<p>RO has reported that earlier, the project proponent has obtained consent to establish (NOC) for the establishment of a residential housing project bearing no. ZO-ASR/ASR/Colony/NOC/2012/F-241 dated 20/01/2012, which was valid up to 19/01/2013. The project proponent had applied for the extension of the NOC time to time and the same was granted latterly up to 19/01/2017.</p>
<p>As per the new policy of the Board, the NOC of an industry / project may not be extended beyond the period of 5 years. Thereafter the project proponent applied for fresh consent to establish and same was granted vide Boards no. CTE/Fresh/ASR/2018/7017217 dated 20.03.2018, valid upto 19.01.2019 for establishment of residential colony containing 484 residential plots including EWS flats and club building.</p>
<p> </p>
<p>Now, the project proponent has applied for fresh NOC from pollution angle for establishment of residential colony containing 484 residential plots. Details of the case are as under:</p>
<p>1. The project proponent has submitted copy of EC granted vide no, SEIAA/PB/MIS/2022/EC/16 dated 13.07.2022, wherein the Company M/S ATM ESTATES PVT. LTD will develop 484 residential flats including EWS flats and club building in a land area of 32685.28 sqm with built up area of 65343.18 sqm and green area of 5350.989 sqm. Further mentioned that there will be water demand of 333 KLD ( fresh water 220 KLD and flushing water 113 KLD) met through borewell and treated water through STP.</p>
<p>2. The project proponent has submitted feasibility report, wherein waste water generation of 266 KLD will be treated in the proposed STP of capacity 300 KLD and treated water will be re-used for various purposed such as Flushing, horticulture and the remaining will be discharged into MC sewer. Components of the proposed STP consists of Bar Screens – Oil & Grease Chamber – Equalization Tank – MBBR – Secondary Tube Settler – SDB – CCT – Filters – Treated Water Tank, Principally seems adequate, can adjudge after the installation of the same.</p>
<p>3. The project proponent has submitted CA certificate of the proposed fixed assets of Rs. 137.46 crores. It has deposited Rs. 432000 vide R.no. N045232332395594 dated 14.02.2023 as NOC fee, valid for a period upto 31.12.2023 including the NOC fee for the years 2020-21, 2021-22, 2022-23.</p>
<p>4. The project proponent has submitted a letter issued by Municipal Town Planner, Municipal Corporation, Amritsar bearing no. 1588 dated 27.07.2018 regarding the issuance of CLU regarding the project and the approved building plan for covered area.</p>
<p> </p>
<p>The proposed site of the project was visited by this office on 22/03/2023 and observed as under:-</p>
<p>1. The site falls on the left side of G.T. Road at Village- Daburji in the premises of residential project of M/s Shubham Enclave.</p>
<p>2. The project proponent has constructed the structures of multi-storyed flats in the nos. of 350 approx. Finishing of about 50 no. flats has been done. During visit, representative of the establishment informed that due to Covid pandemic the construction work has been lying off for the last 2.5 years and it has been re-started now only. </p>
<p>3. At present about 12 no. flats have been occupied. The establishment has provided septic tank for treatment of domestic effluents generated from these flats. The site for the installation of STP is reserved but no construction work or installation of mechanical components exists there. Representative of the establishment during visit informed that they have placed work order regarding installation of STP.</p>
<p>4. A D.G. set of capacity 220 KVA has been installed, which is fitted with canopy.</p>
<p> EEZO has made following observations:-</p>
<p>1. The Regional Office has not mentioned about the specific siting guidelines framed by the Board for the residential project.</p>
<p>2. The project proponent has uploaded its CA certificate for the year 2021 not the fresh one.</p>
<p>3. Regional Office has not mentioned about solid waste and hazardous waste management under the respective rules.</p>
<p>4. Regional Office has not mentioned about the NOC for ground water extraction.</p>
<p> </p>
<p>5. Regional Office has not uploaded EC granted by MoEF & CC.</p>
<p>RO has replied as under:-</p>
<p>1. As per policy regarding siting criteria, there was no rice sheller, saila plant and stone crusher exists within 500 mts. and no brick kiln, hot mix plant, cement plant, cement grinding unit exists within 300 mts.</p>
<p>2. The project proponent was contacted regarding the same and he has informed that after the receiving of revised EC, they have included all the cost incurred on the project till date and the proposed cost to be incurred during finishing of project in the submitted CA certificate. As such the cost of the proposed project has already been included, therefore fresh CA certificate is not required.</p>
<p>3. At present about 12 no. flats have been occupied and the industry has been maintaining solid waste and hazardous waste as per provisions of the SWM Rules, 2016 and Hazardous and Other Waste (Management & Transboundary Movement) Rules, 2016 and as per the provisions/directions mentioned in the Environment Clearance granted.</p>
<p>4. The project proponent was contacted regarding the same and he has informed that NOC for ground water extraction granted by CGWA has been expired and they have applied for fresh NOC for ground water extraction to the PWRDA.</p>
<p>5. Copy of EC granted to the industry attached herewith.</p>
<p>RO has recommended that consent to establish (NOC) from pollution angle may be granted to the project up to the period of 31/12/2023 subject to the suitable conditions and specific as under:</p>
<p>1. The project proponent shall complete the installation of STP for treatment of domestic effluent of the colony before any further habitation in the colony. </p>
<p>2. The project proponent shall develop adequate plantation/green area as per mentioned in the EC granted and shall provide flow meters at the water sources, treatment source, re-circulation source and MC disposal sources before its commissioning. </p>
<p>3. The project proponent shall comply with the condition of the EC granted vide no. SEIAA/PB/MIS/2022/EC/16 dated 13.07.2022 and shall obtain clearances from the concerned departments/Authority as required.</p>
<p>Keeping in view of above, it is recommened that consent to establish (NOC) from pollution angle may be granted to the project up to the period of 31/03/2024 subject to the suitable conditions and specific as under:</p>
<p>1. The project proponent shall complete the installation of STP for treatment of domestic effluent of the colony before any further habitation in the colony. </p>
<p>2. The project proponent shall develop adequate plantation/green area as per mentioned in the EC granted and shall provide flow meters at the water sources, treatment source, re-circulation source and MC disposal sources before its commissioning. </p>
<p>3. The project proponent shall comply with the condition of the EC granted vide no. SEIAA/PB/MIS/2022/EC/16 dated 13.07.2022 and shall obtain clearances from the concerned departments/Authority as required.</p>
<p>4. The project proponent shall obtain the fresh NOC for ground water extraction from the PWRDA. </p>
