<p class="MsoNormal" style="margin: 0cm; font-size: 12pt; font-family: Calibri, sans-serif;"><span lang="EN-US"> </span></p>
<p class="MsoNormal" style="margin: 0cm; font-size: 12pt; font-family: Calibri, sans-serif;"><span lang="EN-US">Now, the industry has submitted its reply through online system on 03.04.23 & 05.04.23, which may kindly be perused. Alongwith other submissions, the industry has mentioned as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin: 0cm 0cm 0cm 36pt; font-size: 12pt; font-family: Calibri, sans-serif; text-align: justify; text-indent: -18pt;"><em><span lang="EN-US">1.<span style="font-style: normal; font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span></em><em>As now we have installed the required ETP, therefore there is no violation at this moment. The sludge generated from the ETP will be picked up by TSDF i.e. Nimbua Greenfield Ltd. as the agreement has been done.</em></p>
<p class="MsoListParagraphCxSpLast" style="margin: 0cm 0cm 0cm 36pt; font-size: 12pt; font-family: Calibri, sans-serif; text-align: justify; text-indent: -18pt;"><em><span lang="EN-US">2.<span style="font-style: normal; font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span></em><em>Moreover, it is also highlighted that no raw material has been processed since the expiry of passbook as the passbook was valid till 17/12/2022 under Rule 6 of the Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016, vide no. Reg/PPCB/2017-22/F-134 dated 18.12.2017.</em></p>
<p class="MsoNormal" style="margin: 0cm; font-size: 12pt; font-family: Calibri, sans-serif;"><span lang="EN-US"> </span></p>
<p class="MsoNormal" style="margin: 0cm; font-size: 12pt; font-family: Calibri, sans-serif; text-align: justify;"><span lang="EN-US">In this regard, it is submitted that</span></p>
<p class="MsoListParagraph" style="margin: 0cm 0cm 0cm 36pt; font-size: 12pt; font-family: Calibri, sans-serif; text-align: justify; text-indent: -18pt;"><span lang="EN-US">A.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US">earlier the industry had applied for obtaining renewal of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. However, the said application were refused by the Board vide no. CTOW/Renewal/SAS/2022/20324390 dated 22/12/2022 and Air (Prevention & Control of Pollution) Act, 1981, vide no. CTOA/Renewal/SAS/2022/20324124 dated 22/12/2022, due to following observations:</span></p>
<p class="MsoNormal" style="margin: 0cm; font-size: 12pt; font-family: Calibri, sans-serif;"><span lang="EN-US"> </span></p>
<p class="MsoNormal" style="margin: 0cm 0cm 0cm 2cm; font-size: 12pt; font-family: Calibri, sans-serif; text-align: justify;"><span lang="EN-US">"<em>As per CPCB’s SOP for lead acid battery recycling units, the industry is required to install ETP in its premises. However, the industry not yet installed effluent treatment plant in its premises, as such, the industry is not complying with the SOPs now laid down by CPCB.”</em></span></p>
<p class="MsoNormal" style="margin: 0cm 0cm 0cm 2cm; font-size: 12pt; font-family: Calibri, sans-serif; text-align: justify;"><em><span lang="EN-US"> </span></em></p>
<p class="MsoNormal" style="margin: 0cm 0cm 0cm 2cm; font-size: 12pt; font-family: Calibri, sans-serif; text-align: justify;"><span lang="EN-US">Now, the industry has installed ETP in its premises and is complying with SOPs laid down by CPCB in this regard. Complete details of the same are mentioned in undersigned’s note dated 27.03.2023.</span></p>
<p class="MsoNormal" style="margin: 0cm; font-size: 12pt; font-family: Calibri, sans-serif;"><span lang="EN-US"> </span></p>
<p class="MsoListParagraphCxSpFirst" style="margin: 0cm 0cm 0cm 36pt; font-size: 12pt; font-family: Calibri, sans-serif; text-align: justify; text-indent: -18pt;"><span lang="EN-US">B.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US">Further, during visit to the site of the industry on 14.03.2023, it was observed that the unit was not in operation and the industry in its reply has submitted that they have not procured any raw material since the expiry of passbook, i.e. 17/12/2022.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0cm 0cm 0cm 36pt; font-size: 12pt; font-family: Calibri, sans-serif; text-align: justify; text-indent: -18pt;"><span lang="EN-US">C.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US">w.r.t. imposition of EC is concerned, the undersigned is of the view that as, earlier the industry was granted by the Board without installation of ETP at the site and now, upon instructions from the Board, the industry has installed ETP in its premises. Thus, EC may not be imposed on the unit.</span></p>
