File Note: <p>It is submitted that the industry was granted consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 vide no. CTOW/Fresh/BAR/2022/19024760 dated 13/07/2022 valid upto 31/12/2022 and Air (Prevention &amp; Control of Pollution) Act, 1981 vide no. CTOA/Fresh/BAR/2022/18477428 dated 13/07/2022 valid upto 31/12/2022 with certain conditions mentioned therein.</p> <p>A complaint made by residents of village Kaire &amp; Naiwala was received in the Board through the office of Deputy Commissioner, Barnala on 18/06/2020, regarding nuisance being caused by the poultry farm i.e. problem of flies &amp; mosquitoes etc. in its vicinity.</p> <p>To check the contents of the complaints, the site under complaint was visited by officer of the Board on 19/11/2020 it was observed as under:-</p> <p>1.<span style="white-space: pre;"> </span>The poultry farm was in operation Sh. Raman Garg, owner was present at the time of visit and he informed that around 50,000 birds has been kept in two sheds.&nbsp;</p> <p>2.<span style="white-space: pre;"> </span>The poultry farm had not adopted proper mechanism for cleaning of birds droppings from poultry sheds and has stored the bird droppings for a period of six months underneath the poultry sheds.&nbsp;</p> <p>3.<span style="white-space: pre;"> </span>The poultry farm had also installed poultry feed mill in its premises.&nbsp;</p> <p>4.<span style="white-space: pre;"> </span>The foul smell was sensed in the premises of the poultry farm and the flies were also observed. No regular cleaning of litters / waste is being carried out by the poultry farm.&nbsp;</p> <p>5.<span style="white-space: pre;"> </span>The poultry farm is not disposing of. dead birds as per environmental guidelines issued by CPCB.&nbsp;</p> <p>6.<span style="white-space: pre;"> </span>The poultry farm had failed to produce documents regarding year of establishment of the poultry farm.&nbsp;</p> <p>7.<span style="white-space: pre;"> </span>The poultry farm had not obtained consent to operate of the Board as required under the provisions of the Water Act, 1974 arid the Air Art, 1981 from the Board.</p> <p>Accordingly, the poultry farm was issued show cause notice for violations under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 vide letter no. 57 dated 07/01/2021 with an opportunity of personal hearing before Senior Environmental Engineer on 18/01/2021, due to aforesaid violations.</p> <p>Sh. Raman Garg, H/o Smt. Sonia Garg, Proprietor of the poultry farm attended the hearing and submitted the written reply, which was taken on record: He further stated that the complaint made by Krantikari Kissan Union, Punjab has been withdrawn vide their letter dated 05/08/2020 addressed to the Deputy Commissioner, Barnala. He also stated that they have established and commissioned the poultry farm in the year 2014 after obtaining NOC from the Sarpanch Gram Panchayat, Naiwalala NOC from Fire Station, Barnala; NOC from the DTP, Sangrur and NOC from Sub Division Magistrate, Barnala. After the visit of the officers of the Board they have adopted proper mechanism for cleaning of bird dropping, regular spray is being done to avoid any nuisance / odour and flies etc. and started disposing of dead birds as per environmental guidelines issued by the Board. He requested that they may be exempted from obtaining consents of the Board under Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 as the capacity of the poultry farm is less than one lakh birds. Also, the action be taken against the other poultry farms running in District Sangrur &amp; Barnala operating without NOC / consents of the Board and most of them are having capacity more than one lakh birds.</p> <p>After hearing the officer of the Board and representative of the poultry farm Senior Environmental Engineer, Zonal Office-II, Patiala decided that:</p> <p>1.<span style="white-space: pre;"> </span>The poultry farm shall attend all the observations made during visit dated 19/11/2020 by the officers of the Board and shall comply with the environmental guidelines issued by the Central Pollution Control Board / Punjab Pollution Control Board for poultry farm in true letter &amp; spirit.&nbsp;</p> <p>2.<span style="white-space: pre;"> </span>The poultry farm shall apply for consent to operate of the Board under the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 alongwith requisite documents and fee, within 15 days.&nbsp;</p> <p>3.<span style="white-space: pre;"> </span>Environmental Engineer, Regional Office, Sangrur shall visit the poultry farm after 15 days to verify the compliance of the hearing decisions as above and submit the report with conclusive recommendations.</p> <p>The proceedings of the hearing were conveyed to the poultry farm as well as Regional Office, Sangrur vide letter no. 260-61 dated 27/01/2021 for information and compliance.</p> <p>To check the compliance status of the above hearing decisions, the poultry farm was again visited by the officer of the Board on 27/05/2021 and it was observed as under:-</p> <p>1.<span style="white-space: pre;"> </span>The poultry farm was in operation and no responsible person was available at site.&nbsp;</p> <p>2.<span style="white-space: pre;"> </span>The person available at site informed that presently there are 50,000 birds and same were kept in two no. sheds.&nbsp;</p> <p>3.<span style="white-space: pre;"> </span>The poultry farm has not yet provided any mechanism for removal of birds droppings and same are found being collected underneath the poultry shed. From the physical conditions of the farm, it seems that the bird droppings have not been lifted for last 3-4 months approximately.&nbsp;</p> <p>4.<span style="white-space: pre;"> </span>The foul smell was sensed in the premises of the poultry farm and the flies were also observed. No regular cleaning of litters / waste is being carried out by the poultry farm.&nbsp;</p> <p>5.<span style="white-space: pre;"> </span>The poultry farm has provided one no. well for disposal of dead birds and same was covered from top.&nbsp;</p> <p>6.<span style="white-space: pre;"> </span>The poultry farm has not yet not applied for obtaining consent to operate of the Board as required under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981.</p> <p>Thus, the poultry farm had failed to comply with the decisions of personal hearing given to it with in stipulated period. Also, the poultry farm was not found complying with the Environmental guidelines issued by the Board for poultry farm units and found violating the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 &amp; Air (Prevention &amp; Control of Pollution) Act, 1981 and causing pollution in the vicinity intentionally &amp; deliberately.</p> <p>Accordingly, the poultry farm was afforded an opportunity u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention &amp; Control of Pollution) Act, 1981 to explain his position in writing before the Chief Environmental Engineer (B) of the Board vide letter no. 2361 dated 11/06/2021 within 15 days from the date of issuance of this notice. But, no reply was submitted by the poultry farm in this regard. However, a copy of reply dated nil addressed to Sr. Environmental Engineer, ZO-2, Patiala was shown to the AEE, Regional Office, Sangrur by the representative of the poultry farm during visit.</p> <p>Thereafter, the poultry farm was visited by the officer of the Board on 25/10/2021 to verify the compliance of environmental guidelines made by the poultry farm and contentions of the poultry farm given by it in its reply. During visit, Sh. Raman, Partner of the poultry farm was contacted and observed as under:-</p> <p>1.<span style="white-space: pre;"> </span>The poultry farm was in operation and having a capacity of the poultry farm is about 50,000 birds as informed by the representative of the poultry farm.&nbsp;</p> <p>2.<span style="white-space: pre;"> </span>The poultry farm has constructed 2 no. single storey poultry sheds and 1 no. chicks shed.&nbsp;</p> <p>3.<span style="white-space: pre;"> </span>The poultry farm has neither installed mechanical scrapper/ belt conveyer for removal of bird droppings from the poultry sheds nor started any work in this regard.&nbsp;</p> <p>4.<span style="white-space: pre;"> </span>The representative of the poultry farm informed that the bird droppings are removed from the poultry sheds manually and sold out to the farmers. During visit, bird droppings were found accumulated under the poultry sheds. The poultry farm is not maintaining any record with regard to generation of bird droppings and its disposal.&nbsp;</p> <p>5.<span style="white-space: pre;"> </span>The poultry farm has not provided septic tank for the treatment of domestic effluent being generated from the poultry farm. The domestic effluent is being discharged into soakage pit.&nbsp;</p> <p>6.<span style="white-space: pre;"> </span>The poultry farm has also installed poultry feed mill in its premises. The poultry farm has not installed any APCD and stack to collect end discharge of fugitive emissions generated from feed mill.&nbsp;</p> <p>7.<span style="white-space: pre;"> </span>The poultry farm has not provided canopy with its DG set of capacity 62.5 KVA.&nbsp;</p> <p>8.<span style="white-space: pre;"> </span>During visit to the poultry farm, foul odour was sensed In the premises of the poultry farm caused from its operations and flies were also seen in the premises of the poultry farm.&nbsp;</p> <p>9.<span style="white-space: pre;"> </span>The poultry farm has constructed one pit for the burlal of dead birds, but no stack has been provided with it.</p> <p>The poultry farm was not found complying with the environmental guidelines issued by the Central Pollution Control Board and Punjab Pollution Control Board and is being operated without obtaining Consent to operate of the Board under the Water Act, 1974 and the Air Act, 1981. Thus, violating the provisions of the said Acts and causing water &amp; air pollution intentionally &amp; deliberately.&nbsp;</p> <p>Accordingly, report was sent to ZO vide R. letter no. 6546 dated 11/11/2021. The matter was considered by the Competent Authority and it was decided to issue notice to issue directions u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention &amp; Control of Pollution) Act, 1981 proposing for closure of the poultry farm after affording an opportunity of personal hearing, due to aforesaid violations.</p> <p>Accordingly, notice to issue directions u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention &amp; Control of Pollution) Act, 1981 was issued to the poultry farm vide Board&rsquo;s letter no. 119 dated 10.01.2022 for closure of the poultry farm after affording an opportunity of personal hearing before the Chief Environmental Engineer (B) on 20/01/2022.</p> <p>After hearing the officers of the Board and representative of the poultry farm, Chief Environmental Engineer (B) Patiala decided that:-</p> <p>1.<span style="white-space: pre;"> </span>The poultry farm shall attend all the observations made during visit dated 25/10/2021 by the officer of the Board and shall comply with the environmental guidelines issued by the Central Pollution Control Board/Punjab Pollution Control Board for poultry farms in true letter &amp; spirit issued from time to time.&nbsp;</p> <p>2.<span style="white-space: pre;"> </span>The poultry farm shall apply for consent to operate of the Board under the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 alongwith requisite documents and fee, within 3 days.&nbsp;</p> <p>3.<span style="white-space: pre;"> </span>Environmental Engineer, Regional Office, Sangrur shall visit the poultry farm in the first week of Feb. 2022 to verify the compliance of the hearing decisions as above and process the consent cases of the poultry farm on merits.</p> <p>Further, it is pertinent to mention here that a complaint was received in the office of Deputy Commissioner, Barnala against the subject cited poultry farm on 25/3/2022, made by residents of nearby area. The said complaint was forwarded by the Deputy Commissioner, Barnala to GMDIC for joint visit alongwith the AEE of this office.&nbsp;</p> <p>Accordingly, to verify the content of the complaint, the site was jointly visited by the GMDIC and the AEE on 28/03/2022 and it was observed as under:-</p> <p>1.<span style="white-space: pre;"> </span>The poultry farm was in operation.&nbsp;</p> <p>2.<span style="white-space: pre;"> </span>The poultry farm has neither installed mechanical scrapper/belt conveyer for removal of bird droppings from the poultry sheds nor started any work in this regard.&nbsp;</p> <p>3.<span style="white-space: pre;"> </span>From the physical conditions of the poultry farm, it was observed that the poultry farm has removed the accumulated bird droppings from the beneath of poultry sheds. The representative informed that they have removed the bird droppings just one month ago.&nbsp;</p> <p>4.<span style="white-space: pre;"> </span>The bird dropping after removing from the poultry sheds are stored in land adjacent to the poultry farm.&nbsp;</p> <p>5.<span style="white-space: pre;"> </span>During visit to the poultry farm, foul odour was sensed and flies were seen inside and outside the premises of the poultry farm caused from its operations. Further, flies were also seen in the nearby houses, school and religious places.&nbsp;</p> <p>6.<span style="white-space: pre;"> </span>The poultry farm has not maintained the records w.r.t. removal and disposal of bird droppings.&nbsp;</p> <p>7.<span style="white-space: pre;"> </span>The poultry farm has also installed poultry feed mill in its premises. The poultry farm has provided cyclone as APCD with it to control fugitive emissions generated from feed mill.&nbsp;</p> <p>8.<span style="white-space: pre;"> </span>The poultry farm has not provided canopy with its DG set of capacity 25.0 KVA. The earlier DG set of capacity 62.5 KVA was found shifted from the premises.&nbsp;</p> <p>9.<span style="white-space: pre;"> </span>The poultry farm has provided septic tank for the treatment of domestic effluent being generated from the premises. The treated domestic effluent is being discharged onto land for plantation purpose.&nbsp;</p> <p>10.<span style="white-space: pre;"> </span>The representative of the poultry farm informed that the poultry farm was established in year, 2014, but failed to show the documentary proof.&nbsp;</p> <p>11.<span style="white-space: pre;"> </span>Panchayat members of village Naiwala and other nearby villages have provided dharna outside of the poultry farm and the main entrance gate has been closed by the said people.&nbsp;</p> <p>12.<span style="white-space: pre;"> </span>The poultry farm has constructed one pit for the burial of dead birds, but no stack has been provided with it.</p> <p>Accordingly, report was sent to competent authority for taking necessary action in the matter. Meanwhile orders were passed by SDM Barnala vide no. 01-04/ਅਹਸ dated 01.04.2022 in a complaint matter received against the above said poultry farm which is reproduced as under:-</p> <p>ਲਿਹਾਜਾ ਉਪਰੋਕਤ ਹਾਲਾਤਾਂ ਦੇ ਮੱਦੇ ਨਜਰ ਮੈਂ ਵਰਜੀਤ ਵਾਲੀਆ, ਆਈ.ਏ.ਐਸ ਉਪ ਮੰਡਲ ਮੈਜਿਸਟਰੇਟ ਬਰਨਾਲਾ ਆਪ ਨੂੰ (ਮੈਸ: ਗਰਗ ਪੋਲਟਰੀ ਫਾਰਮ, ਕੈਰੋ ਰੋਡ, ਪਿੰਡ ਨਾਈਵਾਲਾ) ਨੂੰ ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ conditional order ਜੇਰ ਧਾਰਾ 133 CrPC ਤਹਿਤ ਜਾਰੀ ਕਰਦਾ ਹਾਂ:-&nbsp; &nbsp;</p> <p>1.<span style="white-space: pre;"> </span>ਪੋਲਟਰੀ ਫਾਰਮ ਦੇ ਕਾਰੋਬਾਰ ਨੂੰ ਤੁਰੰਤ ਬੰਦ ਕੀਤਾ ਜਾਵੇ।&nbsp;</p> <p>2.<span style="white-space: pre;"> </span>ਪੋਲਟਰੀ ਫਾਰਮ ਨੂੰ ਖਾਲੀ ਕਰਨ ਦੀ ਪ੍ਰਕਿਰਿਆ ਨੂੰ ਤੁਰੰਤ ਅਮਲ ਵਿੱਚ ਲਿਆਂਦਾ ਜਾਵੇਂ।</p> <p>3.<span style="white-space: pre;"> </span>ਪੋਲਟਰੀ ਫਾਰਮ ਵਿੱਚ ਮੌਜੂਦ ਸਾਰੀ ਪੋਲਟਰੀ ਨੂੰ ਦੋ ਮਹੀਨਿਆਂ ਦੇ ਅੰਦਰ-ਅੰਦਰ ਖਾਲੀ ਕੀਤਾ ਜਾਵੇ। ਪੋਲਟਰੀ ਫਾਰਮ ਖਾਲੀ ਕਰਨ ਦੌਰਾਨ ਇਹ ਯਕੀਨੀ ਬਣਾਇਆ ਜਾਵ ਕਿ ਇਸ ਪ੍ਰਕਿਰਿਆ ਨਾਲ ਸਬੰਧਤ ਸਾਰੇ ਨਿਯਮ, ਕਾਨੂੰਨ, ਅਦਾਲਤੀ ਹੁਕਮ ਅਤੇ ਪਸ਼ੂ ਅਧਿਕਾਰਾਂ ਦੀ ਪੂਰਨ ਪਾਲਣਾ ਕੀਤੀ ਜਾਵੇ।</p> <p>4.<span style="white-space: pre;"> </span>ਇਹ Conditional order ਪੰਜਾਬ ਪ੍ਰਦੂਸ਼ਣ ਰੋਕਥਾਮ ਬੋਰਡ ਦੇ final order ਉਪਰੰਤ revise ਕੀਤਾ ਜਾਵੇਗਾ। ਇਸ ਕਰਕੇ ਇਹ ਹਦਾਇਤ ਕੀਤੀ ਜਾਂਦੀ ਹੈ ਕਿ ਪੰਜਾਬ ਪ੍ਰਦੂਸ਼ਣ ਰੋਕਥਾਮ ਬੋਰਡ ਅਤੇ ਹੋਰ ਸਮਰੱਥ ਅਧਿਕਾਰੀਆਂ ਕੋਲ ਤੁਰੰਤ ਚਾਰਾਜੋਈ ਕੀਤੀ ਜਾਵੇ।</p> <p>ਜੇਕਰ ਆਪ ਨੂੰ ਇਸ ਤਰ੍ਹਾਂ ਕਰਨ ਤੋਂ ਇਤਰਾਜ ਹੈ ਤਾਂ ਆਪ ਖੁੱਦ ਨਿਮਨ-ਸਹੀਕਾਰ ਦੀ ਅਦਾਲਤ ਵਿੱਚ ਮਿਤੀ 04/04/2022 ਨੂੰ ਬਾਅਦ ਦੁਪਿਹਰ 03:00 ਵਜੇ ਪੇਸ਼ ਹੋਵੇ ਅਤੇ ਇਸ ਤੋਂ ਪਿੱਛੋਂ ਉਪਬੰਧਤ ਤਰੀਕੇ ਨਾਲ ਕਰਨ ਦੱਸੋ ਕਿ ਇਸ ਹੁਕਮ ਨੂੰ ਕਤੱਈ ਕਿਉਂ ਨਾ ਬਣਾਇਆ ਜਾਵੇ।</p> <p>ਉਕਤ ਤੋਂ ਇਲਾਵਾ ਇਸ ਕੇਸ ਵਿੱਚ ਗਰਗ ਪੋਲਟਰੀ ਫਾਰਮ ਪਿੰਡ ਕੈਰੇ ਰੋਡ, ਨਾਈਵਾਲਾ ਵੱਲੋਂ ਪੈਦਾ ਕੀਤੇ ਜਾ ਰਹੇ ਪਬਲਿਕ ਨਿਊਸੈਂਸ ਨੂੰ ਹਟਾਉਣ ਲਈ ਅਤੇ ਨਿਮਨ-ਸਹੀਕਾਰ ਵੱਲੋਂ ਜਾਰੀ ਉਕਤ ਕੰਡੀਸ਼ਨਲ ਹੁਕਮ ਨੂੰ ਲਾਗੂ ਕਰਵਾਉਣ ਹਿੱਤ ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ ਕਮੇਟੀ ਦਾ ਗਠਨ ਕੀਤਾ ਜਾਂਦਾ ਹੈ।</p> <p>1.<span style="white-space: pre;"> </span>ਤਹਿਸੀਲਦਾਰ, ਬਰਨਾਲਾ।</p> <p>2.<span style="white-space: pre;"> </span>ਐਸ.ਡੀ.ਓ, ਪੰਜਾਬ ਪ੍ਰਦੂਸ਼ਣ ਰੋਕਥਾਮ ਬੋਰਡ, ਖੇਤਰੀ ਦਫ਼ਤਰ, ਇੰਡਸਟਰੀਅਲ ਫੋਕਲ ਪੁਆਇੰਟ, ਸੰਗਰੂਰ।</p> <p>3.<span style="white-space: pre;"> </span>ਮੁੱਖ ਅਫ਼ਸਰ, ਥਾਣਾ, ਬਰਨਾਲਾ।</p> <p>ਇਹ ਕਮੇਟੀ ਉਕਤ ਹੁਕਮਾਂ ਦੀ ਇੰਨ-ਬਿੰਨ ਪਾਲਣਾ ਕਰਕੇ ਅਤੇ ਕੰਡੀਸ਼ਨਲ ਆਰਡਰ ਦੀ ਪਾਲਣਾ ਕਰਵਾਉਣ ਉਪਰੰਤ ਨਿਮਨ-ਸਹੀਕਾਰ ਦੇ ਰੂ-ਬ-ਰੂ ਰਿਪੋਰਟ ਪੇਸ਼ ਕਰਨ ਦੀ ਪਾਬੰਦ ਹੋਵੇਗੀ।</p> <p>Accordingly, a report was sent to ZO vide e-note dated 25/04/2022</p> <p>Now, the poultry farm has applied for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981 poultry farm of 50,000 layer birds capacity along with poultry feed mill of 5 T/day capacity in its premises located at Village Bhadalbad (Amla Singh Wala), Tehsil &amp; District Barnala.</p> <p>&nbsp;The poultry farm has deposited consents fee of Rs. 42000/- vide UTR no. 206602036 dated 06/10/2021 &amp; Rs. 55200/- vide UTR no. 972547584 dated 14/04/2022 under the Water Act, 1974 &amp; Rs. 42000/- vide UTR no. 536946015 dated 06/10/2021 &amp; Rs. 55200/- vide UTR no. 932155145 dated 14/04/2022 under the Air Act, 1981, against the value of gross fixed assets of Rs. 278.24 lacs as on 13/04/2022, which is adequate upto 30/09/2024 under the both acts (after deduction of penalty fee). The poultry farm already submitted the report from SDM, Barnala issued vide letter no. 726 Revenue dated 14/03/2018 for siting parameters from the site of the poultry farm and same is reproduced as under:-</p> <p>Sr no. <span style="white-space: pre;"> </span>Criteria For New Poultry Farm as per notification CPCB letter no. However, during visit it was seen that no major drinking water reservoir or catchment side was found in the radius of 500 m from the poultry farm. The distance of remaining siting parameters had been mentioned in the said report.</p> <p>Further, it is intimated that the CPCB has framed Environmental Guidelines for layered poultry farms in 01/10/2022 and same has been adopted by the Board vide office memo no. 196 dated 20/06/2022.</p> <p>It is pertinent to mention here that the poultry farm has established in the year 2014 and at that time there were no specific siting guidelines for the establishment of poultry farms. Therefore,&nbsp; general siting criteria is applicable for the establishment of industry /poultry prevailing during year 2014 and same is as under:</p> <p>"All Red/Orange/Green category of industries, which are to be established in the areas / Zone other than designated/approved areas such as Industrial Area/Industrial Estate/Industrial Focal Point/Approved Industrial Park/Industrial Zone of the statutory/non-statutory Master Plans, will be allowed to set up at a distance of 100m outside the Municipal Council limits/ phirni of village/ designated residential area /residential area comprising of 15 pucca houses by the Competent Authority of the State. In such cases, certificate of its location/situation from the nearest village lal lakir/ phirni/ MC limits from the Revenue Authorities such as Deputy Commissioner/ Additional Deputy Commissioner or the Sub-Divisional Magistrate will be required for grant of consent to establish (NOC)/ authorization by the Board.</p> <p>The Poultry farm has submitted copy of receipt dated 05/05/2014 issued by the Assistant Executive Engineer, PSPCL, Barnala vide which the poultry farm has deposited the requisite charges to PSPCL for release of electric connection. A copy same is attached online alongwith application for kind perusal please&nbsp; in which it has been mentioned that electricity connection available with the poultry farm has been installed in the year, 2014.</p> <p>The poultry farm has submitted letter in which it has stated that the bird dropping are disposed off to the nearby local farmers to be used as manure in their fields twice in a year and has also submitted the record of the last disposal.</p> <p>Further, it is intimated that the CPCB has framed Environmental Guidelines for layered poultry farms 10/01/2022. As per the said guidelines, the poultry farms are classified as under:</p> <p>1.&nbsp; &nbsp; &nbsp; &nbsp;Small (5,000-25,000 bird)</p> <p>2.&nbsp; &nbsp; &nbsp; &nbsp;Medium (above 25,000-1,00,000 birds).</p> <p>3.&nbsp; &nbsp; &nbsp; &nbsp;Large (above 1,00,000 birds)</p> <p>In the current guidelines issued by CPCB, installation of mechanical scrapper/belt conveyer for the removal of bird droppings from the poultry shed has not been made mandatory. However, it has been proposed that bird droppings are removed once in four to six months &amp; sold to the farmers. Birds dropping will not stop here, we will regularly pick up waste by local farmers and biotect plants. We have granted consent from 13/7/2022 to 31/12/2022 ,office dispatch no 2028 and Endst no 2029 by Chief Engineer Punjab Pollution Control Board Patiala It is requested kindly renew our consent to operate by imposing same conditions.&nbsp;</p> <p>The poultry farm was visited by the undersigned on 21.03.2023. During visit, it was observed as under:</p> <p>1.<span style="white-space: pre;"> </span>The poultry farm was not in operation and birds has already been removed from the poultry farm.</p> <p>2.<span style="white-space: pre;"> </span>The poultry farm has already evacuated from its poultry sheds.&nbsp;</p> <p>3.<span style="white-space: pre;"> </span>The poultry farm has provided 2 no. compost pits for disposal of bird droppings, broken eggs and dead birds inside the poultry farm.&nbsp;</p> <p>4.<span style="white-space: pre;"> </span>The representative has informed that the bird droppings were sold to Biotech Plants, Sirsa, Haryana as bio CNG plant. In future, the bird droppings will be sold to biogas plant in compliance to the environment guidelines.&nbsp;</p> <p>5.<span style="white-space: pre;"> </span>The poultry farm has maintained the records w.r.t. removal and disposal of bird droppings.&nbsp;</p> <p>6.<span style="white-space: pre;"> </span>The poultry farm has also installed poultry feed mill in its premises. The poultry farm has provided cyclone as APCD with it to control fugitive emissions generated from feed mill.&nbsp;</p> <p>7.<span style="white-space: pre;"> </span>The poultry farm has not provided DG set in its premises.&nbsp;</p> <p>8.<span style="white-space: pre;"> </span>The poultry farm has provided septic tank for the treatment of domestic effluent being generated from the premises. The treated domestic effluent is being discharged onto land for plantation purpose.&nbsp;</p> <p>9.<span style="white-space: pre;"> </span>The poultry farm has constructed one pit for the burial of dead birds, and stack has been provided with it.&nbsp;</p> <p>10.<span style="white-space: pre;"> </span>During visit it was seen that there was no Municipal Council limits/ phirni of village/ designated residential area /residential area comprising of 15 pucca houses falls in the radius of 100 mtr of the poultry farm.</p> <p>The industry is complying with provisions of Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981.</p> <p>In view of the above, it is recommended that the consent to operate granted to the industry under the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 may be extended upto 31.12.2023&nbsp; with usual conditions as per the policy of the Board and with a following additional conditions that:&nbsp;</p> <p>1.<span style="white-space: pre;"> </span>The poultry farm shall not increase its bird capacity without obtaining prior NOC/ varied consent to operate from the Board as well as without providing adequate pollution control measures.</p> <p>2.&nbsp; &nbsp; <span style="white-space: pre;"> </span>The industry shall strictly comply with the latest environmental guidelines for poultry farm issued by CPCB.&nbsp;</p> <p>3.&nbsp; &nbsp; <span style="white-space: pre;"> </span>The industry shall ensure that there is no public nuisance polluted in the area due to activities within its premises.</p> <p>4.&nbsp; &nbsp; <span style="white-space: pre;"> </span>The industry shall comply with the guidelines of the Punjab Water Regulation and Development Authority (PWRDA).</p> <p>&nbsp;</p>
