File Note: <p style="text-align: justify;">Discussed.&nbsp;</p> <p style="text-align: justify;">The detail of the application is as under:-</p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;">The previous CTOs were granted to the industry on 08.07.2019 (valid upto 30.06.2024) for production of battery plates @ 1000 nos/day and lead ingots @ 500 TPA by using lead acid battery plates/ scrap @ 750 TPA by operating 2 no. smelting furnaces.</p> <p style="text-align: justify;">The industry was granted authorization under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 for generation, collection, storage &amp; disposal of hazardous waste of category 9.1 &amp; 9.2 on 11.01.2022 (valid upto 10.01.2027).</p> <p style="text-align: justify;">The industry has also obtained registration cum passbook for utilization of lead acid batteries/lead scrap on 11.01.2022 (valid upto 10.01.2027).</p> <p style="text-align: justify;">The industry was visited on 29.11.2022 and it was observed that the industry has carried out expansion by installing new rotary furnace &amp; smelting furnace in addition to the existing 2 no. smelting furnaces, lot of emissions were observed being emitted from the rotary furnace which were not being arrested in the APCD installed, wet scrubber installed was not in line, no specific area provided for breaking of the scrap batteries and same were lying all over the floor area, poor house keeping, no record submitted regarding lifting of the lead acid battery scrap and also no record being maintained regarding generation/disposal of hazardous waste of category 9.1 &amp; 9.2.</p> <p style="text-align: justify;">Notice u/s 33-A of the Water Act, 1974 &amp; u/s 31-A of the Air Act, 1981, revocation of consents under Water Act, 1974 &amp; Air Act, 1981 and revocation of authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 was issued to the industry alongwith an opportunity of personal hearing before Chief Environmental Engineer (B) of the Board on 26.12.2022, which was postponed to 02.02.2023, wherein it was decided that:-</p> <p style="text-align: justify;"><!-- [if !supportLists]-->a)&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry shall not operate its rotary furnace &amp; newly installed smelting furnace without obtaining consent to operate of the Board under the Water Act, 1974 &amp; Air Act, 1981.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->b)&nbsp;&nbsp; <!--[endif]-->The Regional Office, Bathinda shall immediately seal the rotary furnace and newly installed smelting furnace, which have been installed/commissioned without obtaining 'consent to operate of the Board.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->c)&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry shall ensure the compliance of the guidelines/ Standard Operating Procedure prescribed for environmentally sound recycling of lead bearing Hazardous Waste alongwith compliance of conditions of consents granted under the Water Act, 1974 &amp; Air Act, 1981 &amp; authorization under HOWM Rules, 2016 at all times.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->d)&nbsp;&nbsp;&nbsp; <!--[endif]-->Environmental Engineer, Regional Office, Bathinda shall visit the industry immediately within 15 days to verify the compliance (s) / submissions made by the industry at site and thereafter submit report / recommendations in the matter.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->e)&nbsp;&nbsp;&nbsp; <!--[endif]-->During hearing, it has been made clear to the proprietor of the industry that in case of any violation(s) in future, further action as deemed fit shall be initiated under the provisions of the Water Act, 1974; the Air Act, 1981 and HOWM Rules, 2016.</p> <p style="text-align: justify;">Now the industry has applied for obtaining varied consents to operate under the Water Act, 1974 &amp; Air Act, 1981 for production of battery plates @ 2000 nos/day and lead ingots @ 1350 TPA by using lead acid battery plates/ scrap @ 2000 TPA as it has installed new rotary furnace &amp; new smelting furnace in addition to the existing 2 no. mandir bhattis.</p> <p style="text-align: justify;">The visiting officer has reported that the site is located in the industrial focal point of Malout and SAC clearance is not required to the industry though it has undergone expansion.</p> <p style="text-align: justify;">The visiting officer has further reported that the industry was visited on 17.03.2023 and was not in operation; rotary furnace &amp; newly installed smelting furnace was found sealed in compliance to the decisions of the personal hearing dated 02.02.2023. Further, it has been reported that:-</p> <p style="text-align: justify;"><!-- [if !supportLists]-->&nbsp; &nbsp;1.&nbsp;&nbsp;&nbsp; <!--[endif]-->Common APCD installed with 2 no. mandir bhatties and rotary furnace consisting of gravitiy settling chamber followed by cyclone followed by bag filter house followed by alkali scrubber as APCD. Separate APCD installed with the newly installed smelting furnace consisting of dust settling chamber followed by twin cyclone followed by bag filter house followed by alkali scrubber as APCD. Both the APCDs were found in line and with the adequate stack height.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->&nbsp; 2.&nbsp;&nbsp;&nbsp; <!--[endif]-->Imprevious floor provided for storage of lead bearing waste.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->&nbsp; 3.&nbsp;&nbsp;&nbsp; <!--[endif]-->Neutralizing pit of capacity 1 KLD provided consisting of storage tank followed by reaction-cum-dozing tank followed by discharge for the effluent generated from the breaking of batteries (if any). The ETP installed was not in operation as there was no effluent generation.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->&nbsp; 4.&nbsp;&nbsp;&nbsp; <!--[endif]-->Acid proof flooring provided in the battery breaking area with the slope towards the collection tank of neutralizing pit. Manual scrap breaking specific area provided for breaking of scrap batteries.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->&nbsp; 5.&nbsp;&nbsp;&nbsp; <!--[endif]-->House keeping of the industry has been improved and the industry has started maintaining record w.r.t. lifting of battery scrap.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->&nbsp; 6.&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry is complying with the provisions of the Water Act, 1974 &amp; Air Act, 1981 &amp; with the SOPs prescribed for such type of units.</p> <p style="text-align: justify;">In view of above, if approved varied consents to operate under the provisions of the Water Act, 1974 &amp; Air Act, 1981 be granted to the industry for six months, subject to the following conditions:-</p> <p style="text-align: justify;">&nbsp;1.&nbsp; The industry shall not procure and process any hazardous waste as prescribed in Schedule-I appended to the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 beyond the permitted capacity i.e. 750 TPA as granted in the registration cum passbook issued to it on 11.01.2022 for utilization of lead acid batteries/lead scrap.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->&nbsp;2. The industry shall obtain revised registration/passbook for utilization of lead acid batteries/lead scrap @ 2000 TPA, which shall be obtained during the validity period of this consent.</p> <p style="text-align: justify;">&nbsp; &nbsp; 3.&nbsp;&nbsp;&nbsp; The industry shall ensure that in no case the production capacity of the industry shall exceed manufacturing of battery plates @ 1000 nos/day and lead ingots @ 500 TPA until it obtains revised registration-cum-passbook under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->4.&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry shall provide the operational schedule and get analyzed its air emission sample from Board's lab within 2 months.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->5.&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry will ensure compliance of SOPs prescribed by CPCB for such type of units, at all times.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->6.&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry shall ensure the compliance of conditions of consents to operate under the Water Act, 1974 &amp; Air Act, 1981; authorization under the Hazardous &amp; Other Waste Management Rules, 2016 and conditions stipulated while issuing registration certificate-cum-passbook, at all times.</p> <p style="text-align: justify;">Competency: CEE (B)</p> <p style="text-align: justify;">&nbsp;</p>
