Subject: -    Proceedings of the personal hearing given to M/s Neelam Plaza, G.T. Road, Ajitwal, Moga for refusal of 'Consent to establish' (NOC) under the provisions of the Water Act, 1974 and Air Act, 1981 by the Senior Environmental Engineer on 05.04.2023.   The following were present: From Board's side: Er. Parveen Kumar, Partner                       It was brought out that the industry is a hotel-cum-marriage palace and the project proponent has applied for obtaining 'consent to establish' (NOC) of the Board for establishment of hotel-cum-marriage palace with 600 person capacity.                     The application of the project proponent has been examined by the Competent Authority and it has been observed that: - 1.      The project proponent has not submitted approved building plan / site plan demarcating green area for disposal of treated effluent generated. 2.      The project proponent has not provided undertaking / proposed compliance w.r.t. guidelines as per NGT order dated 19.09.2019 in O.A no. 400/2017. 3.      The project proponent has submitted feasibility / technical report with the application which is not in accordance with the project report as: a.    In project report the PP has mentioned that the project is having 13 no. cottages, a restaurant and a banquet hall however as per technical report (page 3) the hotel rooms have been mentioned as 20 no. b.    On page no 3 of the technical report under introduction section, it has been mentioned as maximum gathering will be 700 persons however on the same page it has been mentioned under the total effluent generation head that the max strength will be 806 persons & 30 rooms. c.    On page 3, it has been mentioned that the total effluent generation per room will be 100 ltr/room, 20 ltr/ person for small gathering, 40 ltr/person for marriage gathering etc. which is not in consonance with the Code of Basic Requirements of Water Supply, Drainage & Sanitation (IS:1172-1993). And is considered in much less quantity than the IS Code. d.    On page 6, the quantity of effluent generation per function for kitchen under various heads is having wrong calculation. e.    The project proponent has proposed for discharge of effluent onto land for irrigation however the adequacy of green area has not been provided. f.     The project proponent has not proposed any grit chamber in the effluent treatment mechanism which is required as per the guidelines for hotels and marriage palaces as per NGT order dated 19.09.2019 in OA no. 400/2017. g.    On page 15 the solid waste generation has been quantified by taking into account 400 persons only however the PP is applying for 600 persons. h.    The project proponent has proposed to provide solid waste to pig farm however as per Solid Waste Management Rules, 2016 & guidelines for hotels and marriage palaces as per Hon'ble NGT order dated 19.09.2019 in OA no. 400/2017 the PP his required to provide in house management of Solid waste.                     The project proponent was issued clarification through online to submit the reply within 4 days w.r.t. the above observations for which the project proponent has failed to submit reply till date.                     Show cause notice for refusal of 'consent to establish' (NOC) under the provisions of the Water Act, 1974 and Air Act, 1981 was issued to the industry with an opportunity of personal hearing on 22.03.2023. Last opportunity of personal hearing has been afforded to the marriage palace on 05.04.2023. During hearing, the representative of the marriage palace were guided regarding the shortcomings in the application applied and the representative of the marriage palace assured that they will prepare and submit all the required documents within one week. After hearing the representative of the industry as well as officer of the Board, it has been decided that:- 1.    <span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; background: white; mso-bidi-language: AR-SA; mso-bidi-font-style: italic;">The marriage palace shall remove all the documentary shortcomings and will submit the documents to the Regional Office, Faridkot, within 3 days. 2.    <span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; background: white; mso-bidi-language: AR-SA; mso-bidi-font-style: italic;">Regional Office, Faridkot shall verify the documents to be submitted by the representative of the marriage palace and will process the CTE application submitted by the marriage palace on merits. You are requested to ensure the compliance of the above decisions of the personal hearing.     Submitted for confirmation of proceedings of the hearing dated 05.04.2023 please.
