Earlier, the industry had applied for consent to operate under Water Act, 1974 & Air Act,1981 and same were refused due to the reasons mentioned there in and main reason for refusal of consents is the industry had not submitted the permission from Competent Authority u/s 79 of the Punjab Regional & Town Planning Development Act, 1995 (amended on 2006 & 2016).</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; text-indent: 35.45pt; line-height: normal; background: white;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-bidi-language: PA;">Thereafter, the industry was given personal hearing before the Chief Environmental Engineer, Ludhiana on 29.01.2020, wherein, it was decided as under:</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -14.15pt; line-height: normal; background: white; margin: 0in 0in .0001pt 35.45pt;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-bidi-language: PA;">1. The industry shall get the permission from the competent authority u/s 79 of the Punjab Regional & Town Planning Development Act, 1995 (amended on 2006 & 2016 for continuation of its operation at the said site as per the provisions of Master Plan, Samrala within one month and submit the same to the Board.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -14.15pt; line-height: normal; background: white; margin: 0in 0in .0001pt 35.45pt;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-bidi-language: PA;">2. The Executive Officer, MC Samrala may clarify, who is the competent authority for grant of permissions u/s 79 of the Punjab Regional & Town Planning Development Act, 1995 (amended on 2006 & 2016) from continuation for the operation of unit at the said site as per the provisions of Master plan, Samrala within 15 days.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -14.15pt; line-height: normal; background: white; margin: 0in 0in .0001pt 35.45pt;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-bidi-language: PA;">3. Environmental Engineer, Regional Office-2 shall persue the matter with the MC Samrala as well as DTP Ludhiana regarding submission of permission u/s 79 of the Punjab Regional & Town Planning Development Act, 1995 (amended on 2006 & 2016) for continuation of the operation of unit at the said site as per the provisions of Master Plan.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -14.15pt; line-height: normal; background: white; margin: 0in 0in .0001pt 35.45pt;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-bidi-language: PA;">4. The industry will apply and obtain consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; text-indent: 35.45pt; line-height: normal; background: white;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-bidi-language: PA;">The Executive Officer, MC Samrala as well as industry have not submitted any reply/ document in compliance of the personal hearing.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; text-indent: 35.45pt; line-height: normal; background: white;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-bidi-language: PA;">Thereafter, a notice to issue directions u/s 33-A of the Water Act, 1974 and u/s 31-A of Air Act, 1981 was issued to industry with hearing before the CEE, Ludhiana on 06.03.2023 and after hearing it was decided as under :-</span></p>

The industry shall apply for authorization under Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016, within 15 days.</span></p>

The Environmental Engineer, Regional Office-2, Ludhiana shall process consent applications on merits and submit report / recommendations in the matter, within 07 days. He is also requested that in such cases report should be sent after visiting the site.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; line-height: normal; background: white;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-bidi-language: PA;"><span style="mso-tab-count: 1;"> </span>Now, the industry has applied for fresh consent to operate under Water Act, 1974 & Air Act, 1981 alongwith requisite documents for the manufacturing of product THRESHAR, ROTAVETOR, ZERO DRILL, MULTICROP PLANTER, HAPPY SEEDER. The industry has also submitted the no due certificate issued by the O/o of Municipal Council, Samrala vide letter no. 1824 dated 30.12.2019 stating as under :-</span></p>

Ludhiana (Factory) </span><span lang="PA" style="font-size: 12.0pt; font-family: 'Raavi','sans-serif'; mso-ascii-font-family: Tahoma; mso-fareast-font-family: 'Times New Roman'; mso-hansi-font-family: Tahoma; mso-bidi-theme-font: minor-bidi; mso-bidi-language: PA;">ਨਗਰ ਕੌਸਲ ਸਮਰਾਲਾ ਦੀ ਹਦੂਦ ਅੰਦਰ ਪੈਂਦੀ ਹੈ । ਇਹ ਸਾਈਟ ਰਹਾਇਸ਼ੀ ਜੋਨ ਵਿੱਚ ਆ ਜਾਂਦੀ ਹੈ। ਇਹ ਯੂਨਿਟ ਪੰਜਾਬ ਦੀ ਧਾਰਾ 79 ਅਧੀਨ ਮਾਸਟਰ ਪਲਾਟ ਡਿਵੈਲਪਮੈਂਟ ਐਕਟ 1995 (ਤਰਮੀਮ 2006 ਅਤੇ 2016) (ਭਾਵ 2030 ਤੱਕ ਸਮਰੱਥ ਅਧਿਕਾਰੀ ਦੀ ਪ੍ਰਵਾਨਗੀ ਨਾਲ ਚਾਲੂ ਰੱਖਣ ਸਬੰਧੀ ਇਸ ਦਫਤਰ ਨੂੰ ਕੋਈ ਇੰਤਰਾਜ ਨਹੀਂ ਹੈ। ਇਸ ਨੇ ਡਿਊ ਸਰਟੀਫਿਕੇਟ ਨੂੰ ਭਵਿੱਖ ਵਿੱਚ ਬਣਨ ਵਾਲੀ ਕਿਸੇ ਬਿਲਡਿੰਗ ਦੀ ਪ੍ਰਵਾਨਗੀ ਨਾ ਸਮਝੀ ਜਾਵੇ। ਇਹ ਫੈਕਟਰੀ 2007 ਤੋਂ ਪਹਿਲਾ ਦੀ ਚਲ ਰਹੀ ਹੈ। ਨਗਰ ਕੌਸਲ ਵੱਲੋਂ ਕੋਈ ਵੀ ਟਰੇਡ ਕਰਨ ਲਈ ਹਰ ਸਾਲ ਲਾਇਸੰਸ ਜਾਰੀ ਕੀਤਾ ਜਾਂਦਾ ਹੈ। ਜੋ ਕਿ ਸਬੰਧਤ ਅਦਾਰੇ ਦੇ ਮਾਲਕ ਵੱਲੋਂ ਦਰਖਾਸਤ ਦੇਣ ਉਪਰੰਤ ਜਾਰੀ ਕੀਤਾ ਜਾਂਦਾ ਹੈ। ਇਸ ਅਦਾਰੇ ਨੂੰ 2030 ਤੱਕ ਹਰ ਸਾਲ ਦੀ ਤਰ੍ਹਾ ਲਾਇਸੰਸ ਜਾਰੀ ਕਰਨ ਵਿੱਚ ਨਗਰ ਕੌਸਲ ਨੂੰ ਕੋਈ ਇੰਤਰਾਜ ਨਹੀ ਹੋਵੇਗਾ। ਅਗਰ ਸਰਕਾਰ ਵੱਲੋਂ ਕੋਈ ਨਵਾ ਹੁਕਮ ਹੁੰਦਾ ਹੈ ਤਾਂ ਉਸ ਮੁਤਾਬਕ ਕਾਰਵਾਈ ਕਰਨ ਦਾ ਅਧਿਕਾਰ ਨਗਰ ਕੌਸਲ ਨੂੰ ਹੋਵੇਗਾ। ਸਾਲ 2030 ਤੋਂ ਬਾਅਦ ਸਮਰੱਥ ਅਧਿਕਾਰੀ ਦੀ ਪ੍ਰਵਾਨਗੀ ਮੁਤਾਬਕ ਅਗਲੀ ਕਾਰਵਾਈ ਕੀਤੀ ਜਾ ਸਕੇਗੀ। ਸਬੰਧਤ ਅਦਾਰੇ ਦਾ ਮਾਲਕ ਸਮਰੱਥ ਅਧਿਕਾਰੀ ਦੀ ਪ੍ਰਵਾਨਗੀ ਲੈਣ ਲਈ ਆਪਣੀ ਪੱਧਰ ਤੇ ਕਾਰਵਾਈ ਕਰੇਗਾ। ਇਸ ਸਬੰਧੀ ਨਗਰ ਕੌਸਲ ਸਮਰਾਲਾ ਦਾ ਕੋਈ ਬਕਾਇਆ ਨਹੀਂ ਹੈ।</span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; mso-bidi-language: PA;">“</span><span lang="PA" style="font-size: 12.0pt; font-family: 'Raavi','sans-serif'; mso-ascii-font-family: Tahoma; mso-fareast-font-family: 'Times New Roman'; mso-hansi-font-family: Tahoma; mso-bidi-theme-font: minor-bidi; mso-bidi-language: PA;"> </span></p>
