<p style="text-align: justify;">The agenda note and report / recommendations of AEE/EE, RO, may kindly be perused.</p>
<p style="text-align: justify;">The industry was granted ‘Consent to operate’ under the Water Act, 1974 and Air Act, 1981, valid upto 31.12.2022 each to manufacture INJECTIONS @ 200000 Numbers/Day, DRY SYRUP @ 50000 Numbers/Day, TABLET @ 1000000 Kgs/day, CAPSULE @ 300000 Numbers/Day alongwith trade effluent @ 50 KLD & domestic effluent @ 24 KLD onto land for plantation after treatment through ETP, subject to suitable conditions alongwith following special conditions:</p>
<p style="text-align: justify;">1. The industry shall develop plantation in 1. 6 acres area in total (07 pockets and along boundary wall) within 01 month.</p>
<p style="text-align: justify;">2. The industry shall upgrade its ETP within 02 months.</p>
<p style="text-align: justify;">3. The industry shall install EMF at outlet to ETP, separate energy meter with ETP and shall maintain proper record regarding operation of ETP.</p>
<p style="text-align: justify;">4. The industry shall install water meter at ground water extraction borewell and shall maintain proper record regarding extraction of ground water.</p>
<p style="text-align: justify;">The electricity connection of the industry was also restored temporarily for period upto 31.12.2022 vide Board’s letter no: 4153 dated 22.06.2012.</p>
<p style="text-align: justify;">Thereafter, the industry was visited on 08.12.2022 by officers of the Board effluent samples were collected from outlet to ETP. As per analysis report, concentration of pH (8.9), BOD (35 mg/l), Sulphide (3.2 mg/l) and Bio-Assay (Zero % survival of fish in 100 % effluent after 96 hours) were found beyond the prescribed limits of the Board. Also there was no Hazardous Waste in HW room and general waste was found stored in HW room. EMF provided at outlet to ETP was also not working.</p>
<p style="text-align: justify;">As the industry had failed to apply for renewal of ‘Consent to Operate’ under the Water Act, 1974 & the Air Act, 1981 and time period for temporary restoration was over, this office has taken up the matter with PSPCL Authorities vide letter no: 391 dated 02.02.2023 to disconnect the power supply of the industry.</p>
<p style="text-align: justify;">Meanwhile, the industry had applied for renewal of ‘Consent to Operate’ under the Water Act, 1974 & the Air Act, 1981. The PSPCL authorities had disconnected the power supply of the industry vide TDCO no: 045/322403 dated 22.02.2023. The industry was visited by AEE of Regional Office on 22.02.2023 and it was observed as under:</p>
<p style="text-align: justify;">1. The industry was not in operation as electricity connection of the industry was disconnected.</p>
<p style="text-align: justify;">2. The condition of ETP and plantation was same as observed during visit dated 08.12.2022. The industry had not upgraded its ETP as per special condition of previous consent.</p>
<p style="text-align: justify;">3. Total area available for plantation in the industry was about 1 acre 05 Kanals. The industry had developed plantation in 9 Kanals (including gardens and plantation along boundary wall). The industry has maximum trade effluent @ 50 KLD and domestic effluent @ 24 KLD (as industry is a labour intensive unit). </p>
<p style="text-align: justify;">4. The industry was not maintaining any record regarding generation and disposal of its Hazardous Waste.</p>
<p style="text-align: justify;">5. The industry has installed 02 DG set of capacity 1010 KVA & 82.5 KVA, both equipped with canopy and stack of adequate height.</p>
<p style="text-align: justify;">6. The industry has installed 01 diesel fired boiler of capacity 06 TPH and stack of adequate height has been provided with the boiler.</p>
<p style="text-align: justify;">7. As per record file, the site of the industry falls in Industrial Zone as per Master Plan Ludhiana (2007-21) as reported by the Senior Town Planner, Ludhiana vide memo no: 5710 STP(L)/TW-12A dated 02.11.2010.</p>
<p style="text-align: justify;">Thus, the industry was not complying with the provisions of the Water Act, 1974 & the special conditions of the previous consent. Accordingly Consent applications of the industry were returned online as it has not submitted any compliance/up-gradation/improvement/proposal for improvement and electricity connection was already disconnected by PSPCL Authorities.</p>
<p style="text-align: justify;">Now, the industry has applied for renewal of ‘Consent to Operate’ under the Water Act, 1974 & the Air Act, 1981. The industry has submitted C.A. certificate dated 07.02.2023 and as per this C.A. certificate, value of fixed assets is 96.23 crores. The industry has deposited consent fee, which is adequate for period upto 31.12.2023 under the both Acts.</p>
<p style="text-align: justify;">The industry has now submitted request for restoration of electricity connection and has submitted that they have provided training to the staff to operate ETP effectively and regarding use of proper chemical dosing. The industry has assured to achieve prescribed standards and to provide adequate plantation area.</p>
<p style="text-align: justify;">Keeping the above in view, it is recommended that:</p>
<p style="text-align: justify;">1. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 may be issued to the PSPCL Authorities to temporary restore the electricity connection of the industry for six months.</p>
<p style="text-align: justify;">2. Renewal of ‘Consent to Operate’ under the Water (Prevention & Control of pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for shorter period i.e. upto 30.09.2023 subject to suitable conditions alongwith following special conditions:</p>
<p style="text-align: justify;">a. The industry shall develop plantation in 04 kanals area in addition to existing plantation within 01 month.</p>
<p style="text-align: justify;">b. The industry shall upgrade its ETP within 02 months.</p>
<p style="text-align: justify;">c. The industry shall install EMF at outlet to ETP, separate energy meter with ETP and shall maintain proper record regarding operation of ETP.</p>
<p style="text-align: justify;">d. The industry shall operate its ETP properly and efficiently so as to achieve the effluent standards prescribed by the Board in this period.</p>
