valid upto 30/09/2023 for operation of Stone crusher only @ 4700 CFT/Day in the name of Sh. Narinder Thakur, Partner. <span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-font-weight: bold;">Thereafter, the Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act 1981 was revoked/cancelled vide no. 1070 dated 27.04.2022 as the unit was being run illegally and storing a large quantity of material.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%;">Now, the unit has applied for obtaining fresh 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 in the name of Sh. Vikram Singh Kahlon, Partner (with change of proprietor ship documents i.e. Admission-cum-Retirement Deed) alongwith compliance of previous consent, undertaking regarding code of practice & legal mining, authorization letter, mining slips and consent fee. </span></p>

Gurnam Dhiman & Sh. Narinder Thakur were retired from the partnership deed and Sh. Vikram Singh Kahlon & Sh. Rajesh Kumar Kaushal are the continuing partners. Further, the unit has also submitted Partnership-cum-Retirement Deed 10.02.2023, wherein, it has mentioned that Sh. Rajesh Kumar Kaushal was retired from the deed and Sh. Vikram Singh Kahlon & Sh. Sukhwant Sing Sarao are the continuing partners.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 76.5pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%;">Further, the unit has submitted the slips of obtaining raw material from HP, verified by O/o Executive Engineer-cum-District Mining, Drainage cum Mining Division, Sri Anandpur Sahib dated 31.01.2023 regarding obtaining raw material from Himachal Pradesh through check post Khera Kalmot</span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 76.5pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%;">The industry has submitted the CA certificate dated 15.02.2023, wherein the value of fixed assets of the industry as on 31.12.2022 is Rs. 40.46 lakhs with value of plant & machinery is Rs. 32.40 lakhs. As per the record file earlier, the fee deposited by the unit was adequate upto 30.06.2025 under both the Acts. Now, the unit has deposited additional fee amounting to Rs. 2900/- vide UTR. No. N058232347174162 dated 27.02.2023 under the Water Act, 1974 and Rs. 2900/- vide UTR. No. N058232347177567 dated 27.02.2023 under the Air Act, 1981. As such, the fee deposited by the unit is adequate upto 30.06.2025 after adjusting penalty @ 100% as per circular dated 29.10.2018</span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">.</span></p>

Vishal, Munshi was contacted. During visit, it was observed as under:</span></p>

<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 70.9pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%;">As such, it is clear that the unit is not complying with the code of practice prescribed for such kind of unit and is violating the provisions of the Water Act, 1974 and the Air Act, 1981 and is operating the unit without obtaining valid consent to operate under the Water Act, 1974 and the Air Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 70.9pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%;">Thereafter, the unit was issued show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 alongwith an opportunity of personal hearing on 21.03.2023 at 11:00 am to show cause as to why the proposed action may not be taken.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 70.9pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%;">The representative of the industry attended the hearing and informed that it has removed all the observations observed during the visit except Environmental Data Board which is being installed.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 70.9pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%;">After hearing the representative of the unit and considering background of the case, the Environmental Engineer decided that the AEE will visit the unit within 07 days to verify the contention of the unit and process the application of the unit on merit as per visit.</span></p>

Vikram Singh Kahlon, Partner was contacted. During visit, it was observed as under:</span></p>
