CTOA/Renewal/FZL/2016/4852573 dated 21/12/2016, valid upto 30/09/2026 for operation of brick kiln with bulls trench kiln (BTK) technology for production of bricks & tiles @ 30,000 nos./day, subject to the conditions mentioned therein. <span style="color: black;"><span style="mso-spacerun: yes;"> </span></span></span></p>
<p><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p class="normalCxSpFirst" style="margin-right: 1.35pt; mso-add-space: auto; text-align: justify; line-height: 150%; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><span style="mso-spacerun: yes;"> </span>The brick kiln was made aware of these directions dated 28.05.2019 of the State Govt. along with a request to submit compliance regarding work for conversion to induced draft technology with zig-zag setting along with deposition of environmental compensation vide this office letter no. 4362 dated 29.08.2019. However, no reply was received from the brick kiln. </span></p>
<p><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p class="normalCxSpMiddle" style="margin-right: 1.35pt; mso-add-space: auto; text-align: justify; line-height: 150%; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><span style="mso-spacerun: yes;"> </span>Thereafter, the brick kiln was visited by officer of the Board on 31.08.2019 and Sh. Sada Nand, Partner of the brick kiln was contacted. During visit, it was observed that the brick kiln was not in operation. The brick kiln has not started any work for conversion of brick kiln from BTK technology to induced draft technology with zig-zag setting. Accordingly, show cause notice was issued for revocation/ cancellation of consent to operate granted under the Air Act, 1981, by this office vide letter no. 4537 dated 05.09.2019. </span></p>
<p><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p class="normalCxSpMiddle" style="margin-right: 1.35pt; mso-add-space: auto; text-align: justify; line-height: 150%; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><span style="mso-spacerun: yes;"> </span>The kiln neither applied for varied consent to operate for operation of brick kiln with induced draft technology with zig-zag setting nor it has deposited environmental compensation fee in this office. Accordingly, consent to operate under the Air Act, 1981 was cancelled vide this office letter no. 745 dated 29.01.2020. </span></p>
<p><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p class="normalCxSpMiddle" style="margin-right: 1.35pt; mso-add-space: auto; text-align: justify; line-height: 150%; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><span style="mso-spacerun: yes;"> </span>To verify the compliance status the brick kiln, the kiln was visited by AEE on 11.04.2022 and it was observed as under:– </span></p>

Bricks are lying in a zig-zag way. Agricultural waste was also being used for operation of kiln alongwith coal. </span></p>
<p><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p class="normalCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo1; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes; margin: 0in 1.35pt .0001pt .25in;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><span style="mso-list: Ignore;">2.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-kerning: auto; font-language-override: normal; font-feature-settings: normal;"> </span></span>The brick kiln has upgraded its kiln into induced draft zig-zag technology, however no completion drawing has been submitted in this regard. AVFD fan has been provided with the chimney and the length of the brick kiln (central island was less than 245 feet. </span></p>

<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><span style="mso-spacerun: yes;"> </span><span style="font-size: 11pt; line-height: 150%; background: white;">In view of above, the brick kiln has been afforded an opportunity of personal hearing u/s 31-A of Air Act, 1981 on 15.06.2022 (postponed to 30.06.2022 & further postponed to 5.7.2022).</span></span></p>
<p><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><span style="mso-spacerun: yes;"> </span><span style="font-size: 11pt; line-height: 150%; background: white;">During hearing, representative of the brick kiln stated that they have suffered loss in the year 2020 due to Covid-19 pandemic and further in the year 2021 due to rains. He requested to give one week time for submission of consent applications.</span></span></p>
<p><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><span style="mso-spacerun: yes;"> </span><span style="font-size: 11pt; line-height: 150%; background: white;">After considering the request made by the representative of the brick kiln, it has been decided by the Chairman of the Board that:</span></span></p>
<p><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in 6.0pt .5in;"><span style="font-size: 11pt; line-height: 150%; font-family: tahoma, arial, helvetica, sans-serif; background: white;">1.<span style="mso-tab-count: 1;"> </span>The brick kiln shall submit applications for obtaining 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 alongwith completion certificate issued by the technology provider and also deposit EC alongwith the consent applications.</span></p>
<p><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in 6.0pt .5in;"><span style="font-size: 11pt; line-height: 150%; font-family: tahoma, arial, helvetica, sans-serif; background: white;">2.<span style="mso-tab-count: 1;"> </span>RO shall process the consent applications to be submitted by the brick kiln, on merits. </span></p>
<p><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p class="MsoNormalCxSpFirst" style="margin-right: 7.3pt; mso-add-space: auto; text-align: justify; line-height: 150%;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><span style="mso-spacerun: yes;"> </span>The proceedings of the personal hearing were conveyed the brick kiln for compliance of hearing decisions vide Zonal Office letter no. <span style="background: white;">3613 dated 22.07.2022</span>. </span></p>
<p><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p class="MsoNormalCxSpMiddle" style="margin-right: 7.3pt; mso-add-space: auto; text-align: justify; line-height: 150%;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><span style="mso-spacerun: yes;"> </span>Since, the brick kiln has neither submitted applications for obtaining <span style="background: white;">'consents to operate' under the Water Act, 1974 & the Air Act, 1981 nor submitted/ deposited completion certificate/ environmental compensation. Accordingly, directions u/s 31-A of the Air Act, 1981 has been issued to the brick kiln vide Zonal Office letter no. 4969 dated 18.10.2022. Also, DFSC, Fazilka was directed to suspend the license issued by the brick kiln with immediate effect and not to restore/ issue the license of the brick kiln without consent of the Board under the Air Act, 1981 vide<span style="mso-spacerun: yes;"> </span>Zonal Office letter no. 4972 dated 18.10.2022. The license of the brick kiln cancelled by DFSC Fazilka on 09.03.2023. </span></span></p>
<p><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p class="MsoNormalCxSpLast" style="margin-right: 7.3pt; mso-add-space: auto; text-align: justify; line-height: 150%;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><span style="mso-spacerun: yes;"> </span>Now, the brick kiln has applied<span style="mso-bidi-font-family: Arial;"> for obtaining fresh consent to operate under the Water Act, 1974 and varied consent to operate under the Air Act, 1981 on dated 20.03.2023, for its operation after adopting induced draft technology with zig-zag firing to manufacture bricks and tiles @ 30,000 nos./day. Details of the case are as under:-</span></span></p>

Therefore, we cannot maintain coal register and submitting the self declaration certificate. </span></p>

<p><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: -.2in; line-height: 150%; mso-list: l4 level1 lfo3; margin: .3pt 7.3pt .0001pt .5in;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><span style="mso-list: Ignore;">6.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-kerning: auto; font-language-override: normal; font-feature-settings: normal;"> </span></span>That in case any irregularity / discrepancy is found In this undertaking, the Punjab Pollution Control Board has right to withdraw / cancel consents granted to the brick kiin or to take action against the brick kiln and its responsible persons operating the kiln, as deemed fit under the provision of law. </span></p>
