The industry is a large scale red category sugar mill with capacity to process sugar cane @ 2500 MTD. The industry was granted consent to operate under the Air Act 1981 vide no. CTOA/Renewal/NWS/2022/16886931 dated 28.2.2022 valid upto 31/03/2022 for 2 nos. Boilers of Capacity 20 TPH each and 1 no. Boiler of Capacity 30 TPH  and 2 nos. DG Sets of capacity 125 KVA & 160 KVA.                The industry applied for renewal of consent under Water Act, 1974 through OCMMS and the industry was issued show cause notice for refusal of consent under the Water Act, 1974 with hearing before Chairman of the Board on 30.03.22 and the consent to operate applied by the industry under the Water Act, 1974 was returned to the industry through OCMMS on 21.04.22. The industry was visited by the AEE of Regional Office, Hoshiarpur on 12.05.2022 and was found violating the said Acts.  Accordingly, the industry was issued show cause notice for revocation of consent to operate granted under the Water Act 1974 with hearing before Chairman of the Board on 16/12/2022.              After hearing, the officer of the Board, representative of the industry & considering the material facts on record, the Chairman of the Board decided that:- <p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -1.0cm; line-height: normal; mso-list: l0 level1 lfo1; background: white; margin: 0cm 0cm .0001pt 1.0cm;">1.      The industry shall utilize the entire treated effluent of ETP onto land for plantation during the current crushing season within the industry. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -1.0cm; line-height: normal; mso-list: l0 level1 lfo1; background: white; margin: 0cm 0cm .0001pt 1.0cm;">2.      The industry will arrange 2 acres of land within the premises in the present crushing season. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -1.0cm; line-height: normal; mso-list: l0 level1 lfo1; background: white; margin: 0cm 0cm .0001pt 1.0cm;">3.      The industry shall develop green belt along the roads & parks so as to ensure that there is no discharge into East Bein, for utilization of 100 KLD of treated effluent and shall use the treated effluent in road sprinkling activities. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -1.0cm; line-height: normal; mso-list: l0 level1 lfo1; background: white; margin: 0cm 0cm .0001pt 1.0cm;">4.      The industry shall ensure that there is no discharge into East Bein in the current crushing season. 5.      The industry shall apply for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and authorization under Hazardous & other Wastes (Management & Transboundary Movement) Rules, 2016 within 10-days.   The industry has applied for renewal of 'consent to operate' under the the Air (Prevention & Control of Pollution) Act, 1981. The industry was visited by the undersigned on 31.3.2023 and contacted Sh. Sukhwinder Singh, Chief Engineer . The detail of the case and observations made during visit is as under; The industry has submitted the CA certificate for Gross Value of assets as on 31.03.2022 of Rs. 3087 lacs.. The industry has deposited consent fees as under; Under Air Act, 1974: Rs. 190800/- vide R. no. IBKL230221494133 dated 21.02.2023 as consent fees. The industry has deposited 'consent to operate' fee under Act upto 31.03.2024. The industry has submitted the compliance report of the conditions of the 'consent to operate' granted, , financial status, authorized signatory, process flow diagrams,etc. General Information: 1. The industry is manufacturing sugar from sugar cane and is in operation 2. The industry is crushing sugar cane @ 2500 MTD to produce Sugar @ 225 MTD, Molasses @ 112 MTD and Press Mud @ 125 MTD. 3. The main manufacturing process is: Sugar Cane, Preparation/Crushing, Heating, SO2 and lime addition, Sulphitation, Heating, Clarification, Evaporation, Syrup, Sulphitation, Crystallization, Centrifuge, Drying, Packaging. 4. The industry has been granted 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 upto 31.03.2024 alongwith ETP based on Biological Treatment for Domestic Effluent @ 25.0 KLD and Trade Effluent @ 440.0 KLD, subject to the conditions mentioned therein. 5. The industry was granted 'consent to operate' under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/NWS/2020/12489754 dated 09.05.2020 valid upto 31.03.2021 alongwith 2 nos. Boilers of Capacity 20 TPH each, 1 no. Boiler of Capacity 30 TPH and using Bagasse @ 35 TPH as fuel, 2 nos. DG Sets (125 KVA & 160 KVA), Water Scrubber with Boilers, subject to the conditions mentioned therein. 6. The 'consent to operate' were granted for manufacturing of Sugar @ 220 Metric Tonnes/Day from Sugar cane @ 2500 Metric Tonnes/Day, Molasses @ 112 Metric Tonnes/Day, Press Mud @ 125 Metric Tonnes/Day, Filter Cake @ 100 Metric Tonnes/Day. Compliance of Air Act, 1981: <p class="MsoListParagraphCxSpFirst" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: normal; mso-list: l1 level1 lfo2; background: white;">1.  The industry has existing 2 no. of Boilers of capacity 20 TPH each and one no. boiler of capacity 30 TPH. However, the same are not operated as the steam and power requirement is fulfilled by the Nawanshahr Power Pvt. Ltd. However, regular complaints of the ash spreading is being received wrt operation of power plant and it becomes very difficult to stop the power plant and get it repaired due to sugar cane crushing and farmer welfare. It is required that the sugar mill shall keep its boilers as standby as and when the power plant needs to be shut down so as to keep sugar mill operating . <p class="MsoListParagraphCxSpMiddle" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: normal; mso-list: l1 level1 lfo2; background: white;">2.  The boilers are provided with wet scrubber as APCD and stack of adequate height. The bagasse is used as fuel in the boilers. <p class="MsoListParagraphCxSpMiddle" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: normal; mso-list: l1 level1 lfo2; background: white;">3.  The agreement of hazardous waste category 5.1.5.2 and 33.1is made with authorized recyclers and the industry is in process to apply for HWM Rules 2016 authorization. <p class="MsoListParagraphCxSpMiddle" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: normal; mso-list: l1 level1 lfo2; background: white;">4.  The unit has installed 02 DG sets of 125 &160 KVA capacity with canopy and adequate stack height. <p class="MsoListParagraphCxSpMiddle" style="mso-margin-top-alt: auto; margin-right: -1.1pt; margin-bottom: .0001pt; margin-left: 63.85pt; mso-add-space: auto; text-align: justify; line-height: normal; background: white;">  <p class="MsoListParagraphCxSpLast" style="mso-margin-top-alt: auto; margin-right: -1.1pt; margin-bottom: .0001pt; margin-left: 0cm; mso-add-space: auto; text-align: justify; text-indent: 35.45pt; line-height: normal; background: white;">It is pertinent to mention here that the unit needs to repair its boiler to make them operational so that same may be operated as standby if there is problem in M/s Nawanshahr Power Plant due to air pollution, so that the power plant can take shut down for its repair without the shutdown of the sugar mill thus avoiding air pollution an law order problem with farmers and local residents. In view of above, it is recommended that the unit may be granted CTO under the provisions of Air Act, 1981 upto 31.03.2024 with suitable conditions and special condition that unit shall repair its boilers to make them operational so that same may be operated as standby if there is problem in M/s Nawanshahr Power Plant.
