The project proponent was granted Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2022/17292924 dated 10.03.2023, valid till 31.03.2023 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2022/17292915 dated 10.03.2022, valid till 31.03.2023 for Brown Bitumen @ 40.0 T/day, Emulsion Bitumen @ 40.0, T/day, Ceiling Bitumen @ 2.0 T/day, Bitumen Primer @ 2.0 T/day, Battery Bitumen @ 2.0 T/day by using Bitumen 80/100 grade @ 86 TPD, HCL @ 15.0 Liter/ day as raw material with special conditions as under: 1)      The industry shall be bound to comply with the order to be passed by the Hon’ble National Green Tribunal in O.A. no. 30 of 2013 titled ‘Karnail Singh & Ors. Vs. CPCB & Ors.' and O.A. no. 33 of 2013 titled ‘Jai Singh & Ors. Vs. U.O.I. & Ors. And, incase the Hon'ble National Green Tribunal directs the Board to curtail the period of validity of consent, the Board will be at liberty to curtail the validity of this consent as per order of the Hon'ble National Green Tribunal. 2)      The industry shall maintain record of operation of the electric evaporator system on daily basis and submit quarterly report of the record to the Board. 3)      The industry shall maintain record of water consumed on daily basis and make it available to the officer of the Board during the conduct of visit to the industry. 4)      The industry shall ensure that the sampling arrangements with the stacks are compliant as per the EPR-3 norms. 5)      The industry shall not discharge any effluent at any time or any other unauthorized place by any unauthorized means. 6)      The industry shall ensure the compliance of stipulations imposed at the time of allotment of plot and / or thereafter by the PSIEC. 7)      The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. Now, the project proponent has applied renewal of Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with requisite documents. The project proponent has submitted CA Certificate with the value of fixed assets of Rs. 1.99 crore on 31.03.2022. The project proponent has deposited Rs. 22,100/- vide UTR no. N024232012003083 dated 24.01.2023 under Water Act, 1974 and Rs. 21,600/- vide UTR no. N024232012002227 dated 24.01.2023 under Air Act, 1981, the consent fees under Water Act, 1974 is adequate till 31.03.2025 and consent fee under Air Act, 1981 is adequate till 31.03.2025. The project proponent has submitted compliance report of the previous Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 granted to it. The site of the industry visited by undersigned on 03.04.2023 and contacted Sh. Manoj, Supervisor (9592099633). During the visit, it was observed as under: 1.        The industry was not in operation. As per the physical condition it reveals that industry is lying non operational since long. The representative informed that they are presently doing trading of bitumen received by them from Kandla port through import . 2.        The industry has installed 4 no. bitumen heater for manufacturing of Ceiling Bitumen, Bitumen Primer and Battery Bitumen, and the representative of the industry informed that these are not being operated by the industry & are lying in redundant form. 3.        The industry has installed 02 no. DG sets of capacity 62.5 KVA & 42 KVA, which are equipped with canopies and stacks of adequate heights. 4.        The industry discharges domestic effluent generated into focal point sewer, which further leads to terminal STP of capacity 2 MLD being operated the PSIEC. 5.        The industry has primarily provided adequate Air pollution and Water pollution control arrangements but most of them found to corroded since the industry has not been operated since long. 6.        The industry has provided environmental data board outside the premises, but data was found missing. In view of above, it is recommended that ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted for short term i.e 31.12.2023 with special condition as under: 1.        The industry will do the maintenance of APCD and stacks which have corroded well before starting the operation. 2.        The industry will update the environmental data board provided outside the premises.   Competency: SEE
