<p>It is submitted that the subject cited industry is a small scale rolling mill unit and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/FGS/2018/8287126 dated 30/08/2018, valid upto 30/09/2022 & under the Air Act, 1981 vide no. CTOA/Renewal/FGS/2021/17376364 dated 26/11/2021, valid upto 30/06/2022 with suitable conditions mentioned therein. Now, the industry has applied for obtaining renewal of consent to operate under the Water Act, 1974 & under the Air Act, 1981 with requisite documents through OCMMS under orange category. The industry has already deposited consent fee of Rs. Rs. 4350/- each vide no. 715913600 & 525948073 dated 22/02/2023 & Rs. 2800/- each vide R. No. 744063445 & 432756696 dated 02/03/2023 under Water Act, 1974 & Air Act, 1981 against the undepreciated fixed assets of Rs. 49.73 Lacs as on 20/02/2023 as per CA certificate dated 21/02/2023, which is adequate upto 30/09/2024 and Rs. 625/- is lying excess with the Baord under the Water Act, 1974 (after deducting penalty charges 25%) and upto 31/12/2023 under the Air Act, 1981 as peroffice order dated 29/10/2018( after deducting penalty charges 50%). The industry has submitted stack emission analysis report from NABL lab on 09/02/2023 and as per analysis report the SPM level was found 91.4 mg/Nm3 which is within the prescribed limit of 150 mg/Nm3. In the meeting held under the Chairmanship of Shri Vijay Kumar Janjua, Chief Secretary, Punjab with the representatives of rolling mills operating in Mandi Gobindgarh Area on 30/12/2022 at 12:00 noon regarding their conversion of fuel from Coal/Furnace Oil to PNG, it was unanimously decided that the rolling mills operating in Mandi Gobindgarh area may be granted relaxation for some time for converting from their conventional fuels to cleaner fuels and the Competent Authority of the Board may consider/ decide regarding extending the validity of the Consents to Operate till finalization of State Fuel Policy or 31/12/2023, whichever is earlier subject to suitable conditions. ਭਾਨਮਗ ਕਫਨਨਟ ਭੰ ਤਯੀ, ਨਿਨਗਆਨ, ਤਕਨਾਰਜੀ ਅਤਿਾਤਾਿਯਣ ਨਿਬਾਗ, ੰ ਜਾਫ ਦੀ ਰਧਾਨਗੀ ਹਠ ਭੰ ਡੀ ਗਨਫੰਦਗੜ੍ਹਅਤਖੰ ਨਾਂ ਖਤਯ ਨਿਿੱ ਚ ਚਿੱ ਰ ਯਹੀਆਂਯਨਰੰ ਗ ਨਭਿੱ ਰਾਂ ਦਨੁਭਾਇੰ ਨਦਆਂ ਨਾਰ ਕਰਾ/ਿਯਨੈ ਸ ਆਇਰ ਤੋਂ ੀ.ਐਨ.ਜੀ ਨਿਿੱ ਚ ਤਫਦੀਰੀ ਸਫੰ ਧੀ ਨਭਤੀ 09/01/2023 ਨੂੰ ਫਾਅਦ ਦੁਨਹਯ 03:30 ਿਜਹਈ ਭੀਨਟੰ ਗ ਨਿਿੱ ਚ ਨਿਸਨਤਰਤ ਚਯਚਾ ਤੋਂਫਾਅਦ ਸਯਫਸੰ ਭਤੀ ਨਾਰ ਪਸਰਾ ਕੀਤਾ ਨਗਆ ਨਕ ਭੰ ਡੀ ਗਨਫੰ ਦਗੜ੍ ਅਤਖੰ ਨਾ ਖਤਯ ਨਿਿੱ ਚ ਚਿੱ ਰ ਯਹੀਆਂ ਯਨਰੰ ਗ ਨਭਿੱ ਰਾਂ ਨੂੰ 30/12/2022 ਨੂੰ ਭੁਿੱ ਖ ਸਕਿੱ ਤਯ ਦੀ ਰਧਾਨਗੀ ਹਠ ਹਈ ਭੀਨਟੰ ਗ ਨਿਿੱ ਚ ਨਹਰਾਂ ਹੀ ਰਏ ਗਏ ਪਸਰਦ ਅਨੁਸਾਯ ਆਣਯੰ ਯਾਗਤ ਫੰ ਧਨ ਤੋਂਸਾਫ਼-ਸੁਥਯਫੰ ਧਨ ਨਿਿੱ ਚ ਫਦਰਣਾ ਜਾਂ ਯਾਜ ਦੀ fuel policy ਨੂੰ ਅੰ ਨਤਭ ਯੂ ਦਣ ਤਿੱ ਕ, ਜਿੀ ਨਹਰਾਂ ਹਿ, 31/12/2023 ਤਿੱ ਕ ਛਟ ਨਦਿੱ ਤੀ ਜਾ ਸਕਦੀ ਹ। The Board vide letter no. 1955-57 dated 18/01/2023 has informed that department of Water Resources (RD and GR), Central Ground Water Authority, Ministry of Jal Shakti Govt. of India, New Delhi under Section 5 of the Environment (Protection) Act, 1986 has issued directions vide order dated 6/4/2022 that “It shall be mandatory for the project proponent abstracting ground water to obtain No objection Certificate from Central Ground Water Authority or the concerned State/UT Ground Water Authority as the case may be in the compliance conditions in consent to operate and consent to establish issued by the State pollution control Board” The Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under: The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries. PPCB vide office order no. CEE(HQ)/F.No.957/2016/59 dated 02/02/2016 has decided that the Board shall grant renewal of NOC / Consent to operate within 7 days to all types of industries falling under Orange and Green category, without visiting the industry on the basis of submission of documents self attested by the Owner / Director /Managing partner of industry and deposition of fee prescribed by the Board for such type of industries. The data, processes and pollution control measures installed by the industry shall be verified at a later date by visiting the site as per inspection guidelines. Further, as per PPCB office order no. 443 dated 09.08.2021, the Board in its 185th meeting held on 07.01.2021 has decided to extend the facility for auto generated renewal to all categories of small scale industries / projects, without inspection / physical verification of the environmental parameters at the time of application(s). If approved, Senior Environmental Engineer Zonal Office – II, Patiala may be recommended that 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31/12/2023 with special conditions that: 1. The industry shall be liable to comply with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. 2. The industry shall shift from its conventional fuel to cleaner fuel latest by 31/12/2023 or finalization of State Fuel Policy, whichever is earlier. 3. The industry shall be bound to apply online for grant of Terms of Reference (ToR) on or before 19/07/2023 in compliance to notification no. S.O. 3250(E) dated 20.07.2022 of MoEF & CC and obtain Environmental Clearance, failing which this 'consent to operate' shall stand revoked/cancelled automatically.</p> |
