CTOW/Fresh/LDH1/2017/5847643 dated 07.09.2017 valid up to 30.06.2021 with special conditions that the industry shall not install any tube-well for the abstraction of ground water without the permission from Central Ground Water Authority.</span></p> <p class="MsoNormal" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;"><span style="font-family: Tahoma, 'sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Thereafter the industry was again applied for renewal of consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 and was found non-complying, thereafter the industry has been issued show cause notice for refusal of consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 with an opportunity of personal hearing given before Worthy Member Secretary of the Board vide letter no. 437-38 dated 01.02.2022 and it was decided as under:-</span></p> <p class="MsoListParagraph" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; margin: 0in 28.5pt 0.0001pt 0.5in;"><em><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-style: normal; font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span></em><em><span style="font-family: Tahoma, 'sans-serif';">The Industry shall deposit Environmental Compensation amounting to Rs. 50000/- in place of Rs.&nbsp; 1.50 lac earlier imposed upon the industry, within 07 days.</span></em></p> <p class="MsoListParagraph" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; margin: 0in 28.5pt 0.0001pt 0.5in;"><em><span style="font-family: Tahoma, 'sans-serif';">2.<span style="font-style: normal; font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span></em><em><span style="font-family: Tahoma, 'sans-serif';">The industry shall make agreement with authorize re-processor having valid consent to operate/authorization of the Board for lifting of Spent acid (H2SO4), within 10 days</span></em></p> <p class="MsoNormal" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;"><span style="font-family: Tahoma, 'sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In compliance, the industry has deposited the Environmental Compensation of Rs. 50000/-vide receipt no. 16/5150 dated 15.02.2022. However, the industry has not made the revised agreement with authorize re-processor having valid consent to operate/authorization of the Board for lifting of Spent acid (H2SO4). The industry has informed that presently it is lifting its spent acid to M/s JBR Technology Kohara. As per the record of this office M/s JBR technology Kohara presently does not have valid consent valid consent to operate/authorization of the Board for lifting of Spent acid (H2SO4). and the application of the industry was refused.</span></p> <p class="MsoNormal" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;"><span style="font-family: Tahoma, 'sans-serif';">&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; The industry has later applied consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 after agreement with M/s JBR Technologies, Focal Point, phase-8. Ludhiana dated 19.10.2022.</span></p> <p class="TableParagraph" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;"><span style="font-family: Tahoma, 'sans-serif';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has deposited Rs. 72000/- vide online R no. N175211542376231 dated 24.06.2021 under water Act, 1974 Adequate upto 30.09.2025 (after refused under Water Act, 1974).</span></p> <p class="MsoNormal" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-right: -24.05pt; text-indent: 0.5in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The unit was visited by the officer of the Board on 11.11.2022 and observed as under:-</span></p> <p class="MsoListParagraphCxSpFirst" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; margin: 0in -24.05pt 0.0001pt 49.5pt;"><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The industry was in operation and was engaged in pickling.</span></p> <p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; margin: 0in -24.05pt 0.0001pt 49.5pt;"><span style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The industry is using HCL for pickling and no record regarding lifting of spent acid has been maintained nor was available at site.</span></p> <p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; margin: 0in -24.05pt 0.0001pt 49.5pt;"><span style="font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The industry has now applied for Consent to Operate under Water (Prevention &amp; Control of Pollution) Act, 1974 and has made fresh agreement for lifting of spent HCL/effluent with M/s JBR Technology Pvt. Ltd., (Unit-II), Kohara Ludhiana on 19.10.2022.</span></p> <p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; margin: 0in -24.05pt 0.0001pt 49.5pt;"><span style="font-family: Tahoma, 'sans-serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The representative informed that they have recently started their process, but they were unable to give any concrete proof regarding non operation of the industry since long.</span></p> <p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; margin: 0in -24.05pt 0.0001pt 49.5pt;"><span style="font-family: Tahoma, 'sans-serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">Perusal of above reveals that the industry might have been in operation and is either disposing of spent HCL/effluent by unfair means or in case as per agreement the effluent is lifted by M/s JBR Technology Pvt. Ltd., (Unit-II), Kohara Ludhiana, even though the industry as well as M/s JBR Technology Pvt. Ltd., (Unit-II), Kohara Ludhiana are non-complying with the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974.</span></p> <p class="MsoListParagraphCxSpLast" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; margin: 0in -24.05pt 0.0001pt 49.5pt;"><span style="font-family: Tahoma, 'sans-serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">Further, the CETP operator has been barred by the Competent Authority of the Board for making fresh agreements for lifting of spent acid/HCL, but the CETP operator has failed to comply with the directions of the Board and made the agreement.</span></p> <p class="MsoNormal" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-right: -24.05pt; text-indent: 0.5in;"><span style="font-family: Tahoma, 'sans-serif';">It is pertinent to mention here that spent HCL/sulfuric acid has been defined as hazardous waste category 12.2 as per schedule-I of Hazardous Wastes (Management Handling &amp; Transboundary Movement) Rules, 2016. But, the CETP operator/ M/s JBR Technology Pvt. Ltd., (Unit-II), Kohara Ludhiana are not having authorization under said rules for lifting and processing of hazardous waste category 12.2.</span></p> <p class="MsoNormal" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-right: -24.05pt; text-indent: 0.5in;"><span style="font-family: Tahoma, 'sans-serif';">As such the industry as well as the CETP operator are not complying with the Hazardous Wastes (Management Handling &amp; Transboundary Movement) Rules, 2016.</span></p> <p style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;"><span style="font-size: 11pt; font-family: Tahoma, 'sans-serif';">Accordingly, the Consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 of the industry was refused and further action has been recommended through e-noting.&nbsp;</span></p> <p style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;"><span style="font-size: 11pt; font-family: Tahoma, 'sans-serif';">Now, the industry has again applied for&nbsp;</span><span style="font-family: Tahoma, 'sans-serif'; font-size: 14.6667px;">Consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 whereas the action after refusal of previous application is still under process. The personal hearing has been given to the industry, proceedings of which are yet to receive. As such, the application may be sent to Zonal Office for uploading the proceedings, please.</span></p>
