File Note: <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">It is submitted that the project proponent has applied for obtaining consent to establish (NOC) under the Water Act, 1974 &amp; the Air Act, 1981 for establishment of commercial colony with 79 no. of factory outlets, 02 no. food courts and 02 no. restaurants in land area measuring 8.991 acres in the revenue estate of Village Gill, Moga Road, Baghapurana, District Moga. </span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">On 29.03.2023, PP has submitted reply w.r.t. clarification dated 28.03.2023 stating that they are revising the building-cum-layout plan and as per the revised lay out plan the project will have 76 SCOs, 01 food court and 02 no. restaurants. The PP also submitted that the lay out plan approved by Glada vide letter no. 1999 dated 16.03.2023 is still awaited. PP also stated that he is submitting revised feasibility report and copy of unapproved layout plan.</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">The site of the project was visited by RO, FDK on 10.02.2023 and it was reported that:-</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: 150%; background: white; margin: 0in 0in .0001pt 27.0pt;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">1)</span><span style="font-size: 6.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">&nbsp;&nbsp;&nbsp;</span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">The proposed site is located on left hand side on Bhagapurana- Moga Road in in the revenue estate of Village Gill, Bhagapurana, District Moga.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: 150%; background: white; margin: 0in 0in .0001pt 27.0pt;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">2)</span><span style="font-size: 6.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">No construction activity was being carried out at site and only boundary wall has already been constructed.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: 150%; background: white; margin: 0in 0in .0001pt 27.0pt;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">3)</span><span style="font-size: 6.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">A petrol pump is situated on one side of the proposed site and a dhaba and other commercial shops are located within 100 mtr from the project site. No air polluting industry is located within 100 mtr from the project site. Moreover, no MAH industry is located within 250mtr of the project site and no cement plant/grinding unit/rice sheller/saila plant/stone crusher/screening cum washing plant/hot mix plant/brick kiln is located within 500 mtr from the proposed site.</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">The site of the commercial colony is meeting with the siting guidelines for establishment of such projects.</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">The project proponent has submitted Change of Land Use (CLU) issued by Chief Administrator, GLADA, Ludhiana vide memo no. 1314 dated 02.12.2022 for land area measuring 71 kanal-18 marlas-6 sarsahis (8.991 Acres) in the revenue estate of Village Gill (Hadbast No. 86), Tehsil Baghapurana, District Moga. As per CLU granted, the site falls in mixed land use zone and residential zone as per Notified Master Plan, Baghapurana (2010-31).</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">The project proponent has submitted copy of proposed unapproved layout plan having proposed built up area as per FAR @ 22581.93 sq. yds i.e. 18,888.23 sq mtr which is less than 20,000 sq. meter. Therefore, the project is not required to obtain EC as per EIA notification 2006.</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">As per the layout plan 157.64 sqyds area has been earmarked for establishment of STP and 402.03 sqyds (336 sq meter) area has been earmarked as green / park area. </span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">Further, the industry has submitted an undertaking dated 03.03.2023 as per which the PP undertook that they have made seller buyer agreement dated 30.01.2023 for procuring land @ 20K 7M having khasra no. 85//2/1/2(2-19), 9/1(7-16), 10 (8-0) &amp; 12/3 (1-12) out of which 1000 sqyd land will be used for plantation and disposal of treated effluent after STP. The PP has also submitted copy of seller buyer agreement dated 14.12.2022 bearing same khasra nos. However, the seller buyer agreement is off 16 Kanals only. </span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">RO has submitted that as per feasibility report submitted by PP, it has been proposed that the 55 KLD of fresh water will be utilized in the project and 42 KLD of effluent will be generated. The PP has proposed to install 45 KLD STP based on MBBR technology, which is adequate priniciple. It has been proposed that 10 KLD effluent will be reused for flushing purpose and remaining 32 KLD effluent will be disposed onto land for plantation. It has been proposed that 850 sqmeter green area will be developed within the approved layout plan and 850 sq meter area shall be developed in the newly purchased land as per seller buyer agreement.</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">RO has informed that apporx. 200 kg of solid waste has been proposed to generate from the project which woule be collected using colour coded bins.
