<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal; tab-stops: 36.0pt;"><span style="font-size: 10.5pt; font-family: 'Arial','sans-serif';"> The Assistant Environmental Engineer, Regional Office-2, Ludhiana brought out that </span><span style="font-size: 10.5pt; font-family: 'Arial','sans-serif'; mso-fareast-font-family: 'Times New Roman';">the industry was found operating without valid Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and violating the provisions of the said Acts. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal; tab-stops: 36.0pt;"><span style="font-size: 10.5pt; font-family: 'Arial','sans-serif'; mso-fareast-font-family: 'Times New Roman';"> The show cause notice was issued to the industry with opportunity of personal hearing</span> <span style="font-size: 10.5pt; font-family: 'Arial','sans-serif'; mso-fareast-font-family: 'Times New Roman';">before the CEE, Ludhiana on 16.12.2022, wherein, it was decided as under: -</span></p>

<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 35.45pt; line-height: 115%;"><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif';">The </span><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif'; mso-fareast-font-family: 'Times New Roman';">industry applied for Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for Dyeing and washing of Knitted Fabric @ 2300 kgs/day, which was refused after giving an opportunity of show cause in writing, as the industry failed to submit any reply regarding the following points:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -21.25pt; mso-list: l1 level1 lfo2; margin: 0cm 0cm .0001pt 35.45pt;"><!-- [if !supportLists]--><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif'; mso-fareast-font-family: Arial;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif'; mso-fareast-font-family: 'Times New Roman';">As per DTP certificate dated 7.12.2022, the part of industry upto 500’ falls in mix land use along road front and remaining part falls in industrial. It has also been mentioned that green category industries are allowed in mix land area along road front.</span></p>

The industry has not mentioned the total length in the Site plan.</span></p>

However, some part of site falls under industrial and the industry is required to apply for consent under red category in that industrial area only.</span></p>

<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -21.25pt; mso-list: l1 level1 lfo2; margin: 0cm 0cm .0001pt 35.45pt;"><!-- [if !supportLists]--><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif'; mso-fareast-font-family: Arial;">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif'; mso-fareast-font-family: 'Times New Roman';">The industry is yet to develop a 2500 sq. yard on the plantation area as per the site plan and only small pockets of the plantation area have been developed.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 36.0pt; line-height: 115%;"><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif';">The</span><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif'; mso-fareast-font-family: 'Times New Roman';"> industry has again applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for dyeing of fabric @ 2300 kg/day.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 36.0pt; line-height: 115%;"><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif';">The</span><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif'; mso-fareast-font-family: 'Times New Roman';"> industry </span><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif';">has not submitted report from DTP that it has installed its unit in Industrial Zone only.</span></p>
<p class="MsoListParagraph" style="margin: 0cm; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 35.45pt;"><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif';">The industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 16.03.2023.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; tab-stops: 36.0pt;"><span style="font-size: 10.5pt; line-height: 107%; font-family: 'Arial','sans-serif';"> Sh. Bawinder Singh, Proprietor of the industry attended the hearing and submitted that the entire plant and machinery has been installed in industrial zone.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; tab-stops: 36.0pt;"><span style="font-size: 10.5pt; line-height: 107%; font-family: 'Arial','sans-serif';"> After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided as under:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3; tab-stops: 36.0pt;"><!-- [if !supportLists]--><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif'; mso-fareast-font-family: Arial;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 10.5pt; line-height: 115%; font-family: 'Arial','sans-serif';">The industry shall re-apply for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with certificate from District Town Planner that it has installed its unit in Industrial Zone only, within 15 days.</span></p>
