File Note: <p style="text-align: justify;">The agenda note and report / recommendations of AEE/EE, RO, may kindly be perused.</p> <p style="text-align: justify;">Earlier a complaint was received regarding burning of textile residue / waste by the industry. To verify the same, the industry was visited by the officer of RO on 16.08.2018 and observed that no burning of textile waste/ residue was going on at site. However the residue of the past burning of textile waste / residue was observed at site. During visit, effluent samples of the industry were collected from the final outlet of ETP. As per the analysis report, various parameters were found beyond the prescribed limits of the Board.</p> <p style="text-align: justify;">Accordingly, directions u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act 1974 and u/s 31-A of the Air (Prevention &amp; Control of Pollution) Act, 1981 were issued to the industry for its closure. The electric connection of the industry was restored for six months i.e. 14.09.2019 and further extended upto 11.05.2022.</p> <p style="text-align: justify;">&nbsp;&nbsp;&nbsp;The industry was granted consent to operate under Water Act, 1974 &amp; Air Act, 1981, both valid upto 11.05.2022 for washing of&nbsp;cloth @ 500 Kgs/day&nbsp;with discharge of trade effluent @ 100 KLD into sewer after ETP &amp; domestic effluent @ 0.5 KLD into sewer along with one boiler of capacity @ 02 TPH along with cyclone as APCD &amp; one DG set of capacity 62 KVA with conditions mentioned therein.</p> <p style="text-align: justify;">The directions u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 &amp; u/s 31-A of the Air (Prevention &amp; Control of Pollution) Act, 1981 also issued to PSPCL authorities to restore electric connection of the industry temporarily for six months i.e. 11.05.2022.</p> <p style="text-align: justify;">Thereafter, the industry had applied for consent to operate under Water Act, 1974 &amp; Air Act, 1981 for washing of cloth @ 500 Kgs/day with discharge of trade effluent @ 100 KLD &amp; domestic effluent @ 0.5 KLD into conveyance system of CETP 50 MLD alongwith. The said applications of the industry were returned as per the directions of the Competent Authority due to the reason that production figures had not consummate with the discharge of effluent.</p> <p style="text-align: justify;">Now the industry has applied for&nbsp;consent to operate under Water Act, 1974 &amp; Air Act, 1981 for washing of cloth @ 4.8 MTPD with discharge of trade effluent @ 100 KLD &amp; domestic effluent @ 0.5 KLD into conveyance system of CETP 50 MLD. The industry has deposited consent fee, which is adequate upto 30.06.2024 under both acts.</p> <p style="text-align: justify;">The industry was already visited by officers of RO on 31.01.2023 and it was observed that:-</p> <p style="text-align: justify;">1)&nbsp;&nbsp;&nbsp;The industry was in operation, during visit.</p> <p style="text-align: justify;">2)&nbsp;&nbsp;&nbsp;The industry has installed 02 soft flow machines of 300 Kg each having total 04 chambers &amp; 01 winch machine of 150 Kgs in its premises. However, in GNE report it had mentioned that unit has 10 chambers of soft flow &amp; one winch machine. The representative in this regard clarified that during GNE visit industry had also give the detail of proposed 6 chambers of soft flow to be installed by the industry. Hence, at present unit has only 04 chambers of soft flow and one winch machines. The winch machine is already sealed by the Board, hence effluent generation from the unit as per GNE calculations will be 4 X 20 KLD = 80 KLD. The industry has granted 200 KLD shares on 22.07.2022 of CETP, hence the discharge of the industry is within the share allotted to it.</p> <p style="text-align: justify;">3)&nbsp;&nbsp;&nbsp;The industry has submitted the detail of nos of lots, nos of bath, liquor ratio, production and corresponding effluent generation and same is enclosed in the list of the documents submitted by the industry and matching with the data given in the application form. As per the data the total production of the industry will be&nbsp;washing of cloth @ 4.8 MTPD&nbsp;and effluent generation will be around&nbsp;63.36&nbsp;KLD from its entire machinery in 24 Hours.</p> <p style="text-align: justify;">4)&nbsp;&nbsp;&nbsp;The industry has installed one no. boiler of 03 TPH capacity. Twin Cyclone has been provided as APCD along with stack of adequate height. The industry was using wood as fuel.</p> <p style="text-align: justify;">5)&nbsp;&nbsp;&nbsp;The industry has made agreement for disposal of fuel ash in low lying area.</p> <p style="text-align: justify;">6)&nbsp;&nbsp;&nbsp;The industry has installed&nbsp;one DG set of capacity 62 KVA, which is equipped with canopy.</p> <p style="text-align: justify;">The industry has submitted a new bank guarantee of Rs. 50,000/- vide no. 34570ILG000123 dated 05.01.2023 valid upto 24.01.2024 in lieu of old expiry bank guarantee. The industry has requested to return the same stating that earlier the industry had ETP but now it has joined CETP and industry has also requested to restore their electric connection permanently. The industry has now joined the CETP and during last three visits to the industry i.e. on 09.09.2021, 17.10.2022 &amp; 31.01.2023 it was found using only authorized fuel in its boiler.</p> <p style="text-align: justify;">As per the Common land use certificate issued by the DTP vide letter no. 1313-DTP(L)/I-16 dated 13.04.2011.&nbsp; Right side of the Tajpur Road falls in the Residential Zone and left side to the falls in the Industrial Zone. This unit falls on main Tajpur Road left side on Buddha Nallah.</p> <p style="text-align: justify;">It is further informed that the GNE calculations of the soft flow machines were based on dyeing of fabric. However, in this case, the industry doing only washing of clothes. As such, the industry trade effluent generation will be about 64 KLD and domestic effluent 0.5 KLD into CETP conveyance system with the production i.e. washing of clothes @ 4.8 TPD.</p> <p style="text-align: justify;">Till the finalization of the allotment of the shares of CETP 50 MLD, it is recommended that:</p> <p style="text-align: justify;">A.&nbsp;&nbsp;&nbsp;Directions u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981&nbsp;be issued to the PSPCL Authorities for permanent restoration of the electricity connection of the industry.</p> <p style="text-align: justify;">B.&nbsp;&nbsp;&nbsp;The Bank Guarantee of Rs. 50,000/- submitted by the industry be returned.</p> <p style="text-align: justify;">C.&nbsp;&nbsp;&nbsp;Consent to operate under the Air (Prevention &amp; Control of Pollution) Act, 1981 may be granted for one year with usual conditions &amp; special condition that the industry got analyzed it stack emission samples within 01 month.</p> <p style="text-align: justify;">D.&nbsp;&nbsp;&nbsp;Consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 may be granted for one year for the discharge of trade effluent 64 KLD and domestic effluent 0.5 KLD into CETP conveyance system with the production i.e. washing of clothes @ 4.8 TPD subject to the condition that:-</p> <p style="text-align: justify;">1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Shares of CETP are yet to be "Demat" through Registrar of Companies (ROC). As such, legal sanctity of these shares allocated by the Punjab Dyers Association (PDA) to the industry is yet to establish as per the guidelines issued by Securities and Exchange Board of India under the Company Laws. The industry will get its Demat from ROC, within 2 months, positively.</p> <p style="text-align: justify;">2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;As such, the production/ effluent discharge in this consent is subject to the final allotment as described at "1" above. Therefore, in case of variation of shares at the final settlement by the PDA / approval by PPCB /Demat by ROC, the industry is bound to follow the production/ effluent discharge from their unit accordingly and shall obtain revised consents with modified figures of production and effluent discharge as per the final share allotment.</p> <p style="text-align: justify;">3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The consent is an interim arrangements so as to check the discharges from Members industry and the efficiency of the CETP.</p> <p style="text-align: justify;">4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The consent is based on tentative intimidation of the shares by PDA dated 22.7.2022 and GNE report of 2022, as such, it is a temporary arrangement, it will not convey any right to the industry to tentative shares intimated by SPV vide letter dated 22.7.2022.</p> <p style="text-align: justify;">5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The member industry shall install effluent measuring devices at the outlet of the industry leading to conveyance system of CETP within the validity of consent for verification of the discharges.</p> <p style="text-align: justify;">6.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry shall ensure that no new machinery is installed without prior permission of the Board.</p> <p style="text-align: justify;">7.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The consent is an interim measure in-accordance to tentative shares intimated by PDA to the Board vide its letter dated 22.07.2022. These shares are temporarily considered and their finalization is under the consideration of the Board.</p> <p style="text-align: justify;">8.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The member units and PDA shall ensure that total effluent intake into the CETP, Tajpur Road, Ludhiana from the existing units will never be exceed 40 MLD.</p> <p style="text-align: justify;">9.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry as well as M/s Punjab Dyer Association (SPV), Tajpur Road Module, Ludhiana will comply with the&nbsp;undertaking submitted by SPV dated 22.09.2022.</p> <p style="text-align: justify;">10.&nbsp;&nbsp;&nbsp;&nbsp;The PDA shall ensure the working of Inlet and outlet online flow-meters at CETP and shall also provide standby flow meters for the same to ensure their regular working at CETP site.</p> <p style="text-align: justify;">11.&nbsp;&nbsp;&nbsp;&nbsp;The online flow meters at the inlet water source of all member units shall be installed within 4 months. The online connectivity of these flow meters of all units shall be ensured so as to check the discharge allowed by the Board.</p> <p style="text-align: justify;">12.&nbsp;&nbsp;&nbsp;&nbsp;The member industry and M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana shall provide online meters at the outlet of all the dyeing units and to check, update / calibrate this online system so as to provide the regular and exact data of effluent discharge by individual units and in consonance to the effluent received at CETP within 1 week.&nbsp;</p> <p style="text-align: justify;">13.&nbsp;&nbsp;&nbsp;&nbsp;The PDA, Tajpur Road, Ludhiana shall ensure that no overflow of effluent will takes place from the conveyance system at any time and if such things happen, immediately the concerned industries discharging effluent in that line will be closed.</p> <p style="text-align: justify;">14.&nbsp;&nbsp;&nbsp;&nbsp;All member units shall have only one outlet jointly for domestic and trade effluent for discharge into the conveyance system of CETP, 50 MLD Tajpur Road, Ludhiana. There shall be no bypass from any dyeing unit.</p> <p style="text-align: justify;">15.&nbsp;&nbsp;&nbsp;&nbsp;M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana or individual industry shall not to execute any trading/ transfer of CETP's shares without prior permission of the Competent Authority of the Board. The PDA or the individual industry will be responsible for any loss due to trading of shares.</p> <p style="text-align: justify;">16.&nbsp;&nbsp;&nbsp;&nbsp;The PDA, Tajpur Road, Ludhiana and individual member unit shall be liable to pay Environmental Compensation for any lapse in undertaking submitted by SPV dated 22.09.2022.</p> <p style="text-align: justify;">17.&nbsp;&nbsp;&nbsp;&nbsp;It is made clear that in case of failure of commitment made by PDA vide its undertaking dated 22.09.2022, the Board shall be constraint to take strict action in accordance to law, on SPV as well as individual members without any further notice.</p> <p style="text-align: justify;">18.&nbsp;&nbsp;&nbsp;&nbsp;The PDA is again directed to ensure that it achieves the prescribed standards at the outlet of CETP within one month, failing which the Board shall be constrained to order the closure of all the member industries attached with the CETP.</p> <p style="text-align: justify;">Competency :</p> <p style="text-align: justify;">Consent : SEE (ZO)</p> <p style="text-align: justify;">Directions : Hon'ble Chairman of the Board</p> <p>&nbsp;</p>
