It is submitted that Consent to operate under the Air Act, 1981 was granted to the brick kiln vide no. R15FZLCTOA2480749 dated  17/03/2015, valid upto 30/09/2019 for operation of brick kiln with bulls trench kiln (BTK) technology for production of bricks & tiles @ 30,000 nos./day, subject to the conditions mentioned therein.                                         The order dated 28.05.2019 issued by the Government of Punjab, Department of Science, Technology and Environment was also conveyed to the brick kilns vide Board's letter no. 4368 dt. 29.08.2019 for compliance and for deposition of Environmental Compensation, however no reply was received in the matter.                                         The brick kiln was visited by the officer of the Board on 01.10.2019 and it was found that the brick kiln was in operation without adopting induced draft zig-zag technology.                                         The brick kiln was thus in operation in violation of orders dated 24.10.2018 of the Hon’ble National Green tribunal, New Delhi and the order dated 28.05.2019 of the Government of Punjab. Department of Science, Technology and Environment and was operating without valid consent to operate of the Board as required under the Air Act, 1981.                                         Directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 were issued to the BKO to stop its operation immediately failing which legal action will be initiated against the brick kiln as well as the direction to the District Food & Civil Supplies Officer, Department of Food, Civil Supplies & Consumer Affairs, Fazilka to cancel the license of the brick kiln, vide Board's letter nos. 4943 & 4947 dt. 11.10.2019, respectively.                                         A complaint was also received telephonically that the brick kiln was in operation with old FCBTK technology i.e. without adopting induced draft zig-zag technology. To verify the contents of the complaint, the brick kiln was again visited by officer of the Board on 14.05.2020 and it was observed that the brick kiln was in operation without adopting Induced draft zig-zag technology.                                         The matter was considered by the Competent Authority of the Board and it has been decided that legal action may be taken against the brick kiln under section 37 (I) of the Air Act, 1981 as well as the District Food & Civil Supplies Officer, Department of Food, Civil Supplies & Consumer Affairs, Fazilka under section 41 of the said Act for non complying with the directions issued to them under section 31-A of the Air Act, 1981 after giving an opportunity of show cause with personal hearing before the Chairman of the Board.                                         Sh. Gurpreet Singh Kang, DFSC submitted that he has joined as DFSC, Fazilka just 7 days ago and is not much aware regarding the details of the case, however assured that the compliance of the directions issued by the Board u/s 31-A of the Air Act, 1981 will be done within one week.                                         Sh. Ankushdeep, representative submitted that the industry has already deposited Environmental Compensation of Rs.2.00 lacs with the Board and has also obtained the feasibility report from CBRI, Roorkee for converting the brick kiln into induced draught technology. He further informed that presently the brick kiln is lying closed and assured that the same will not be operated without conversion to Induced draft zig-zag technology.                                         After hearing the officers of the Board and the DFSC, Fazilka alongwith representative of the brick kiln, it was decided by Competent Authority as under :- <p class="normalCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l4 level1 lfo2; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes; margin: 0in 1.35pt .0001pt .25in;">1.    The DFSC, Fazilka will suspend the license of the brick kiln by 11.09.2020 in compliance to the directions issued by the Board u/s 31-A of the Air Act, 1981 and will submit the compliance of the same to the Board. <p class="normalCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l4 level1 lfo2; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes; margin: 0in 1.35pt .0001pt .25in;">2.    The brick kiln will not operate without converting to induced draft zig-zag technology and without obtaining consent to operate of the Board and in case it is found violating the directions, legal action will be initiated against the brick kiln.                                         The proceedings of the personal hearing were conveyed to the brick kiln and DFSC, Fazilka, for compliance of hearing decisions vide Zonal Office letter no. 3096-97 dated 25.09.2020.                                         To verify the compliance of hearing decisions, the BKO was visited by AEE of this office on 30.11.2021 and it was observed that BKO was not in operation. The kiln has adopted High draft technology, however no completion certificate has been submitted to this office, in this regard. No kuccha bricks was found stored in the premises of the Kiln. The representative of the kiln informed that kiln will be operated after obtaining CTO of the Board. Also, the DFSC Fazilka has submitted copy of cancellation of license dated 11.09.2020 issued by DFSC, Fazilka, as per hearing decision. The BKO has deposited EC of Rs. 2 lacs to this office vide R. No. 73/5107 dated 24.12.2019.  The license of the brick kiln cancelled by DFSC Fazilka on 09.03.2023.                           Now, the brick kiln has applied for obtaining fresh consent to operate under the Water Act, 1974 and varied consent to operate under the Air Act, 1981 on dated 17.03.2023, for its operation after adopting induced draft technology with zig-zag firing to manufacture bricks and tiles @ 30,000 nos./day. Details of the case are as under:- <p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes; margin: 0in 7.3pt .0001pt .25in;">·         The brick kiln has submitted feasibility/technical report along with completion drawing from M/s Team Energy Systems authorized licensee of M/s Central Building Research Institute, Roorkee regarding induced draft zig-zag technology to be adopted by the kiln and Completion certificate dated 28.02.2022 via drawing no. 22/015 issued by M/s CSIR-CBRI, Roorkee. ·         As per completion certificate dated 28.02.2022 the brick kiln has converted into induced draft zig-zag technology. ·         The brick kiln has submitted an undertaking (attested by Charted Accountant i.e. M/s Vinod K. Chhabra & Associates) through Sh. Satpal S/o Sh. Lal Chand R/o Village Lakhe Wali Dhab, Tehsil & Distt. Fazilka, Sole Proprietor of M/s Shree Balaji Intt Udyog, Village Azam Wala, Tehsil Abohar, Distt. Fazilka, which is reproduced as under:- 1.   That I am the sole Proprietor of M/s Shree Balaji Intt Udyog, Azam Wala, Fazilka-Punjab. 2.   That I/we had not used coal for burning of katcha bricks for my brick kiln and I/we used the authorized agro fuels. And above statement are true and correct, may be taken as a documentary evidence. 3.   That the brick kiln has adopted induced draught technology and obtained completion certificate from THE TEAM ENERGY SYSTEM, PANCHKULA on 28.02.2022. 4.   That the brick kiln is using authorized fuel i.e. agro fuels/ bio-mass and the brick kiln was operated with FCBTK technology up to 01/10/2019 to 31/05/2020 and I/we had started the construction of adoption of ID technology on 10.09.2020 (i.e. after the hearing on 08.09.2020) and has been completed in the month of January, 2021. Thereafter, the official of CBRI visited the kiln and issued completion certificate on 28.02.2022. The EC of Rs. 200000/- (Two Lakhs only) has been deposited for 8 months of operation with FCBTK technology. Thereafter, the kiln has not been operated after 31.05.2020 till adoption of induced draught Zig-Zag technology after obtaining completion certificate from THE TEAM ENERGY SYSTEM, PANCHKULA. ·         The brick kiln has submitted bill issued by M/s B.K. Steel Enterprises and Agriculture, Longowal, Distt. Sangrur to the brick kiln on 08.03.2021 for purchase of items i.e. ID Fan and Shunt Fibre for conversion of their kiln to induced draft high draft technology. ·         The BKO has submitted balance sheet for Year 2020-21, as per which conversion of High draft of brick kiln along with purchase of Fan has been done before 31.03.2021 ·         The brick kiln has submitted certificate of C.A showing value of gross fixed assets of the industry as Rs. 21.06 lacs as on 10.03.2023.<a name="_GoBack"></a> ·         The brick kiln has deposited Rs. 25,200/- vide UTR No. SBIN523073452101 dated 14.03.2023 as consent to operate fee under the Water Act, 1974, which is adequate for period upto 30.09.2031 in orange category. ·         The brick kiln has deposited Rs. 32,400/- vide UTR No. SBIN523073455869 dated 14.03.2023 as consent to operate fee under the Air Act, 1981, which is adequate for a period up to 30.09.2031 under orange category. ·         The brick kiln has also deposited Rs. 1800/- vide UTR No. SBIN523073454923 dated 14.03.2023 as NOC fee, which is adequate.                           To verify the facts and process the application, the brick kiln was visited by undersigned (AEE) on 06.04.2023 and it was observed as under:– 1.            The brick kiln was not in operation. No kuccha bricks was found stored in the premises of the Kiln. The representative of the kiln informed that kiln has not been operated till date after the adoption of induced draft technology due to financial crisis. 2.            The brick kiln has upgraded its kiln into induced draft zig-zag technology. AVFD fan has been provided with the chimney and the length of the brick kiln (central island was less than 245 feet as required by the Board. 3.            The brick kiln has provided adequate sampling facilities with kiln stack to facilitate emission sampling. 4.            The kiln has stabilized the periphery road/movement area with brick bats/keri. 5.            The brick kiln has planted trees along its boundary 6.            The brick kiln has provided septic tank for the treatment of domestic effluent and same is being discharge onto land for plantation. 7.            The brick kiln has complied with the code of practice prescribed by the Govt./Board for such type of units as well as with the provisions of the Air Act, 1981.     Keeping in view of above, it is recommended as under:- <p class="MsoListParagraph" style="margin-left: .25in; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo5; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes;">1.    Consent to operate under the Water Act, 1974 and Air Act, 1981 may be granted to the brick kiln for production of bricks & tiles @ 30,000 nos./day using induced draft zig-zag technology for a period of 30.09.2031, with suitable conditions. 2.    Directions u/s 31-A of the Air Act, 1981 was issued to the brick kiln for its closure be dropped, please.
