CTOA/Renewal/FZL/2016/4873504 dated 21/12/2016, valid upto 30/09/2026 for operation of brick kiln with bulls trench kiln (BTK) technology for production of bricks & tiles @ 30,000 nos./day, subject to the conditions mentioned therein. </span></p>
<p class="normalCxSpMiddle" style="margin-right: 1.35pt; mso-add-space: auto; text-align: justify; line-height: 150%; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black;"><span style="mso-spacerun: yes;"> </span>The Hon’ble NGT, New Delhi vide its order dated 24.10.2018 passed an order in the matter of Punjab Brick Kiln Owner Association V/s State of Punjab & Ors. (Appeal No. 251/2018) wherein it was decided that all the brick kiln in the State of Punjab will remain closed till 31.01.2019 and can only start operating after installing the new induced draft zig-zag technology. A public notice was also given in all the leading daily newspapers regarding orders dated 24.10.2018 passed by the Hon’ble NGT, New Delhi to aware the brick kilns.</span></p>
<p class="normalCxSpMiddle" style="margin-right: 1.35pt; mso-add-space: auto; text-align: justify; line-height: 150%; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black;"><span style="mso-spacerun: yes;"> </span>A no. of complaints were received telephonically regarding illegal operation of brick kilns in Fazilka area in violation of the orders. Accordingly, the brick kiln was visited by AEE of this office on 06.02.2019 and it was observed that the brick kiln was in operation. The brick kiln has not adopted induced draft zig-zag technology. Crushed Coal/Guar was being used as fuel in its kiln, during visit. Since the owner of the brick kiln is violating the provisions of the Air Act, 1981 as well as orders dated 24.10.2018 by operating without valid consent to operate and without adopting induced draft zig-zag technology. Accordingly, consent to operate under the Air Act, 1981 granted to it was revoked vide this office letter no. 536-37 dated 07.02.2019 with a copy to the District Food Supplies & Consumer Affairs (DFSC), Fazilka. Also, directions u/s 31-A of the Air Act, 1981 were issued to the subject cited defaulting brick kiln for its closure vide Board’s office letter no. 1155 dated 20.02.2019 with further directions to the District Food Supplies & Consumer Affairs (DFSC), Fazilka for cancellation of license issued by their Department to the brick kiln vide Board’s office letter no. 1159 dated 20.02.2019.</span></p>
<p class="normalCxSpMiddle" style="margin-right: 1.35pt; mso-add-space: auto; text-align: justify; line-height: 150%; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; color: black;"><span style="mso-spacerun: yes;"> </span>The State Govt., Department of Science, Technology & Environment vide order no. 10/482019-STE(5)/1491422/1 dated 28.05.2019 issued directions to all the brick kilns falling within non-attainment cities of the State that no conventional brick kiln with natural draft/ Bull Trech Kiln (BTK) technology shall be allowed to operate beyond 30.09.2019 along with directions of those brick kilns to pay environmental compensation w.e.f. 01.02.2019, if they do not start convention/ converted to induced draft technology with zig-zag setting within this period i.e. 01.02.2019 to 30.09.2019.</span></p>

However<span style="color: black;">, neither the brick kiln submitted MOU/agreement/feasibility report with any of the technical providers (PSCST/CBRI) for conversion to induced draft technology with zig-zag setting nor deposited any environmental compensation in this office till date. Also, the brick kiln does not have valid consent to operate under the Air Act, 1981. Thus, the brick kiln is violating the provisions of the Air Act, 1981 not having valid consent to operate under the said Act, directions dated 24.10.2018 of the Hon’ble NGT, New Delhi and State Govt. dated 28.05.2019 deliberately and willfully. Therefore, vide this office letter no. 4661-62 dated 14.10.2019, DFSC, Fazilka was requested to cancel the license of brick kiln immediately so as to comply with the directions of the State Govt. with a copy to the Deputy Commissioner, Fazilka with a request to direct the concerned official for cancellation of license of the said brick kiln. However, still no reply was received from the DFSC, Fazilka. </span></span></p>
<p class="MsoNormalCxSpFirst" style="margin-right: 1.35pt; mso-add-space: auto; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;"><span style="mso-spacerun: yes;"> </span></span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">A complaint was received on 27.02.2020 regarding operation of kiln without ID zig-zag technology, accordingly the kiln was visited on 29.02.2020 and found that brick kiln was in operation with convention FCBTK technology i.e. without adopting ID zig-zag technology i.e. the complaint was found genuine.</span></p>

The brick kiln has adopted induced draft technology. Agricultural waste was also being used for operation of kiln alongwith coal. </span></p>

AVFD fan has been provided with the chimney and the length of the brick kiln (central island was less than 245 feet. </span></p>

But, till date the industry has failed to apply for the same. </span></p>
<p class="MsoNormalCxSpMiddle" style="text-align: justify; line-height: 150%; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;"> </span>Since the owner of the brick kiln is operating the brick kiln without obtaining varied consent to operate under the Water Act, 1974 and the Air Act, 1981 has failed to deposit Environmental Compensation (EC). Accordingly, the matter has been considered by the Competent Authority of the Board and decided to issue notice u/s 37(I) and 41 of the Air Act, 1981 to the brick kiln & DFSC, Fazilka with an opportunity of personal hearing before the Hon’ble Chairman of the Board on 08.09.2022.<span style="mso-spacerun: yes;"> </span>But neither any representative of the brick kiln attended the hearing nor submitted any reply in the matter.</span></p>
<p class="MsoNormalCxSpMiddle" style="text-align: justify; line-height: 150%; background: white;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;"> </span>No officer / official from the Deptt. of Food, Civil Supplies & Consumer Affairs attended the hearing.</span></p>
<p class="MsoNormalCxSpMiddle" style="text-align: justify; line-height: 150%; background: white;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;"> </span>During hearing, representatives of the brick kiln stated that they have adopted induced draught zig-zag technology & obtained completion certificate and requested to give one week for submission of consent applications alongwith deposit of environmental compensation. They also assured that no un-authorized fuel shall be used in the brick kiln at any time.</span></p>
<p class="MsoNormalCxSpMiddle" style="text-align: justify; line-height: 150%; background: white;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;"> </span>After hearing the representatives of the brick kiln as well as officer of the Board, the Chairman of the Board has decided that:</span></p>

(1) above of the hearing within stipulated period and/or use of un-authorized fuel at any time, further action for closure of brick kiln shall be taken without giving any further notice / opportunity.</span></p>

No. CBINR52022090710 dated 07/09/2022, which is adequate.</span></p>

However, the brick kiln is making kutcha bricks at site. No fuel was found at kiln site. The representative of the brick kiln informed that the DFSC has not restored their license as the BKO does not have consent to operate of the Board and after the consent from the Board, license will be restored/ validated.
