<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">The industry is a small scale red category dyeing unit and was earlier granted 'Consent to Operate' under Water Act, 1974 upto 31.03.2023 with special condition that the industry shall take adequate steps to stop discharging its industrial effluent into municipal sewer, Ludhiana by 31.03.2023. </span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">Now, the industry has applied for renewal ‘Consent to Operate’ under the Water Act, 1974 for the same production. </span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">The industry was visited by officer of the Board on 03/10/2022 & observed as under:</span></p>

During the visit only non-polluting machinery was operational.</span></p>

The industry has installed HTHP machines for dyeing of varying capacities. These are multipurpose machines and all type of dyeing work.</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="text-align: justify; text-indent: -21.0pt; mso-list: l1 level1 lfo1; background: white; margin: 0in 0in 0in 22.5pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; mso-fareast-font-family: Arial; color: black;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">The industry has failed to comply with the special conditions regarding adoption of ZLD based ETP or purchasing of PDA shares.</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">It is pertinent to mention here that the industry as well as the President, Punjab Dyers Association (Focal Point 40 MLD Module) was issued show cause notice for violation of the provisions of Water Act, 1974 with hearing before Chairman of the Board on 02.11.2022. Sh. Atul Gupta, Partner of the industry submitted during the hearing that they are willing to purchase the shares for the discharge of effluent from their industry into the CETP. Sh. Vijay Sharma, Manager of PDA informed that presently they have no spare shares which can be allotted to the industry. But some industries are defaulter w.r.t the payment of allotted shares and they are likely to surrender their shares. The Chairman of the Board expressed his unhappiness that neither the President nor any responsible director of the SPV attended the hearing. After hearing the representative of the industry, officers of the Board and considering background of the case and material facts on the record, the Chairman of the Board decided as under:- </span></p>

<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="text-align: justify; text-indent: -21.0pt; mso-list: l0 level1 lfo2; background: white; margin: 0in 0in 0in .25in;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; mso-fareast-font-family: Arial; color: black;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">The industry and the President alongwith all the directors of Punjab Dyers Association (Focal Point 40 MLD module) shall attend the hearing to be given shortly. </span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="text-align: justify; background: white; margin: 0in 0in 0in -3.0pt;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">Thereafter, the industry as well as the President, Punjab Dyers Association (Focal Point 40 MLD Module) was issued show cause notice for violation of the provisions of Water Act, 1974 with hearing before Chairman of the Board on 06.12.2022. No one from PDA attended hearing on said date. Sh. Jasbir Singh (Dyeing Master) of the industry attended the hearing and requested to facilitate them for the allotment of shares required for them for the disposal of their effluent in the CETP. It was further informed that M/s Centex International Pvt. Ltd., Sua Road, Village Gobindgarh, Adj. Focal Point, Phase-VII, Ludhiana has spare shares which can be transferred to their industry. After hearing the representative of the industry, officers of the Board and considering background of the case and material facts on the record, the Chairman of the Board decided that M/s Centex International Pvt. Ltd., Sua Road, Village Gobindgarh, Adj. Focal Point, Phase-VII, Ludhiana be asked to appear before the Member Secretary of the board to discuss the issue for the allotment of shares to M/s K.K.K Mills. The proceedings of above hearing were conveyed to both the industries. But, M/s Centex International Pvt. Ltd. Has not appeared before the Member Secretary of the board to discuss the issue for the allotment of shares to M/s K.K.K Mills.</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="text-align: justify; background: white; margin: 0in 0in 0in -3.0pt;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">In view of above, it is recommended that application of the industry for obtaining consent to operate under Water Act, 1974 may be refused. </span></p>
