File Note: <p style="text-align: justify;">Kindly peruse the report/ recommendations sent by RO.</p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;">It is brought out here that the industry was earlier granted &lsquo;Consent to Establish&rsquo; for expansion vide no. CTE/Exp/LDH1/2022/18012719 dated 27.04.2022 having validity upto 31.12.2022 for installing an induction furnace capacity of capacity 7 TPH for manufacturing of &lsquo;Alloys and Non Alloys steel ingots , Billet&rsquo; @ 77 MTD in addition to the operation of existing and consented machinery i.e. Rolling Mill with one reheating furnace of capacity 25 TPH, Annealing furnaces (02 nos.) for manufacturing of &lsquo;Round Bar,Hexa Bar,Flat,Wire Rod And Square&rsquo; @ 600 MTD, subject to certain conditions and some of the following additional condition that:</p> <p style="text-align: justify;">&ldquo;1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry shall not increase its production capacity beyond 30,000 MTA, in any case.</p> <p style="text-align: justify;">2. The industry shall not carry out any activity in its premises, which is covered under the ambit of EIA notification dated 14.09.2006, without prior permission of the Competent Authority.</p> <p style="text-align: justify;">3. The industry shall submit the completion certificate of APCD from PSCST, at the time of applying for varied CTO under the Water Act, 1974 &amp; Air Act, 1981.</p> <p style="text-align: justify;">4. The industry shall carry out expansion in its existing area only and shall not add any new/additional land area in its premises, without prior permission from the Board.&rdquo;</p> <p style="text-align: justify;">Further, it was earlier granted varied CTO under the Air Act, 1981 vide no. CTOA/Varied/LDH1/2022/18054885 dated 26.04.2022 having validity upto 31.12.2022, subject to certain conditions and some of the following additional condition that:</p> <p style="text-align: justify;">&ldquo;1. The industry shall comply with directions by Hon'ble NGT in O.A no. 55/2019 (WZ) in the matter of Gajubha Jesar Jadeja vs Union of India &amp; Ors, as applicable.</p> <p style="text-align: justify;">2. The industry shall provide energy saving devices like Variable Frequency Drive (VFD), Recuperator etc. for the fuel saving, resulting less pollution, till PNG is available to the unit.</p> <p style="text-align: justify;">3. The industry shall make necessary changes in its machinery w.r.t PNG, which is a cleaner fuel and switch over to PNG, within six months after arrival of PNG in the area of industry.&rdquo;</p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;">Meanwhile, the MoEF&amp;CC vide notification no. S.O. 3250(E) dated 20.07.2022, had notified that:</p> <p style="text-align: justify;">&ldquo;Central Government is of the view that steel re-rolling operations fall under the purview of the secondary metallurgical processing industry and require Environment Clearance as per item 3(a), relating to Metallurgical Industries (Ferrous and Non-ferrous), of the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide notification number S.O. 1533 (E), dated the 14th September, 2006, mandating the requirement of prior environmental clearance for the projects covered in its Schedule (hereinafter referred to as the said notification), wherein all non&ndash;toxic secondary metallurgical processing units with capacities greater than 5000 tonnes/annum (TPA) fall under category B;</p> <p style="text-align: justify;">Now, therefore, in exercise of the powers conferred by section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby directs that all the standalone re-rolling units or cold rolling units, which are in existence and in operation as on the date of this notification, with valid Consent to Establish (CTE) and Consent to Operate (CTO) from the concerned State Pollution Control Board or the Union territory Pollution Control Committee, as the case may be, shall apply online for grant of Terms of Reference (ToR) followed by Environment Clearance and the said units shall be granted Standard Terms of Reference as per item 3(a) of the said notification and shall be exempted from the requirement of public consultation.</p> <p style="text-align: justify;">Provided that the application for the grant of ToR shall be made within a period of one year from the date of this notification.&rdquo;</p> <p style="text-align: justify;">Furthermore, the Board has endorsed the said notification vide letter no. 20242-57 dated 23.09.2022, with advisory to all concerned industries to comply with the above-mentioned provisions of said notification in true letter &amp; spirit.</p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;">In lieu to the above conditions and the report received from the RO; the following shortcomings have been observed in the application:</p> <p style="text-align: justify;"><!-- [if !supportLists]-->1.&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has not submitted completion certificate of APCD attached with the induction furnace from PSCST, as per condition of the &lsquo;Consent to Establish&rsquo; expansion.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->2.&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has not attached revised building plan of the unit after the expansion, approved from the Director of Factories, Punjab.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->3.&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has not submitted compliance of the conditions of the last CTO granted under the Water Act, 1981 and the Air Act, 1974 and the compliance report attached in note history of the application pertains to some older consent granted to it.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->4.&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has not submitted &lsquo;ToR&rsquo; issued for EC application or the status of the same, for the existing Rolling Mill of the unit.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->5.&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has not deposited NOC regularisation fees for &lsquo;Consent to Establish&rsquo; Expansion as it had already expired on 31.12.2022.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->6.&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->Further, the industry has not deposited penalty fees in accordance with Board&rsquo;s order dated 29.10.2018, as the earlier CTO granted had expired on 31.12.2022.</p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;">It is pertinent to mention here that the industry had earlier applied for &lsquo;Consent to Establish&rsquo; expansion as well as CTO varied from Ind Reg ID G18LDH1615036; but has now applied for CTO varied from new Ind Reg ID O22LDH1314679 and it is required to apply for CTO varied from the existent Ind Reg ID G18LDH1615036.</p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;">Keeping above in consideration, if approved, the application be sent back to RO-I, Ludhiana for returning the same to the industry with request to resubmitting its application in lieu to the above points.</p> <p style="text-align: justify;">P.S.: The application could not be processed earlier due to huge inflow of applicaitons on the IP-BF portal and the inadvertent delay in processing the application is regretted.</p>
