CTOA/Renewal/LDH3/2021/13911924 dated 21.06.2021, valid upto 30.06.2023 and under the Water Act, 1974 vide no. CTOW/Renewal/LDH3/2019/8421865 dated 22.01.2019 valid upto 31.03.2023.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">Earlier, the project proponent was given personal hearing before the Chairman of the Board on 28.07.2015 for not confirming the prescribed standards, wherein it was decided as under:-</span></p>

<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">Accordingly, the project proponent has submitted a bank guarantee bearing no. 034GT02152720008 dated 29.09.2015 of amounting 3.0 lacs. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">Thereafter, effluent samples were collected by the officer of the Board on 19.09.2016 and the project proponent was again found not confirming the prescribed standards. Accordingly, the industry was given personal hearing before the Hon'ble Chairman of the Board on 28.02.2017 wherein, it is decided as under:- </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">1. The project proponent shall get its STP examined from some expert agency and make necessary up-gradation in the installation as well as operational systems of the same, within 15 days. </span></em></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">2. Part of the Bank guarantee amounting to Rs. 1.00 lac out of Rs. 3.00 lac shall be encashed as the samples of the effluent being discharged from the mall is continue to fall the prescribed standards. </span></em></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">3. Environmental Engineer, RO-3, Ludhiana shall personally visit the mall, re-monitor the STP after 15 days and process the consent applications accordingly and give conclusive recommendations to decide this notice also.</span></em></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">Thereafter, Effluent samples from the oulet of STP were collected by this office on 03.04.2017, 21.11.2017 and 14.08.2018 and the project proponent was confirming the prescribed standards during all the time. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">Thereafter, the project proponent was visited on 11.06.2019 and found violating the provisions of Water Act, 1974. Accordingly, personal hearing was given to the PP on 01.07.2019 before the Chief Environmental Engineer, Ludhiana, wherein it was decided as under:-</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">1. The project proponent shall submit extended Bank Guarantee of Rs. 3.0 Lac and fresh bank guarantee of Rs. 1.5 Lac as an assurance to comply with pollution control laws. </span></em></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">2. The project proponent shall install mechanical composter for in-house treatment of organic solid waste, within one month. </span></em></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">3. Environmental Engineer, Regional office-3, Ludhiana shall verify the contention of the industry, en-cash Bank Guarantee of Rs. 1.5 Lac immediately. Now, the project proponent has applied for renewal of consent to operate under Air (Prevention & Control of Pollution) Act 1981 through OCMMS.</span></em></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">Thereafter, The site of the industry was visited by the AEE of this office on 16.10.2020 and it was observed that :-</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">1. The multiplex is having 06 nos. cinema screens, 55 nos. shops, 02 no. coffee shops, 01 no. food court and 01 no. restaurant. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">2. The project proponent is having 03 no. D.G sets of 1010 KVA, 500 KVA & 1000 KVA, which are placed in acoustic room. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">3. The project proponent has installed STP for treatment of effluent generated from catering & domestic source respectively. The project proponent has also installed Mechanical composter for organic waste to reuse in plantation. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">4. The sludge generated by the project proponent is lifted to M/s A2Z waste Management Pvt. Ltd. The record is maintained by the project proponent. As per record, the project proponent has lifted sludge to A2Z Waste Management @ 3374 Kgs in last 9 months (i.e. Jan, 2020 to Sept, 2020). Presently sludge is stored about 150 Kg in 6 bags. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">5. The project proponent has not submitted extended Bank Guarantee of Rs. 3.0 Lac and fresh bank guarantee of Rs. 1.5 Lac as an assurance to comply with pollution control laws </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">6. The project proponent was not complying the personal hearing decision given before the Chief Environmental Engineer, Ludhiana on 01.07.2019.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">Accordingly show cause notice for refusal of Consent to Operate under Air (Prevention & Control of Pollution) Act, 1981 was issued to the PP alongwith opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana on 19.04.2021, wherein, it was decided as under:-</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">1. The Project Proponent will extend the validity of Bank Guarantee of Rs. 3.0 Lacs within 04 days and also submit the fresh bank guarantee of Rs. 1.5 lacs, within 15 days. 2. The project proponent shall provide complete details regarding agreements made with the individual eateries regarding the Solid Waste Management and also the capacity of the bio-composter installed, within 10 days. </span></em></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><em><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">3. Environmental Engineer, Regional Office-3, Ludhiana will visit the project to verify the contention of the industry, installation of bio-composter for in-house management of organic solid waste and submit report/ recommendations within 15 days. </span></em></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;"><span style="mso-spacerun: yes;"> </span>In-compliance to the decisions of personal hearing dated 19.04.2021, the project proponent has submitted extended Bank Guarantee of Rs. 3.0 Lacs and also submitted fresh bank guarantee of Rs. 1.5 lacs, currently valid upto 11.04.2023 and 10.04.2023 respectively.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;"><span style="mso-spacerun: yes;"> </span>Thereafter, the PP was again given Personal Hearing before the CEE, Ludhiana on 17.08.2022 for complying with the decision no. 2 of hearing dated 19.04.2021. Proceedings of the said hearing are awaited. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;">Thereafter, the entity was visited by the officer of this office on 11.01.2023 and effluent sample was collected from the outlet of STP, results of the same has been received from Zonal Lab, Ludhiana, as per which the parameters pH-6.8, TSS-42, <span style="mso-spacerun: yes;"> </span>TDS-620, <span style="mso-spacerun: yes;"> </span>COD-124, <span style="mso-spacerun: yes;"> </span>BOD-37, O&G-6.1 are confirming the general standards. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1; background: white;"><span style="mso-spacerun: yes;"> </span>Now the project proponent has applied for renewal of Consent to Operate under Air (Prevention & Control of Pollution) Act, 1981 and Water Act, 1974 along with requisite documents. The PP has deposited consent fee of Rs. 282000/- vide R.No. 756991812 dated 25.03.2023 under Air Act, 1981 and Rs. 282000/- vide R.No. 490294453 dated 25.03.2023 under Water Act, 1974 and Rs 5600/- vide UTR no. 869378470 dated 29.03.2023 as NOC regularization fee against the CA certificate of Rs. 40.28 crore. The consent fee is adequate upto 30.03.2028 under Water Act, 1974 and upto 29.06.2028 under Air (Prevention & Control of Pollution) Act, 1981. </span></p>
