As per the application and documents submitted, the unit has been commissioned in March, 2023.</span></p>
<p class="MsoNormalCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">The industry had applied for obtaining fresh 'consent to </span><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-IN;">operate'</span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;"> under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981. The application of the industry was scrutinized and returned after approved from the competent authority with following observations:</span></p>
<p class="MsoNormalCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">‘<em>As you are aware that the matter regarding categorization of industry is still under consideration of HQ-2 branch of the Board. Further, the case for categorization of subject cited industry was scheduled and heard today on 10.10.2020 at 12:30 pm, wherein it was decided to return the CTO application lying pending with the Board. The final decision will be conveyed to the industry shortly. Hence, the application is being returned to industry in original.”</em></span></p>
<p class="MsoNormalCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">The policy regarding categorization has been decided by the Board vide letter no. SEE(HQ02)/F-no.10/2022/383 dated 16/11/2022 and as per said circular, the process of the industry is covered under green category at (Sr. 78 code types 3078).</span></p>
<p class="MsoNormalCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">MoEF & CC has issued notification no. S.O. 3250(E) on 20.07.2022, which is reproduced as under:</span></p>
<p class="MsoNormalCxSpMiddle" style="mso-add-space: auto; text-align: justify; line-height: 150%; margin: 0in .25in .0001pt 1.0in;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">"Whereas, the Hon’ble National Green Tribunal vide its order, dated the 12th February, 2020, in Original Application No. 55/2019 (WZ), (Gajubha Jesar Jadeja vs Union of India &Ors.), has inter alia observed that Cold Rolled Stainless Steel Manufacturing Industries require prior environment clearance but, having regard to the fact that there were a large number of such mills operating on the strength of Consent to Establish (CTE) and Consent to Operate (CTO), the Hon’ble Tribunal has held that opportunity should be provided to such units to fall within the Environment Clearance regime by granting a period of at least one year to operate for the purpose.</span></em></p>
<p class="MsoNormalCxSpMiddle" style="mso-add-space: auto; text-align: justify; line-height: 150%; margin: 0in .25in .0001pt 1.0in;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">And whereas, the Central Government, keeping in view the impact caused due to the Covid19 pandemic has taken a considered decision in line with the above said order of the Hon’ble National Green Tribunal, so as to provide a window period for such re-rolling or cold rolling units to obtain prior Environmental Clearance.</span></em></p>
<p class="MsoNormalCxSpMiddle" style="mso-add-space: auto; text-align: justify; line-height: 150%; margin: 0in .25in .0001pt 1.0in;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">And whereas, the Central Government is of the view that steel re-rolling operations fall under the purview of the secondary metallurgical processing industry and require Environment Clearance as per item 3(a), relating to Metallurgical Industries (Ferrous and Non-ferrous), of the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide notification number S.O. 1533 (E), dated the 14th September, 2006, mandating the requirement of prior environmental clearance for the projects covered in its Schedule (hereinafter referred to as the said notification), wherein all non–toxic secondary metallurgical processing units with capacities greater than 5000 tonnes/annum (TPA) fall under category B.</span></em></p>
<p class="MsoNormalCxSpMiddle" style="mso-add-space: auto; text-align: justify; line-height: 150%; margin: 0in .25in .0001pt 1.0in;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">Now, therefore, in exercise of the powers conferred by section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby directs that all the standalone re-rolling units or cold rolling units, which are in existence and in operation as on the date of this notification, with valid Consent to Establish (CTE) and Consent to Operate (CTO) from the concerned State Pollution Control Board or the Union territory Pollution Control Committee, as the case may be, shall apply online for grantof Terms of Reference (ToR) followed by Environment Clearance and the said units shall be granted Standard Terms of Reference as per item 3(a) of the said notification and shall be exempted from the requirement of public consultation:</span></em></p>
<p class="MsoNormalCxSpMiddle" style="mso-add-space: auto; text-align: justify; line-height: 150%; margin: 0in .25in .0001pt 1.0in;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">Provided that the application for the grant of ToR shall be made within a period of one year from the date of this notification.’</span></em></p>
<p class="MsoNormalCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA; mso-bidi-font-style: italic;">Accordingly, the Board vide letter no. 08 dated 02/01/2023 has requested SEIAA Punjab to consider the said unit as existing unit and CTO may be granted upto 19/07/2023 subject to the condition that the industry shall be bound to obtain EC before 19/07/2023.</span></p>
<p class="MsoNormalCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA; mso-bidi-font-style: italic;">In reply, SEIAA Punjab has issued letter addressed to Senior Environmental Engineer Zonal Office – II, Patiala vide no. 125 dated 25/01/2023 (Copy of letter attached). The important facts mentioned in the letter are reproduced as under: </span></p>
<p class="MsoNormalCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA; mso-bidi-font-weight: bold;">‘As such, in light of decision taken by SEIAA in tis 230<sup>th</sup> meeting held on 11/3/2023, it is clarified that the industry may be considered as on existing industry so far as the provisions of notification dated 20/7/2022 are concerned. Further, the grant of consent to operate under the Water Act, 1974 & Air Act, 1981 to the industry upto 19/07/2023 may be considered on merits by PPCB subject to the condition that the industry shall obtain Environmental Clearance under the EIA notification dated 14/09/2006 before 20/7/2023. In case the EC is not granted by this date the case will be reviewed and decided as per then obtaining circumstances and directions of the MOEF & CC. </span></em></p>
<p class="MsoNormalCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA; mso-bidi-font-weight: bold;">It is also, imitated the recently a clarification in respect of another similar case pertaining to M/s Arora Iron & Steel Rolling Mills located at Village Baramlipur and Jaspalon, Doraha Khanna Road, Tehsil Khanna, Distt Ludhiana was requested by the C.E.E. PPCB and the said clarification was issued by the SEIAA along similar lines as in the present case.’</span></em></p>
<p class="MsoNormalCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;"> </span></p>
<p class="MsoNormalCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">In view of above decision by SEIAA Punjab, the industry has again applied for obtaining fresh 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 to manufacture </span><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA; mso-bidi-font-weight: bold;">Seamless Pipes & Tubes @ 80 MTD</span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;"> with requisite documents and consent fees.</span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> </span></p>
<p class="MsoNormalCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry has deposited consent fee of Rs. 57600/- each vide UTR no. N236222089836641 & N236222089831063 dated 24/08/2022 under the Water Act, 1974 and the Air Act, 1981 against the un-depreciated of fixed assets of Rs. 1423.16 Lacs as on 31/12/2022 as per CA Certificate dated 10/02/2023 </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">which is adequate upto 30/09/2026, as per Board’s office order dated 29/10/2018.</span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> The industry has deposited NOC fee of Rs. 14400/- vide UTR No. N319211714898494 dated 15/11/2021 & Rs. 3600/- vide UTR. No. N046232332935434 dated 15/02/2023</span><span style="font-family: 'Tahoma','sans-serif';"> </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">as NOC fee, which is adequate.</span></p>
<p class="MsoNormalCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-IN;">The industry has submitted building plan approved by Er. Bharat Malik, Competent Person recognized by Director of Factories, Punjab.</span></p>
<p class="MsoNormalCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-IN;">The industry has submitted classification of land use issued by DTP, Fatehgarh Sahib vide letter no. 1144 dated 20/08/2021, according to which the site of the unit falls in the Industrial zone, as per the Master Plan of the Mandi Gobindgarh and units such as pipe plant cum iron & steel rolling mills cum induction furnace are permissible in the said zone.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%; margin: 0in -.05in .0001pt 0in;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-IN; mso-bidi-language: AR-SA;">The industry was visited by undersigned </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">on <strong>14/03/2023</strong></span><span lang="EN-IN" style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-IN; mso-bidi-language: AR-SA;"> and contacted Sh. Amit, GM at site. During visit, it was observed as under:</span></p>

The raw material i.e. rounds is being fed into the furnace and after heating the same is channelized to piercing section where the length of the round gets increased and the hollow section is created. After this, the pipe is sent for sizing and cooling.</span></p>

DG set of 140 KVA capacity with adequate stack height.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The Board vide letter no. 1955-57 dated 18/01/2023 has informed that department of Water Resources (RD and GR), Central Ground Water Authority, Ministry of Jal Shakti Govt. of India, New Delhi under Section 5 of the Environment (Protection) Act, 1986 has issued directions vide order dated 6/4/2022 that “It shall be mandatory for the project proponent abstracting ground water to obtain No objection Certificate from Central Ground Water Authority or the concerned State/UT Ground Water Authority as the case may be in the compliance conditions in consent to operate and consent to establish issued by the State pollution control Board”</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in;"><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">“The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries.”</span></em></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';"> The site is suitable for establishment of such type of units as per the policy of the Board dated April 2013.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';"> In view of above mentioned facts, if approved, Senior Environmental Engineer, Zonal Office – II, Patiala may be recommended that fresh 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 for production of </span><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">Seamless Pipes & Tubes @ 80 MTD</span><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">, may be granted to the industry upto <strong>19/07/2023</strong> with suitable conditions and following special conditions:</span></p>
