<p class="MsoNormal" style="text-align: justify;"><span style="font-family: tahoma, arial, helvetica, sans-serif;">Sir, the observations relating to application of the industry are as under:</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"> </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"> It is submitted that the industry is a rice sheller unit, which falls under small scale orange category and has been established after obtaining consent to establish (NOC) vide no. CTE/Fresh/FZR/2022/19285770 dated 19.07.2022, valid upto 18.07.2023 for the manufacturing of Raw Rice with Dryer @ 10.0 TPH and Sorted Rice @ 10.0 TPH, under Orange category, with certain conditions mentioned therein and following relevant special conditions as under:-</span></p>
<p class="MsoListParagraph" style="margin-left: .3in; text-align: justify; text-indent: -.3in; mso-list: l0 level1 lfo1;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><!-- [if !supportLists]-->1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><!--[endif]-->This Consent to Establish (NOC) is granted for the establishment of rice sheller unit in 41 kanals 16 marlas bearing hadbast no. 135, khasra nos. 55//8(8-0), 9(7-0), 12(8-0), 13(8-0), 14(8-0), 15/1(2-16) in the revenue estate of village Shianpari, Teshil Zira, District Ferozepur.</span></p>
<p class="MsoListParagraph" style="margin-left: .3in; text-align: justify; text-indent: -.3in; mso-list: l0 level1 lfo1;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><!-- [if !supportLists]-->2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><!--[endif]-->The industry shall utilize its site falling in khasra nos. 51//12, 9/1, 51//19, 22/2, 55/2/ and 55//1/2 as approach/rasta only.</span></p>
<p class="MsoListParagraph" style="margin-left: .3in; text-align: justify; text-indent: -.3in; mso-list: l0 level1 lfo1;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><!-- [if !supportLists]-->3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><!--[endif]-->The shall comply with the CLU condition to not carry out any kind of construction activity upto 15m from centre of wires and shall leave buffer Zone on both sides of 15 m.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"> Now, the industry has applied for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981 for the manufacturing of Raw Rice with Dryer @ 10.0 TPH and Sorted Rice @ 10.0 TPH, under Orange category. The detail of case is as under:-</span></p>
<p class="TableParagraph" style="text-align: justify; margin: 4.75pt 0in .0001pt 2.95pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"> The industry has submitted completion certificate regarding installation of separate cyclone separator as APCDs for the Pre-cleaning section and sheller section as per attached drawings/ specifications.</span></p>
<p class="TableParagraph" style="text-align: justify; margin: 4.75pt 0in .0001pt 2.95pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"> The industry has submitted building plan from Competent Person under the Deptt. of Factories. </span></p>
<p class="TableParagraph" style="text-align: justify; line-height: 86%; margin: 4.75pt 0in .0001pt 2.95pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"> The industry has deposited Rs. 54,000/- vide UTR/Ref. No. SDL123894533 dated 17.02.2023 as water consent fee under the Water Act, 1974 and Rs. 54,000/- vide UTR/Ref. No. SDL123894375 dated 17.02.2023 as air consent fee under the Air Act, 1981, against the fixed assets of Rs. 91.54 Lakhs as on 31/01/2023 as per CA certificate dated 02/03/2023 submitted by it. Thus, the consent fee is adequate upto 30/09/2027 under each Acts.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"> The industry was visited by EE & AEE of this office on 27.02.2023 and it was observed as under:-</span></p>
<p class="MsoListParagraph" style="margin-left: .3in; text-align: justify; text-indent: -.3in; mso-list: l1 level1 lfo2; background: white;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><!-- [if !supportLists]-->1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><!--[endif]-->The industry was not in operation during visit. The industry has installed machinery for the production of sorted raw rice with one dryer. The industry has provided two shelling section.</span></p>
<p class="MsoListParagraph" style="margin-left: .3in; text-align: justify; text-indent: -.3in; mso-list: l1 level1 lfo2; background: white;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><!-- [if !supportLists]-->2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><!--[endif]-->The industry has provided brick paved road from main gate of the industry to the rice room/husk area for the movements of vehicles.</span></p>
<p class="MsoListParagraph" style="margin-left: .3in; text-align: justify; text-indent: -.3in; mso-list: l1 level1 lfo2; background: white;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><!-- [if !supportLists]-->3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><!--[endif]-->The industry has provided separate Cyclone Separator as APCD along with stack of adequate height to control the process emission from shelling section (1 & 2) as well as paddy cleaner of dryer.</span></p>
<p class="MsoListParagraph" style="margin-left: .3in; text-align: justify; text-indent: -.3in; mso-list: l1 level1 lfo2; background: white;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><!-- [if !supportLists]-->4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><!--[endif]-->The industry has provided stack of adequate height with the APCD and provisions to facilitate emission sampling.</span></p>
<p class="MsoListParagraph" style="margin-left: .3in; text-align: justify; text-indent: -.3in; mso-list: l1 level1 lfo2; background: white;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><!-- [if !supportLists]-->5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><!--[endif]-->The industry has provided brick wall of adequate length & height around husk discharge / storage area and further mesh wire has been provided above the said wall, the height of said wall is 15 feet.</span></p>
<p class="MsoListParagraph" style="margin-left: .3in; text-align: justify; text-indent: -.3in; mso-list: l1 level1 lfo2; background: white;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><!-- [if !supportLists]-->6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><!--[endif]-->The industry has provided septic tank for treatment of domestic effluent with provision to discharge onto land for irrigation along the boundary.</span></p>
<p class="MsoListParagraph" style="margin-left: .3in; text-align: justify; text-indent: -.3in; mso-list: l1 level1 lfo2; background: white;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><!-- [if !supportLists]-->7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><!--[endif]-->The industry has planted trees along its boundary wall.</span></p>
<p class="MsoListParagraph" style="margin-left: .3in; text-align: justify; text-indent: -.3in; mso-list: l1 level1 lfo2; background: white;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><!-- [if !supportLists]-->8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><!--[endif]-->11 KVA wire passes through khasra no. 51//12, which is not part of the industrial premises and hence is located outside the industrial boundary wall. </span></p>
<p class="MsoListParagraph" style="margin-left: .3in; text-align: justify; text-indent: -.3in; mso-list: l1 level1 lfo2; background: white;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><!-- [if !supportLists]-->9.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><!--[endif]-->Khasra no. 51//12, 9/1, 51//19 and 22/2, are not part of industrial premises and the land bearing these khasra nos. is being used as approach/ rasta. Further khasra no. 55/2 and 55//1/2 are part of industrial premises and neither any industrial activity nor any industrial shed has been constructed in these khasra nos. </span></p>
<p class="MsoListParagraph" style="margin-left: .3in; text-align: justify; text-indent: -.3in; mso-list: l1 level1 lfo2; background: white;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><!-- [if !supportLists]-->10.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><!--[endif]-->A high tension wire of 33 KV passes through khasra no. 55// 1/2, 2, 9, 8, 13 & 14 (copy of building plan approved by Competent Person of Director of Factories attached). Further, a portion of the rice sheller which includes a part of paddy storage shed, unloading of paddy section for processing etc. is located within 15 meters of above said high tension wire. However, no machinery for processing of paddy straw is installed within 15 meters from HT wire and moreover, no construction activity has been carried out directly beneath the transmission high tension wire. Further, the industry has submitted letter from Asstt. Executive Officer, PSPCL, Sub Divisional Office, Makhu, which is reproduced as below:</span></p>

<p class="MsoListParagraph" style="text-align: justify; background: white; margin: 0in 53.1pt .0001pt 53.1pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><em>"It is certified that a request from M/s Shree Ganesh Agro Foods, village Shianpari, Makhu (Rice sheller) is received on 14.03.2023, regarding the certification of construciton, if exits, below the High Transmission wire.</em></span></p>
<p class="MsoListParagraph" style="text-align: justify; background: white; margin: 0in 53.1pt .0001pt 53.1pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><em><span style="font-size: 4pt;"> </span></em></span></p>
<p class="MsoListParagraph" style="text-align: justify; background: white; margin: 0in 53.1pt .0001pt 53.1pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><em>In context of the same site has been visited by me personally, and it is certified that, no construction has been done till date (14.03.2023) in HT Zone/ below this HT line by the Shri Ganesh Agro Foods."</em></span></p>
<p class="MsoListParagraph" style="text-align: justify; background: white; margin: 0in 53.1pt .0001pt 53.1pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"><em> </em></span></p>
<p class="MsoNormal" style="text-align: justify;"> </p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"> As per Govt. of Punjab, Department of Science, Technology & Environment notification no. 10/48/2004-STE-(4) / 932 dated 15/10/2013, the industry shall not be located in high tension transmission zone of PSPCL. However, there is an ambiguity whether only construction activity of rice sheller unit, is restricted in high tension transmission zone of PSPCL as per the said notification or the entire industry irrespective of location of passage of high tension wire through its premises, is not suitable for establishment as per the guidelines.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: tahoma, arial, helvetica, sans-serif;"> Keeping in view of above mentioned facts, it is, therefore, recommended that Legal Opinion from Senior Law officer of the Board may be taken for deciding the application for obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981, please.</span></p>
