<p class="MsoBodyText" style="text-align: justify; text-indent: 1.0in; line-height: 115%; margin: 0in 10.25pt .0001pt 19.0pt;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">It is submitted that the subject cited industry is a small scale induction furnace unit under orange category. The industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/FGS/2021/16532496 dated 21/10/2021 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/FGS/2021/16532446 dated 18/10/2021 valid upto 30/09/2022 for the manufacturing of Steel Ingots @ 72 T/day with suitable conditions.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 1.0in; line-height: 115%; margin: 9.65pt 10.25pt .0001pt 19.0pt;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">It is pertinent to mention here that the industry was given personal hearing by the Chairman of the Board u/s 31-A of the Air Act, 1981 on 12/01/2023 and notice for imposition of Environmental compensation (EC) due to the environmental damaged caused by operation of the industry was also issued. After hearing, it was decided as under:</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1; margin: 0in 10.25pt .0001pt 76.5pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">Environmental compensation amounting to Rs. 4.0 Lacs be imposed upon the industry and the industry shall deposit the same within a week at Regional Office, Fatehgarh Sahib.</span></p>

<p class="MsoBodyText" style="text-align: justify; text-indent: -13.5pt; margin: 0in 10.25pt .0001pt 1.0in;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">2. It was made clear to the industry, if the industry falls to comply with aforesaid decisions and any Environmental Law in future, punitive action will taken against the industry, which include closure of the unit.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -13.5pt; margin: 0in 10.25pt .0001pt 1.0in;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">5. Environmental Engineer, Regional Office, Fatehgarh Sahib shall visit the industry after the one week, to verify the submission made during hearing and process the consent application of the industry on merits.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 1.0in; line-height: 115%; margin: 9.65pt 10.25pt .0001pt 19.0pt;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The proceedings were conveyed to the industry vide Board’s. Letter no. 359 dated 30/01/2023. </span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 1.0in; line-height: 115%; margin: 9.65pt 10.25pt .0001pt 19.0pt;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">In compliance decision no. 1 of the hearing, the industry has deposited EC of Rs. 4.0 Lakhs vide no. 23/5513 dated 06/02/2023.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 1.0in; line-height: 115%; margin: 9.65pt 10.25pt .0001pt 19.0pt;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">In compliance decision no. 2 of the hearing, the industry has applied for renewal of 'consent to operate' under the Water Act, 1974 and under the Air Act, 1981, .with requisite documents through OCMMS under orange category. </span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 1.0in; line-height: 115%; margin: 9.65pt 10.25pt .0001pt 19.0pt;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The consent fee deposited is Rs. 1080/- each vide R. No. 138910554 & 723676771 dated 08/12/2022, Rs. 23220/- each vide R. No. 390027716 under Water Act, 1974 & 188810590 dated 08/02/2023 under the Air Act, 1981 is adequate upto </span><strong><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">30/09/2024,</span></strong><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;"> as per Board's Office Order dated 29/10/2018 against the un- depreciated fixed assets of Rs. 494.91 Lacs as on 30/11/2022 as per CA certificate dated 05/12/2022 after deducting penalty charges 25%. </span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 1.0in; line-height: 115%; margin: 9.65pt 10.25pt .0001pt 19.0pt;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">There is increase in the cost of fixed asset by about Rs. 69.00 lacs. The industry has deposited NOC regularization fee Rs. 3600/- R. No. 138910554 dated 08/12/2022, which is adequate. The industry has submitted vide letter dated 8/12/2022 that the increase is due to electromagnetic, CI bottom plate, HR Sheet and others etc.</span></p>
<p class="MsoListParagraph" style="margin-left: 0in; text-indent: 1.0in;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">The industry has got its stack emission analysis carried out by from Board lab on 03/03/2022 and as per report, the concentration of SPM is 62 mg/Nm3, which is with permissible limits.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"> To verify the contents of the application the industry was visited by AEE of this office on 06/04/2023 and contacted Sh. Lokesh Rana, Partner of the industry at site. During visit, it was observed as under:</span></p>

<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"> The Board vide letter no. 1955-57 dated 18/01/2023 has informed that department of Water Resources (RD and GR), Central Ground Water Authority, Ministry of Jal Shakti Govt. of India, New Delhi under Section 5 of the Environment (Protection) Act, 1986 has issued directions vide order dated 6/4/2022 that “It shall be mandatory for the project proponent abstracting ground water to obtain No objection Certificate from Central Ground Water Authority or the concerned State/UT Ground Water Authority as the case may be in the compliance conditions in consent to operate and consent to establish issued by the State pollution control Board”</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 1.25in; line-height: 115%; tab-stops: 7.0in; margin: 9.8pt 2.5pt .0001pt 0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoBodyText" style="margin-top: 9.8pt; text-align: justify; text-indent: 87.7pt; line-height: 115%; tab-stops: 7.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries.</span></p>
<p class="MsoBodyText" style="margin-top: 9.8pt; text-align: justify; text-indent: 87.7pt; line-height: 115%; tab-stops: 7.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The industry has claimed that it has taken adequate steps to comply with provision of the Air Act, 1981 and operate its APCD efficiently but the compliance w.r.t. its claim shall be checked when the industry is in operation.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"> In view of above mentioned facts, if approved, Senior Environmental Engineer, Zonal Office-2, Patiala may be recommended that renewal of 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 for production of Steel Ingots @ 72 MTD, may be granted to the industry upto <strong>30/09/2024</strong> with suitable conditions and following special conditions:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 49.5pt; mso-add-space: auto; text-indent: -27.0pt; line-height: 115%; mso-pagination: widow-orphan; mso-list: l2 level1 lfo3; text-autospace: ideograph-numeric ideograph-other;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The industry shall comply with the guidelines/SOPs provided by PSCST, Chandigarh in the effective operation of APCD.</span></p>
