The project proponent was granted Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2021/16136407 dated 06.08.2021, valid till 31.03.2023 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2021/16136352 dated 06.08.2021, valid till 31.03.2023 for manufacturing of Maganese Dioxide @ 80 MT/Year, 2-Ethyl Sodium Hexanoate @ 1275 MT/Year, Cloxacillin Sodium Monohydtare @ 728 MT/Year, Di-cloxacillin Sodium Monohydrate @ 110 MT/Year, Flucloxacillin Sodium Monohydrate @ 98 MT/Year, Oxacillin Sodium Monohydrate @ 98 MT/Year, Ampicillin Trihydrate @ 110 MT/Year, Amoxycillin Trihydrate @ 516 MT/Year with special condition as under: 1.       The industry shall comply with the SOP (standard operating procedure) for recovery of spent solvent (applicable to captive utilization part) issued by the CPCB in Mar, 2018, and submit PERT chart to this office within 7 days mentioning the progress to be taken up for compliance of the SOP (standard operating procedure) with timelines, for compliance of the same at the earliest in true letter & spirit. 2.       The industry shall ensure that no wastewater from its industrial premises / plantation area or otherwise find its way into storm water drain(s) directly or indirectly under any circumstances. 3.       The industry shall ensure that the sample collection facility attached with the stacks should be as per guidelines mentioned in EPR-3 norms prescribed by the CPCB. Now, the project proponent has applied for renewal of Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with requisite documents. The project proponent has submitted CA Certificate with the value of fixed assets of Rs. 24.89 crore on 28.03.2023. The industry has deposited Rs. 1,47,600/- vide R no. 182391444 dated 29.03.2023 under Water (Prevention & Control of Pollution) Act, 1974  and Rs. 1,47,600/- vide R no. 988138400 dated 29.03.2023 under Air (Prevention & Control of Pollution) Act, 1981. Earlier, the fees deposited by the industry was adequate till 31.03.2025 under both acts and adding the fee deposited by the industry presently, the CTO fee is adequate till 30.09.2027 under both acts. The project proponent has submitted compliance report of the previous Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 granted to it. The industry was earlier visited by the officer of the Board on 22.12.2022 and it was observed that the industry was violating the provisions of the Water Act, 1974, Air Act, 1981 and HWM Rules, 2016 and accordingly, the industry was issued notice to issue directions u/s 5 of EPA, 1986 and show-cause notice for revocation/cancellation of CTO granted under Water Act, 1974 and Air Act, 1981 with an opportunity of personal hearing before worthy Chairman on 21.02.2023. The proceedings are awaited.   The site was visited by the undersigned on 28.03.2023 and contacted Sh. Munish Kumar, GM-HR (7404407661). During visit it was observed as under: 1.       The representative informed that the industry is engaged in manufacturing of Amoxycillin, amoxycillin sodium, sterile, ampiullen, cloxacillin, oxacillin, Di-cloxacillin, potassium clavuanate & phentacelin potassium clauvanate. Hence, the products being manufactured are different for which CTO has been applied. 2.       The industry is operating its unit in D-5, D-6, Focal Point and in D-5 it has set up process plant, utility section, SRP plant, hazardous waste room and in D-6 it has set up MEE, Admin block, boiler etc. The representative informed that they have stopped manufacturing bulk drugs API. 3.       The industry has not installed scrubber to capture the emissions from the process section. The representative informed that they don’t require to install scrubber being sterile plant.  4.       The industry is generating waste water from utensil washing, floor washing, boiler blow down & cooling tower blow down, which is fed in to MEE of capacity 15 KLD. The industry is not segregating its Low & High COD effluent. Before feeding to MEE, the effluent is stored into collection tank of size 10KL, 3 KL, 50 KL, 50 KL, 100 KL, 100 KL & 600 KL. The industry is maintaining the pH in these collection tanks to 7-7.5 by adding caustic. During visit, 2,60,500 ltr wastewater was found stored in these tanks which is to be treated in MEE as per data verified using level rod. These tanks are not covered from top & are open to rain water. From 1st 50 KL tank, the water is lifted to the MEE fee tank from where it is lifted to 1st calandria of forced evaporation type MEE. MEE installed consist 4 calandria. 2 no. calandria was found disconnected and the representative informed that the two calandria has been disconnected yesterday due to leakage problem in callindria. MEE was not in operation and the representative informed that due to leakages observed in MEE fee tank and line leading from MEE feed to Callindria. As such sample could not be collected. The industry is feeding MEE concentrate into MEE feed tank and sludge settled at the bottom is taken to nutch filter but no fixed connection of MEE feed tank has been made with nutch filter. MEE condensate is collected in 5000 ltr  syntax tank from where is used in cooling tower & boiler but there is no fixed pipeline for carrying this water to boiler/cooling tower. The industry has provided an open outlet of MEE condensate tank which is not plugged and the representative was advised to plug the same immediately. As per record checked, MEE was operated by the industry in the month of March on 02.03.2023, 11.03.2023, 14.03.2023 & 27.03.2023 & production was in operation continuously without break.  Reading of water meter provided on the MEE feed line was 15793 KL and reading of water meter provided on MEE condensate line was 18897 KL. The industry has not provided water meter on the LTDS and HTDS line being fed to the common collection tank so that water balance of the effluent can be done. The industry is maintaining the record in the form of water received from plant, waste water taken for treatment, Treated water, Treatment water send to boiler & cooling tower but no basis how this record is being made is there as no water metering has been done on these lines. In the absence of metering at the above points, it cannot be verified whether the industry is actually & properly treating its effluent. 5.       The industry is maintaining record of TDS of water fed into MEE, TDS of MEE condensate and TDS of MEE concentrate and as per record check, TDS of water fed into MEE was 17280, TDS of condensate was 309 & TDS of concentrate was 390 on 27.03.2023. On 14.03.2023, TDS of water fed into MEE was 16200, TDS of condensate was 205 & TDS of concentrate was 217, and such low value of TDS in concentrate is not possible. 6.       Wood fired boiler of 3 TPH was in operation which is provided with multi cyclone followed by stack of adequate height. Sample was collected from the stack of the boiler. The industry has installed RO plant and MC supply water is fed into RO and RO reject and permeate is feeded into boiler as informed by the representative. No record of TDS of water being fed into boiler is being maintained. The industry has not installed OCEMS with the boiler. Sample from stack of boiler was collected and send to HO lab for analysis. 7.       The industry has now disconnected the thermopack with the stack. The representative informed that the thermopack is not being used any more. 8.       The project proponent has installed 2 no. DG sets of capacity 750 KVA & 625 KVA with canopy & inadequate stack height . 9.       The industry has provided environmental data board outside the premises. 10.   The industry is getting fresh water supply from MC supply installed in D-5 & reading of water meter was 5217.44 KL. The industry is not maintaining record of fresh water consumption. 11.   The industry has provided dedicated hazardous waste room and no danger sign board outside the room has been provided. The industry has stored 14 bags of sludge recovered from nutch filter and no marking of date, qty and bag no. on hazardous waste bags were observed. The industry has also stored 2 drums of 200 ltr of spent solvent residue & 1 tank of 200 ltr of spent solvent in this room. The industry has stored 1 drum of used oil generated from servicing of DG in open near the DG set. The authorization under HWM Rules, 2016 of the industry has expired on 30.06.2016. 12.   The industry has installed SRP plant of 10 KLD capacity & has provided VOC & TOC meter at condenser outlet & reading of VOD  is 7 & TOC – 0.40. The industry is yet to connect the vent of storage tanks with the condenser. 13.   The industry has now stored spent solvent drums in a room. Around 40 drums of spent solvent of 200 ltr were found stored. In view of above, it is recommended that show-cause notice for the refusal of CTO applied by the industry under Water Act, 1974 and Air Act, 1981 may be issued with an opportunity of personal hearing before worthy Chairman.
