<p>RO has reported that earlier, the consent to operate under Air (Prevention & Control of Pollution) Act, 1981 was granted to the brick kiln vide online reference no. R15GRPCTOA2425719 dated 19/03/2015, which was valid upto 30/09/2019.</p>
<p>The brick kiln was visited by the Officer of this office on 04/02/2021 and was observed as under:-</p>
<p>1. The brick kiln was not in operation during visit.</p>
<p>2. The brick kiln has converted to induced draft technology.</p>
<p>3. The brick kiln is not following the code of practice as prescribed by the Board.</p>
<p>As per record of this office the brick kiln is has not having valid consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 of the Board after conversion into zig-zag technology. SCN for violations of the provisions of the Air (Prevention & Control of Pollution) Act, 1981 was issued vide this office letter no. 265 dated 26/02/2021 to the brick kiln with an opportunity to file objection in written, but no any reply submitted by the brick kiln. Another opportunities of personal hearing at RO, level were issued vide this office letter no. 734 dated 01/04/2021 and no. 872 dated 27/04/2021 to the brick but no one from the brick kiln was attend the hearing.</p>
<p>Report was sent to the Competent Authority of the Board with recommendations to initiate action u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 against the brick kiln. SCN for violations of the provisions of the Air (Prevention & Control of Pollution) Act, 1981 was issued vide Zonal office Amritsar letter no. 1384-85 dated 25/05/2021 to the brick kiln to file objection in written, within 15 days but no any reply submitted from the brick kiln.</p>
<p>The matter was considered by the Competent Authority of the Board and directions u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 were issued vide Zonal Office, Amritsar letter no. 2406-10 dated 01/09/2021 to the district food & civil supply controller (DFSC), Gurdaspur to cancel the licence of the brick kiln and to the PSPCL authorities for disconnection of electric connection.</p>
<p>The District Food & Civil Supply Controller (DFSC), Gurdaspur has submitted compliance of the directions issued by the Board u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 and the license of the brick kiln suspend vide letter no. 647 dated 16/03/2022.</p>
<p>Now the brick kin has applied for obtaining consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 under Orange Category through OCMMS mode along with requisite documents.</p>
<p>The brick kiln has deposited Rs. 31900/- Vide online UTR No. 000842078793 dated 17/03/2023 and Rs. 41100/- Vide online UTR No. 000842079549 dated 17/03/2023 as consent to operate fee under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974, including Rs. 2900/- as NOC regularization fee, penalty fee and Rs. 500/- as application fee which is adequate upto 31/12/2027 against total gross value of fixed assets worth Rs. 49,29,102/- as on 31/01/2023 as per CA certificate submitted by the BKO. The BKO has also submitted copy of coal register authenticated by CA which shows that the brick kiln was not operation from the period of Feb-2019 to Dec-2020, hence, imposition of Environmental Compensation is not applicable on the brick kiln.</p>
<p>The BKO has submitted completion certificate issued by PSCST, Chandigarh vide letter no. PSCST/CC/1578 dated 01/12/2020 intimating that the industry has constructed induced draft Brick Kiln with zig-zag firing as per the technology evolved by the Punjab State Council for Science & Technology. The Kiln owner will ensure the implementation of recommended operating practices as per the Feasibility Report (SPL-1348). The Brick Kiln has also submitted the copy of dimensional drawing/plan of Kiln showing the length of Central Island of brick kiln is 216 ft.</p>
<p>The BKO was visited by officer of the Board on 05/04/2023 and observed as under:-</p>
<p>1. The brick kiln was not in operation during the visit.</p>
<p>2. The BKO has constructed its brick kiln into induced Draft Brick Kiln with Zigzag setting having rectangular in shape.</p>
<p>3. The BKO has installed induced draft fan with the stack of the brick kiln.</p>
<p>4. The BKO has stabilized the peripheral road around the kiln trench with brick bats/keri.</p>
<p>5. The BKO has planted trees along the boundary of Brick Kiln. The BKO was advised to plant more trees around the boundary of the kiln.</p>
<p>RO has recommended that </p>
<p>1. Directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be issued to the DFSC, Gurdaspur to restore the license of the brick kiln and to the PSPCL authorities to restore the electric connection of the brick kiln permanently.</p>
<p>2. This office may be allowed to grant consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 to the brick kiln for period upto 30/09/2027 with suitable conditions.</p>
<p>In view of the above, it is therefore, recommended as under:-</p>
<p>1. Directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be issued to the DFSC, Gurdaspur to restore the license of the brick kiln and to the PSPCL authorities to restore the electric connection of the brick kiln permanently.</p>
<p>2. RO may be allowed to grant consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air Act 1981 to the brick kiln for period upto 30/09/2027 with suitable conditions.</p>
