CTOW/Renewal/RPN/2021/14538396 dated 22/01/2021, which was valid upto 30.09.2023 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2021/14538366 dated 22/01/2021, which was valid upto 30.09.2021 for operation of stone crusher @ 3000 CFT/Day subject to the suitable conditions mentioned therein. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Thereafter, the Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act 1981 was revoked/cancelled vide no. 911 dated 26.04.2022 due to the non-submission of the mining certificate as per the decision no. 02 of the personal hearing held on 31.08.2021 in light of the instructions issued by the Board vide letter no. 16536 dated 23.07.2021 for processing the CTE/CTO applications for stone crushers/screening/washing plants.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Now, the unit has applied for obtaining fresh 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with compliance of previous consent granted to the unit, mining slips, undertaking regarding code of practice & legal mining and consent fee. The unit has submitted the CA certificate wherein the value of fixed assets of the unit as on 31.05.2022 is of Rs. 28.77 Lakhs with the value of plant and machinery of Rs. 24.65 lakhs. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">As per the record file, the unit has already deposited consent to operate fee under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 which was adequate upto 30.06.2024. The unit has deposited additional fee amounting to Rs. 14,500/- vide UTR no. SBIN222326665925 dated 22.11.2022 under the Air Act, 1981 and Rs. 14,500/- vide UTR no. SBIN222326541952 dated 22.11.2022 under the Water Act, 1974. As such, after deducting 100% penalty as late application fee, the fee is now adequate upto 30.06.2028 under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as per circular dated 29.10.2018. The certificate for air consent was inadvertently prepared upto 30.09.2021, however, consent was approved upto 30.09.2023. As such, penalty has not been imposed for the period 30.09.2021 to 26.04.2022.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 76.5pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Further, the unit has submitted the slips of obtaining raw material from <br />HP, verified by O/o Executive Engineer-cum-District Mining, Drainage cum Mining Division, Sri Anandpur Sahib dated 20.01.2023 regarding obtaining raw material from Himachal Pradesh through check post Khera Kalmot.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Further, the unit was visited by the AEE of this office on 31.03.2023 and Sh. Harvinder Singh, representative was contacted. During visit, it was observed as under:</span></p>
