BMW/Fresh/RPN/2021/17325245 dated 07/12/2021 which is valid upto 31/03/2023 for generation, segregation and storage of bio-medical waste for 45 no. of beds.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-font-width: 115%;">Further, the HCF was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/RPN/2021/16638457 dated 28/10/2021 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/RPN/2021/16628812 dated 28/10/2021, both are valid upto 31/03/2023 for 45 no. beds.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-font-width: 115%;">Now, the HCF has applied for obtaining renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for 45 no. of beds along with the following documents submitted by it:</span></p>

<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-font-width: 115%;">The HCF has deposited Rs. 10,000/- and Rs. 500/- as application form fee vide R No. 317715047 dated 16/01/2023 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 10,000/- vide R No. 17746356 dated 16/01/2023 under the Air (Prevention & Control of Pollution) Act, 1981. As such, the fee deposited by the HCF is adequate upto 31.01.2028 according to Board's order no. EPA/2017/No. 2235-59 dated 07/07/2017.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-font-width: 115%;">Further, the HCF was visited by the AEE of this office on 31.01.2023 and Dr. Gurdev Singh, Proprietor and Dr. Meenakshi, BMW Nodal Officer was contacted. <p class="MsoNormal" style="text-align: justify; text-indent: 2.0cm; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; color: #222222; mso-fareast-language: EN-IN;"> </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-font-width: 115%; mso-ansi-language: EN-US;">Thereafter, the unit was issued show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 along with an opportunity of personal hearing on 28.02.2023 at 11:00 am to show cause as to why the proposed action may not be taken.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 2.0cm; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-font-width: 115%; mso-ansi-language: EN-US;">The representative of the HCE Smt. Minakshi, BMW Nodal Officer attended the hearing and informed that the HCE has got ETP-cum-STP maintained and removed all the observations and now, it is working properly. The plantation has been developed as per Karnal Technology under the guidance of officer of the Board. The representative of hospital has submitted its reply of show cause notice dated 28.02.2023, which has been taken on record.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 2.0cm; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-font-width: 115%; mso-ansi-language: EN-US;">After hearing the representative of the unit and considering facts on the record, the Environmental Engineer decided as under:</span></p>

<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l3 level1 lfo4;"><span style="font-family: 'Bookman Old Style','serif'; mso-font-width: 115%;">The AEE will visit the HCE within 07 days and collect the samples of treated wastewater and verify the contention of the hospital.</span></li>
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l3 level1 lfo4;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-font-width: 115%; mso-ansi-language: EN-US;">The application of the HCE will be processed on merit</span></li>

Minakshi, BMW Nodal Officer was contacted. During visit, it was observed as under:</span></p>

<p class="MsoNormal" style="text-align: justify; text-indent: 70.9pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-font-width: 115%;">As such, it is clear that the HCE is complying with the provisions of the Water Act, 1974.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-font-width: 115%;">In light of the facts mentioned above, it is recommended that show cause notice may be dropped and Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted to the HCF upto 30/09/2027 for 45 no. beds subject to the suitable conditions and following additional conditions:</span></p>
