<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">It is submitted that the industry was earlier granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/LDH4/2022/18135914 dated 09/06/2022, upto 08/06/2023 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/LDH4/2018/7247858 dated 05/06/2018, upto 31/03/2022 for production of finishing of fabric @ 6 TPD and <span style="mso-spacerun: yes;"> </span>Dyeing OF PC/Cotton @ 5.3 TPD and for using of pet coke/ rice husk as fuel in its boiler of capacity 8.8 TPH attached with twin cyclone followed by double stage alkali scrubber along with adequate stack height and 03 DG set of capacities one of 400 KVA, one of 320 KVA, one of 220 KVA with acoustic enclosure alongwith adequate stack height with certain conditions and special conditions that the industry will submit the revised analysis report of air emissions, within one month.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">The industry is repeatedly applying for renewal of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS on 30.01.2023 and same returned due to the following reasons: It is submitted that as per the C.A. certificate the value of plant & machinery is Rs. 753.56 Lacs as on 31.10.2022, as such, the industry is covered in under the medium scale. However, has submitted application as small scale unit.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">Apparently, the industry has now re-applied for renewal of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS on 18.03.2022 under small scale category with request to consider notification of the MSME issued vide no. 1895 dated 26.06.2020 (Attached in the document), wherein, the categorization as per the investment is revised and the unit falls under small scale category. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">The industry has deposited consent fee Rs. 1,80,000/- vide R.No. N118221934244630 dated 28.04.2022, Rs. 3,600/- vide R.No. N118221934267265 dated 28.04.2022 under Air Act, 1981, which is adequate upto 31.03.2027 against the gross value of fixed assets Rs. 1258.84 Lacs and plant & machinery Rs. 753.56 Lacs as on 21.11.2022.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">Accordingly, the industry was recently visited by AEE of this office on 12.12.2022 and it was observed as under:- </span></p>

<p class="MsoHeader" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; tab-stops: .5in;"><span style="font-size: 12.0pt; font-family: 'Verdana','sans-serif'; mso-bidi-font-family: Tahoma;">It is added here that, the stack emission sample were collected by the Board on 23.06.2022 and as per the analysis report received from Zonal Lab., Ludhiana vide letter endst no. 683 dated 29.06.20022, concentration of SPM is found to be 272 mg/Nm3 against the prescribed limit 500 mg/Nm3.</span><span style="font-family: 'Tahoma','sans-serif';"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">If approved, the consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be decided in light of the notification of the MSME issued vide no. 1895 dated 26.06.2020.</span></p>
